The DOJ agreed with Abrams when they charged Cohen with the same crime at a federal level. It's either the DOJ or FEC that prosecutes federal campaign violations.

He is not alone, most people don't understand it because it is a very specialized area of law. Bradley Smith understands it, and he says this was not illegal. He should know, because he is a professor of law who specializes in federal election law, and he helped write the regulations for these laws as Chairman of the Federal Election Commission.

The FEC was aware of the Trump payment and declined to pursue it.
Good day fensterrose1585 - while your statement is technically true it may miss a broader reading and understanding of this particular FEC case against Trump.
In short, the Federal Election Commission is comprised of 6 commissioners: half appointed by republicans and half by democrats. For them to proceed on any issue there must be a min of 4 votes in favor.
The commissioners oversea a group on non partisan career investigators known as the Office of the General Counsel or OCG. The OCG essentially do all the leg work in determining whether or not to bring a case and then give a professional report to the commissioners either recommending or not recommending the case be pursued. The OCG as a non partisan group have made recommendations for bringing forward cases against both Dems and Repubs in the past that ultimately the commissioners accepted.
However in more recent times these same investigators have recommended bringing forth 59 cases but the commissioners have only pursued 7 or less than 12%. If you have been following politics for awhile now you might already be aware that this has been a widely known and ongoing issue with the FEC and its enforcement.
With particular interest in Trumps alleged cases the professional staff had recommended opening cases 26 times. And not one of the Republican members voted in favor of even one case being opened.
However this same FEC board also voted in favor of cases for the other two parties involved that ultimately led to Michael Cohen and AMI and David Pecker. And under both of those cases those parties were found in violation of campaign finance laws.
So just a heads up to provide further context about your FEC statement that while true maybe misses the larger context. In short - had FEC actually been doing its job and not showing fealty to Trump - evidence suggests they would have pursued a case against Trump.

Cohen made a plea deal to get less time in prison for his own crimes if he claimed he violate campaign laws at the request of Trump, (even though he didn't). Pecker was BS-ed into believing he violated laws just to make him a witness against Trump. This shows how corrupt the whole process is.
Because the FEC is dysfunctional since it's members are evenly split b/w dems and gop and it needs a majority of the members to act.

Forgive an old man for this, I honestly didn’t bother following a trial that should never have happened, but did Trump use Campaign funds for this or personal funds? Or are we saying that once he starts campaigning all his personal spending becomes campaign funds? I have never heard which pot of money this camp from so I am not sure. And side point those would be federal issues and not even part of this state case right?

And yes I am sure New York State has campaign finance laws but the ultimate authority on federal political campaigns and their funding is the Federal Election Commission and not the NYC DA. But hey we will see where this goes as the appeal process happens and we will see if it has bigger consequences to NYC going forward concerning businesses wanting to do business there.

You are right, and the reason no one has said what these payments should have been recorded as instead, if "legal fees" is wrong, is because Bragg is effectively claiming they were an illegal campaign contribution by Cohen made at Trump's request. That is how Bragg is trying to make this into a felony, but that is misapplying the law to invent felonies just for Trump.
Because it was not. The evidence made that very clear, as did the testimony. He would have broken the law one way or another. There was no retainer agreement with his lawyer and no evidence that he performed any actual legal services during the many months in which Trump paid him money to reimburse him - plus an added 100% to cover income tax Cohen would have to pay. All that was written down on paper by Trump's now-imprisoned CFO, Alan Weisselberg. The whole scheme was hatched at Trump's request and by Trump, Cohen, and Trump's friend, David Pecker, who published the National Enquirer. Pecker also published fraudulent stories about all of Trump's political rivals during the primaries and the subsequent campaign - i.e., Trump was part of a conspiracy to lie to the voters, which is a crime under New York State law.
