  • When Cecil Hambrough left Ardlamont House in West Scotland on the morning of August 10th 1893 with his friend Alfred John Monson, and a mysterious man named Edward Scott, he had no idea that it would be for the last time. Monson and Scott returned to the House a little time afterwards to report that 20 year old Hambrough had accidentally shot himself. But what appeared at first to be a tragic accident led to one of the most famous murder trials in British history, and to Scotland's most sensational case since the Trial of Madeleine Smith in 1857. The Ardlamont mystery, as it became widely known, is noted also because it heard evidence from Dr Joseph Bell - the man whom Arthur Conan Doyle based the character of Sherlock Holmes...

Mark, this episode is a masterpiece. You fuse rare analytical and literary gifts. Your summation of the evidence is mercilessly logical and cumulatively irresistible. Then the barrister turns novelist and you deftly sketch character and both vividly and persuasively reconstruct events.
Our villain here possessed extraordinary nerve. Two murder attempts within 16 hours, the second necessarily improvised -- outstanding resilience. Had he been put in Lord Lucan's position of embarrassingly murdering the wrong woman, he would have retained his resolve and momentum when the right woman appeared. Strange how the qualities of deviousness, tenacity and audacity brought him no business success.
By the way, in America in 2020, the underwriters are obliged to pay an innocent spouse beneficiary even in the event of provable chicanery by her husband. That case may have been worth litigating. I Hate to see insurers skate.
    Bravo and thank you.

@@barrydysert2974 Thank you for your appreciation of Mark and for my comments.
I think Mark has a brilliant concept for a series, focusing on people who evaded justice and then relentlessly establishing their guilt.
Relatedly, I like a murderer who is trying to better himself. Not a fan of a Dahmer who eats victims or a Bundy who defiles corpses. Give me a calculating bounder or rotter any day. Mark finds these types, and details their financial challenges and murderous business-plans with the skill of a forensic accountant.
Murder for profit would carry a prohibitive risk premium today with CCTV and DNA. But for an ambitious Victorian it could represent a bold move that solved all problems at a stroke.
One last point, it seems our villain here did four years at hard labor a few years after the murder (he apparently served four of five). At 60 he was apparently still up to no good in South Africa.. This suggests a strong constitution. Two years of hard labor broke Wilde's health and spirits for good, and Wilde was by no means a weakling.

Another brilliant presentation! I have watched this smashing documentary - The Ardamamont Mystery, an interesting case for sure and can only say thank you for such excellent research reported in a manner that completely fascinated me, Mark! It takes you a long time to produce this with the level of research and investigation you do, but I really appreciate it. You have examined the evidence of the case that gripped Victorian Britain, putting forward your own theory as to why Cecil Hambrough was murdered. The documentary was interesting in many aspects: it recounted the atmosphere of late-Victorian crime investigating and court procedures, gave insights into the characters. The case itself was very intriguing in its complexity and described in a clear, concise way. The research undertaken by yourself on this case, history, and also the post-trial life of the accused is excellent. Thanks for your diligence and clearly very professional abilities in bringing the telling of this long ago not remembered murder incident.
The accompanying photos and your impressionistic drawings in the documentary help us to keep track of the characters involved and the scene of the trial. You are by far my favourite storyteller, Mark Maguire!
So all in all, it’s the perfect subject matter and great delivery and overall, just an exciting documentary. How could 10 people dislike this video? I am sorry to say, but I think of them as people with no taste. By the way, this is the best channel on RUclips for crime documentaries.

You are also a writer- may I say,( from a Sherlock Holmes fan)- he has nothing on you when it comes to solving a case: the way you think it went, and how you break down every detail. You are also an Attorney! because you make so much sense, it is stunning. In other words... you are simply the BEST! YOU give justice to the victim(s), where there was none.Bravo!

Another fascinating case. The only mystery here is how Monson expected to get away with it, given the incriminating evidence he was leaving in his wake. But get away with it he did, thanks in large part to a biased (incompetent) summing up by the Judge. A forensic analysis of the facts as is usual from Mr. Maguire.

No one would believe the verdict! In other cases it has been clear why people got away with things - cronyism, mistaken misogyny in that they would not believe a woman capable, snobbery etc maybe even bribery, blackmail or links to the accused, but the judge's summing up and the ludicrous defence in this one beggar belief. Monson was a nobody, a bankrupt, did he have some last hold that no one knows about? I would dearly love to know more about Mrs Monson's role in all this. How old was she?.

Wow. 21 seems just a little young to suddenly come into £26 million!
I can only imagine what I'd have done in that situation; I'm picturing my own private Gulfstream jet stocked with a wet bar & an Austrian chef...penthouses in NYC, LA, London, Tel Aviv, Rome, Miami, Honolulu & Paris...a fishpond stocked with sharks & a giant octopus...a vineyard in Australia and maybe a private Polynesian island or two...
Mum & Dad- thank you for teaching me about things like a work ethic, having a family & real friends as opposed to sycophants, retirement funds, grocery shopping, laundry...all the boring stuff that nobody would ever want to shoot me in the head over! (Not to mention making sure I knew how to swim!)
FWIW, I always marveled at how many britons can't swim, despite living on a very small island. My school used to take us to the Lisson Grove Swimming Baths each Friday, just to ensure we could all at least keep afloat.

Wow, that Ardlamont estate is certainly stunning, and it was an auspicious place for Monson. Thank you for sharing the photos/even more angles would be welcome. Edited to add, Found more on the Hambrough's castle in Wikipedia. It looked foreboding and wasn't lucky for their family. Be that as it may, "Scott" would have had to have been at the site of the near-drowning, to know immediately whether he would be needed the next day. Poor Cecil! That jury was not comprised of hunters; I would imagine that a hunter walking on an unstable wall would do everything in his power to take care not to slip and to sacrifice bones to keep gun pointed away. The idea is preposterous that he would walk on a wall. How is that a stalking method?! Too bad the prosecution didn't try to reenact a fall which would involve the gun flying up in the air, rotating and pointing at the back of the head and firing, to prove it was physically impossible! The prosecution was overconfident in the obviousness of this, although they did have an expert testify that it was impossible.

Mark John Maguire you have done it again! Captivating narration and wonderful sketches. I wonder if Sweeney was actually the 'hit man' enticed by Monson with the promise of easy money once the deed was done. Either way, both Monson and Sweeney deserved conviction. I wonder too, whether the secret hand of freemasonry may have played a part in freeing the rogue killer Monson?

Another beautifully crafted coverage of, for me, an unknown case!
Mark, there are some facts in the case which are weird to say the very least.
Assuming that Monson and Scott were accomplices in the plot to murder Hambrough the initial method of choice seems overly convoluted. Boring a hole in a small boat in order to sink it offshore may have been plausible in theory but, for all the preparation, the vessel doesn't seem to have gotten very far away from the beach. Hambrough, unable to swim, successfully made it on to dry land and secondly the boat was effectively retrieved for examination (10:23) so I'm assuming that they never ventured past 15-20 metres or so.
Why didn't Monson try to drown Hambrough whilst still in the water I asked myself.
Firstly Hambrough was younger and possibly in better physical health than his erstwhile friend and could possible have fended off a drowning attempt. A look at Google Earth also shows that Ardlamont House is extremely close to the shoreline and, given the likelihood that Hambrough was frantically shouting for help the risk of one or more eye-witnesses to the unfolding events of the 9th. August was perhaps deemed too great to chance.
Surely a much better plan would have been for all three to head out into deeper water (2-3 hundred metres plus), either in one and/or two boats if they didn't want Scott directly implicated, hit Hambrough across the head and then throw him overboard. It could then be said that he fell and innocently hit his head on the rail, fell unconscious into the water and drowned; In failing light they searched and searched but failed to find the body. Something much more palatable for a jury to believe.
The suicide notion is of course quite risible, leading to the unfathomable verdict handed down by the jury. Not Proven shows a lacking in the prosecution case which as stated lent on circumstantial and forensic evidence, but the very notion of inflicting a fatal shot to the back of the head by accident should never have been considered, thus leading to suspicion being laid firmly at the feet of Monson and Scott.
Wikipedia does interestingly mention something at variance with your video. It states as following, "Estate workers heard a shot, then saw Monson and Scott RUNNING to Ardlamont House carrying the guns. They were cleaning the weapons when the estate butler asked what had become of Mr. Hambrough. Monson replied that he had shot himself in the head by accident while climbing a fence".
I believe that you suggested that they walked back to the house (3:46) as opposed to running.
If the Wiki commentary is truthful, (which I very much doubt), then it's interesting how quickly Monson proffered a convenient explanation for the shooting. At that stage there was the potential for any number of explanations as to the reasons behind the fatality. The police hadn't yet investigated but Monson had already formulated a hasty scenario to relate to the authorities. He had told Dr. McMillan that he and Scott 'had become separated from Hambrough' at the time of the event which by their own admission ruled them out as eye-witnesses; so it is illogical to suppose that they knew exactly what had happened!!
Just why it was that the well-connected Hambrough family didn't appeal the verdict in light of the bias shown by Lord Justice Clerk MacDonald towards the defence case we will never know but it is an example of the appalling nature of the judicial system on occasion. John Comrie Thomson on the other hand was shown to be a very shrewd defence attorney, cut from the same cloth as Sir Edward Marshall Hall.
Anyway thanks again for a wonderful video and I await the next one.
Happy Xmas and New Year Mark.
    Nick Harvey.

Yes I tend to agree that they lost a good opportunity when they didn't 'drown' him out in the bay.
I do think though that Monson sought out help from Scott, not only to act as a false witness, but to ensure that in the event of things going wrong then Scott could act as an extra pair of hands if things got physical.
But I agree that there would have been no need to pre drill holes in boats when an accidental shove 1/4 mile off shore would have brought about Hambrough's demise.

Of all the cases I’ve listened to, this maybe the most complex. It really boils down to the forensic evidence which varies widely. Obviously, it would be very difficult for a self inflicted wound be be administered to the back of the head.

I agree - I very nearly abandoned the case because of the difficulties of the insurance and entailment issues. I felt it impossible to look at the crime without unravelling as much of this as was possible - but to do so in 1 hour seemed tough. It is a very complex case for this reason alone.
