      @@evanchismark3092 there sometimes are exceptions but it's usually to do with dangerous criminals that they don't want in their own country. Her bs won't be seen as important it's not even terroristic or necessarily harmful to anyone, but herself and the victim. Plus it wasn't criminal court case. She's free to roam wherever she likes but she won't have that freedom in USA from the public eye... everyone knows her name and face and what she did and said.... Only reason why she's fleeing honestly

      ​@@evanchismark3092 Extradition doesn't matter, because this is a civil case, not a criminal one. The court can order her bank to pay, and a lien could be put on her house or car. They can't force her to go to jail without a new trial in the criminal system though. The remedy in this trial is just money.

Usually courts don't do that, unless there is a huge risk. She is far away from landing in prison yet, but she might end up there. What a train wreck.

Even if she had given false info to police, her entire scenario was so batshit insane that they would not have been investigating it because the cops know a crazy when they hear one. They probably had thousands of crazies ringing them every day about this case. The more infamous a crime is, the more crazies come out to try and become a part of it.

    If a default judgement is made against her, Ashley still has legal remedies to have the judgement vacated. Running away to Bali for a few months, however, is not one of those remedies. I’m guessing she didn’t consult a lawyer and instead tried to rely on Google to provide her with legal information (which she has misinterpreted based on her jurisdiction argument). I’m not going to pretend to understand her actions, but I am truly baffled by them.
    Edit: Congratulations for being mentioned in Ashley’s response to the lawsuit. If you want to read it, don’t. It hurt my brain.

      She filed the suit "Pro Se" and it's obvious from the filing - the way she lists stuff, regurgitates paragraphs and conflates civil and criminal law would be hilarious if she wasn't on the hook for a lot of money and had a kid to look after and what she did to that poor Professor.
      I am not even American and I think I have a better grasp of US law than her Googling led her to. She should have hired a lawyer, argued jurisdiction and it would have been dropped if they were to move it to Texas (personal opinion) due to logistics - as long as they could stop her making TikToks which is another matter entirely😂

The proper jurisdiction and venue explanation for this lawsuit is "Jurisdiction is proper under 28 U.S.C. § 1332 because there is diversity of citizenship, and the amount in controversy exceeds $75,000. Venue is appropriate under 28 U.S.C. § 1391 because Professor Scofield is an Idaho resident and a substantial part of the events giving rise to the claims occurred in Idaho."

    A few legal points. Yes, she can definitely be sued in federal district court in Idaho. It is in federal court because of diversity jurisdiction (plaintiff and defendant are from different states). The Federal Court for the District of Idaho is also a good option for Scofield, because it is more convenient, but she also could have sued in federal court in whatever state the TikToker is from. The venue issue would only come up if Scofield sued in state court (not federal), but that isn't the case here. Also, if you file in the wrong court, the judge will often throw it out and tell you where to go instead. So, the fact that it was allowed to move forward shows that it is the correct venue.
    Also, then they say that she didn't file a response, that means that she didn't give any defense during the proceedings, so yeah, of course she was found in the wrong. She filed something after the judgement, but that was too late to count. This is a civil trial, so she isn't presumed innocent. If you don't defend yourself in the course of the trial, you will get a judgement against you.

    Normally that's right you have to sue someone in their state but you can sue in your own state if you find personal jurisdiction for the other person (something that ties them to your state). I would assume they found some personal jurisdiction before proceeding with the lawsuit.

    Funny how she chose Bali to flee to. Indonesia and the USA do not have any actual extraction agreement. But... if both countries agree to it they will send the person(s) back. Legally she can only stay in Indonesia for 30 days on visitors' visa and the extension has to be asked at the airport before entering the country.

    Although I am not up to date on legal things either, I would feel that Schofield is within their rights to sue in their home state because the defamatory remarks were made via the internet and therefore a federal court seems appropriate I don't think that the district court is considered the same as the state court system

    So to explain the US legal system a bit in regards to this case: Scofield is suing in civil court of the Federal court of Idaho. Since this is an inter-state dispute, the federal court would be the smarter option. She could have technically sued Ashley in Ashley's state or any other state Ashley has property, buisness, or other connections in (including if she was in that state when served?), but that would require travel and it's possible that the defamation laws in Ashley's state are not as favorable as in Idaho. In my not so professional opinion, Scofield filed in Idaho for convinence and maybe to make it harder for Ashley to get to court in person, but it's not really a shady move.

    One of my neighbors recently accused a friend of mine of murdering another friend of mine.
    Totally way tf out of line, almost as insane as this broad.
    After a back and forth with him I got heated. I finally told him I gave him new information and he was still acting like a "Daron". I filled him in on details he didn't have and Daron still kept accusing my other friend of murder.
    So I finally called him out on all his bullshit, reminded him I gave him information he didn't have. Then point blank I asked "Daron" What the fuck is wrong with you!?"
    So this broad running her beaters accusing Rebecca of murder, for the whole world to see, really fucken pisses me off. I hope she gets everything taken away and she has to spend years making it up to Rebecca. To accuse people of such a horrible thing is unconscionable.

    And BTW, as someone who actually had to sue someone....I know it varies state by state, but the state you live in is the state that the defendant has to go to. And oh well for them if they don't live in that state, maybe don't rip people off or defame them and you won't be put out. But if you can't afford to travel there I am positive you can "attend" through zoom or another video conference service. At least that is the way it works in CT where I live, and it sounds like that is the same for Idaho.

    So the thing with legal venue in the states is, you do need proper venue. HOWEVER, a judge cannot just rule improper venue on their own. If she wanted to say the venue was improper she needed to file a motion with the court, but she didn’t, and by not doing so she loses the ability to now say that she can’t be sued there. And who knows, maybe the judge would’ve ruled this improper but the judge can’t rule on a motion that doesn’t exist. If it was improper, she needed to bring it up BEFORE losing by default.

      And her reasoning for not filing the motion isn’t a valid excuse obviously. Like let’s say you are sued for fraud and at the same time, you are defrauded by someone else. That doesn’t mean you just don’t have to respond to the suit against you.

    Okay so 1 it's not an improper venue it's valid because of her defamation and slander. And the reason it's legal to sue over different states is because it's still in the USA and the laws aren't changing in this case no matter what hole you're in, it just makes it harder to do a bit but it can be done and has.
    And I feel like she's mad because she got caught doing Rebecca dirty and causing so much damage to that poor woman and the majority isn't eating it up like she had hoped for.

    It doesn't matter where you reside, it matters where the crime was committed. I live in Philly and I had an ex who spent 2 years in a federal prison in Virginia bc that's where he broke the law lol so I'm pretty sure thats how it works. You can sometimes request to get transferred to a jail closer to home, but the actually trial would have to take place where the problem started.

    She makes a good point about the filing procedures, but she should have filed a motion within the correct timeframe to have the lawsuit fixed. She didn’t because she knows if she did they would just adjust the lawsuit and she’d have no way out of it at that point. She’s trying to weaponize ignorance legally while also incriminating herself on social media simultaneously 😂
    While posting about her fleeing the freaking country!
    It’ll catch up with her, one way or another she will get her karma. But right now we all can relish in the fact that she made herself look like a fool and her victim won in the eyes of the public. Which can be a lot worse for her since she has a decent platform now. I really hope Miss Rebecca is doing ok now and she knows that all of us are here to support her!

    It is not the wrong venue. Over 75k and it plays out in federal court which allows the case to be heard in TX, Idaho or DC.

    She really doesn’t wanna admit that she can’t read tarot cards. So she’s gonna lose the case cos she’s fleeing the country. And then when she comes back she’ll have to face the consequences. Can’t run forever. She’ll need a visa to stay in Bali more than a month. By then she’ll likely have defaulted on the case and thus lost. She’s being sued in Idaho cos the person affected lives there. That’s how it works. For a psychic she sure didn’t see this coming.
