  • I just passed the patent bar and figured I would share my experience after failing two other times. Drop any and all questions below if they are not answered in the video.
    If necessary, I can also do a separate video on how to register for/sign-up for the patent bar.

    Super helpful info. I’m a mechanical engineer and currently help write patents at a small firm and I am seriously considering becoming a registered patent agent. It seems pretty daunting, especially while working full time and with the cost of the prep course. I’m thinking about just becoming more familiar with the mpep and trying to find practice questions to start out

      I think it's doable, especially since you already have some exposure to the patent application process. You could just work with the 3 free exams posted on the USPTO website and practice looking up the answers using the pdf MPEP online. You also may be able to find some explanatory videos on RUclips to fill in the gaps as necessary.

      It might be worthwhile to talk to your employer about getting some support for training courses and dedicated time per week for studying. They usually have a training budget allocated.

    Hello! Thank you for doing this video! I’m taking the Patent Bar in a month, and I’ve been doing a ton of questions to prepare.     Thank you so much for sharring !!!! I wish I saw this video eariler. I didn't focus as much on the skill of looking up information in the MPEP during my first attempt, relying more on my memory and understanding of MPEP 700 and 2100. I absolutely agree that becoming familiar and comfortable with the MPEP through question look-up is crucial. Following your advice, I'm doing 50 questions with look-up every day until my second try. Could I ask about your correction rate and speed at the end of your preparation? Thanks!

      Hi! It's hard to give an exact speed as I don't remember my timing beyond just being able to answer and look up information within the practice exam time constraints. However, when I first started, it did take me a little longer, and slowly I did become faster. By exam day I was able to look up (or at least know where to look up) each question within the requisite time. There were even some practice exams that I was able to finish early, but on the actual exam I had to guess on the last 2 questions in each section. So maybe shooting for finishing practice exams 15 min early is a good timing goal, just so you have some wiggle room to work with on exam day. By exam day I was getting 70-80% correct on the USPTO released exams.

    Great perseverance on your part. I Started studying today. I like how you reverse engineered gaining of knowledge from the questions itself. Btw let us hopeful’s know did passing the patent bar help you find a job ? I’ve gotten my nj license now taking patent bar.

      I would say that having passed the patent bar is definitely a plus because 1 you won't have to spend time to take it when you start employment, and 2 it shows employers you are serious about wanting to prosecute patents. However, I would say what helped me find a job was networking as much as possible after passing the patent bar.

    Congrats on passing! Looking up 95 percent of the exam, did you get or believe you got about 95 percent of it correct? I am interested in this strategy because I previously read that you could only reasonably expect to look up around 9 questions.

      Thank you! It's hard to say what my score was in the actual exam, but on full-length practice exams that I took right before the real one, I was scoring in the low 80% range. There would always be a few questions I just couldn't find or were randomly super difficult.

    Are the correct answers typically word-for-word as provided in the MPEP, or are they mostly "trick" answers (e.g. the LSAT had "trick" answers where the prompt would say "some", but a wrong answer would use the word "most")?
    In other words, will the correct answer be obvious assuming you are able to correctly locate the relevant section?

      Yes! I did not find there to be any "trick" answers so long as I was able to locate the wording in the MPEP. The correct answer would stand out once I was in the right chapter. If I couldn't find the wording in an answer, I was typically in the wrong chapter.

    What is your sceintific background? I am a current BS in Chemistry, working in biomedical research, unsure if I get an MS/MEng/PhD/JD.

      I have a BS in Neuroscience and spent some time in a Chemical & environmental engineering lab during undergrad. I am now an attorney. I have heard of people getting their MS or PhD prior to law school, but I was not aware of such until after I got my JD. I have also seen people enter the patent realm just with a PhD. I don't have either an MS or PhD so I think additional schooling is helpful, but I wouldn't say one degree is more important than another. This all also depends on what kind of job you are aiming for.

    Where did you find the 1100 questions?

      All my questions were from PLI. The USPTO also has 3 practice exams that are publicly shared on their website.

      I tried to do all the 1100 questions including the customized exams. It turned out that there are a lot of old law questions in customized exam which is out of date. I did not encounter any old law questions myself and I have not heard anyone who had old law questions in 2023.

    Studying for the patent bar is like studying a bunch of frcp rules is there a more better way of making a coherent it’s very choppy to memorize

      I agree, it is very choppy to memorize. What helped me was drawing out flowcharts/grouping topics together based on when they would come into play during the prosecution process. I mainly used that method for patent/application challenges, and it is given to you in my Etsy bundle linked above. But for example, I would group challenges together that apply during a pending application, then group everything together that applies after final rejection, etc.. Grouping topics, chronologically, based on when they actually can be utilized helped me a lot.
