Also it is her private property which mean it fall under her responsibility unless it fall under public safely. The only reason that they was able to get a court hearing so soon is that the flood water have become a issue of public safely.

This drain looks off to me...closer to that woman's house which is why I can see her getting upset. It won't flood the roads, but it will flood her front lawn to get to that drain. I wouldn't go to the extreme of filling it up with cement.

I have noticed that none of the neighbors are putting a storm drain on their properties. I believe this home owner when she says the drainage on her property is eroding her property. Instead of complaining, the neighbors on either side of her property can install drainage systems to serve the neighborhood on their properties. Problem solved.
I can see her point, if the drain pipe runs under her property and is leaking it will erode the ground under her property and her lawn will collapse . Either the city or the developer should have repaired the pipe to start with. But she should have handled it differently.

If I lived in the HoA I'd go to the president and demand they call an emergency meeting. None of this needed to go to court AND it could have been fixed the week she did this. HoA's have the power to make repairs and to charge the responsible party, and if they refuse to pay to put a lien on the property and compel a sale. All they needed to do was pass a special emergency resolution that was specific to the situation and specific to her as a one time solution. No long term issues, problem is solved within two weeks (assuming it takes a few days for the crew) and the problem neighbor is buh bye. I've seen HoA's take peoples homes over having the wrong color of drapes or having the audacity to park in their own driveway (some HoA's require trucks be parked in the garage only).

No long term issues, problem is solved within two weeks (assuming it takes a few days for the crew) and the problem neighbor is buh bye.
I've seen HoA's take peoples homes over having the wrong color of drapes or having the audacity to park in their own driveway (some HoA's require trucks be parked in the garage only).
But nobody is asking why was that put on her property without her permission?

The homeowner has been in the news and begging for county help. The county screwed her and now her only solution was to fill it since the county wouldnot fix their own drain on her property. Unbelievable.
This is still ongoing? Jeez, the wheels of justice do grind slowly, eh? Arrest her, fine her, have the city fix it and bill her. Her neighbors have suffered long enough. End of story.
One thing for sure. She's the most hated person in that neighborhood.

The pipe was put there in the 70s (I think) before the HOA even existed, she moved there in 2012-215 or something. She filled it in because (according to her) the city didn't get her permission to put it in the yard to begin with, over 30 years before she bought the place. She's a nutjob.
