    I also heard the seller can write in a kick out clause. If they get a higher offer before close the original buyers offer has to match or exceed the offer.       Happy new Year to you too. Wow, I have never heard of that clause. There is no way I would ever have my buyer sign something like that. Buyers put a lot of money into the process. The lender is also qualifying them on the purchase price. I like that clause for the seller...however, not sure anyone would sign it. I wouldn't. Good to know though. That's for your kind words.

    I had a buyer who was dragging things out. Ultimately because it was a VA loan I had no choice but to refund the deposit. Yes, he’d found another house!

      Yes Agree this is Garbage playing Games. Twice we had this happen. Jumped through hoops 4 weeks & 5 weeks then they pulled out. Negotiated the crap out of us too plus reduced price

      Ugh...sorry to hear that. I think the hardest thing I am dealing with right now is the lack of respect buyer have for sellers. Its a lot of work going under contact, doing home inspections, and accommodating their requests. yes, it our job...but please don't back out of the contract for silly things. It's rude and just a waste of everyone's time. I just hate wasting time. Have a wonderful New year!! Thanks for watching.

    Sorry to hear your Olive isn't feeling well, Audra.
    I had to to exercise a seller's contingency in 2023 to cancel the sale; buyer had already extended the closing date twice, and I couldn't find anything I wanted to buy. Disappointing, but I wasn't going to leave the buyer waiting any longer, and the market wasn't getting any better for me. Fortunately there was no drama from the buyer. But remember to put those contingencies in writing, in the contract, not just in the listing.

    Audra, please let us all know you and your family are safe! Those fires are absolutely heartbreaking... Please make a video soon or let everyone know you are ok. We know you will be so busy helping and trying to help people find housing etc. I work with a realtor Rose Dell a 30 yr realtor here in the FL Keys and Key West and we would love to see anyone affected come relocate while they decide on their next options and moves. I have 3 friends displaced or homeless in LA after this. 😢

      Ahh...thank you. Yes, I too dislike barking dogs. Barking dogs can be considered an nuisance. If its once in a while, perhaps that's okay. My guess, this sounds like a continual problem. I would definitely chat with your neighbor about their barking dog...and that it needs to stop immediately. It sounds like the barking dog is effecting the value of your home. Not cool.

      @@AudraLambertIt's important to not hide the issue from the buyer. I purchased a home and discovered the constant howling my first night, and I couldn't stop crying. So the next day I worked on a privacy fence with music blaring to force them out. It worked. I'm actually a very quiet person who hates noise. I later learned that the poor dog was dying of untreated cancer. Those people were absolutely terrible people.

    We have been very happy with the realtor that we have been working with to sell our 4 rentals.
    The first one was under contract within a few weeks and we closed 12/10.
    Same buyers are purchasing #2 rental property, closing on 1/3.
    Some of those funds will go towards major repairs and bringing the plumbing up to current code in #3 rental.
    Then we’ll raise the rent and be ready to sell 1/2026.1:48

    Hey Audra! Happy New Year! 3 of the things I love...pleated skirts, lip gloss....and Audra's channel! I'd hire you in a New York second if you were working the Colorado Springs area. I love listening to your advice, which is both informative and entertaining, but a word of caution - be careful of your use of the term "Realtor", which is a registered trademark. You know what Realtor means, and NAR membership is declining rather precipitously. Just say "agent".

      Bravo, that is a fantastic strategy. If everyone is happy to continue working together then there is not need to cancel the contract or end it. However, if you or the agent are unhappy you easily have an out and its not so far off.

    In California, if the Seller sends a Notice to Perform for a contingency, the Purchase Agreement stipulates that the Seller shall authorize the return of the Buyer's deposit. True, it's not automatic but it is pretty clearly spelled out.

    We agreed to purchase a home. We signed a contract and put down earnest money. Four days later, there was a teen shot near the house we purchased. I quickly told the realtor we will not be buying the home and gave the reason. The seller let us out of the contract and gave our earnest money back.

    I got out of a new home purchase in Michigan and got a 100% refund. The seller didn't disclose a creek - labeled it as a "ditch"; wanted to transfer responsibility to me for drainage issues; and refused to install gutters even though all other homes he was selling had them. I wrote a letter laying out the problems and threatening to write complaints to the city, state, and Realtors' Association.

      So glad it worked out in your favor. A contract goes both ways, all parties have to adhere to what they have signed (part of that is seller disclosing all material facts about the property).

    Just another reminder of why consumers want an overhaul of the real estate industry and commissions. Sellers too often are binded to horrible agents that only care about collecting their commissions..

      Well...the buyers do have the responsibility of choosing good representation. Always a good idea to interview your buyer. There are good ones out there. I do have compassion for those that done.

      @AudraLambert Many realtors market themselves well and hide their deception. You can't always be 100% sure you have chosen an honest agent until you are legally binded into a contract. I speak from first hand experience. Agents that don't hold up to their fiduciary agreement need to be held to harsh accountability. That would bring actual change consumers want to see...

      @AudraLambert lts hard for consumers to be 100% sure on their realtors' intentions. Some of them are good at marketing yet are still completely self-serving. You can do some research online and read reviews, but it still doesn't guarantee a fair outcome. My last selling realtor was horrid and cost me a ton of money. His reviews were decent at the time, and now have dropped significantly over the last 2 years. Realtors often boost their review ratings with family and friends reviews..

    What if you are under contract to buy a house and the seller refuses to make the repairs detailed in the contract. When I contract my buyers agent they tell me the repairs will be completed after closing.

    We were stuck in a 6 month listing agreement with an agent who was also a friend, so I had to stick it out to the end even though we were never satisfied with the service they provided, Sadly. I regret it. We are listing with a top agent in our area here in AZ very soon. Should’ve done that from the start!

    Audra- Have you ever not taken a listing because you knew the sellers were going to be waaaay too difficult? Or the expectations of their home selling at price you knew was too high?

      @ I have only been selling homes for 5 years in WA state but the market has definitely shifted. Sellers still think they don’t need to do much for their house to sell quickly and for a high price. I love sellers who do their part and who are willing to do what you ask. It only benefits them.
      Loved this video by the way. Thank you for enlightening all the sellers and buyers. A lot of them don’t know what questions to ask. Knowledge is power and your videos will help them hire a good agent in their area. Happy New Year!

    My buyer decided to cancel her contract after keeping my house off market for 5 weeks this past fall. She had no reason listed and wants her 25k deposit back. She had No contingencies and she passed on inspections. In the state of PA we have to mediate before going to court. The mediator contacted us both and the buyer won’t even respond to the mediation request. I’m not sure what’s next. My realtor will be looking into the next step Monday after the holidays. 🤷🏻‍♀️

    I am trying to sell my house, and I interviewed two different full service agents. They described the services that they promised to provide such as marketing, open house, professional photos,…. However, the listing agreements did not include the services they verbally promised to provide. I explained to them that the contract must be comprehensive and include all their services including the verbal promises. I would not accept verbal agreements with the agents. They refused. I did not sign. Why did the agents refused to include in the listing agreement promises they verbally make to me?

    I got out of one a year ago. I was going to have to lie about my income on a mortgage application to have enough income to qualify to buy the place. I was verbally encouraged by the agent to do so that as long as I made the payment it would be fine. It would have required me to both overstate my business revenues and underreport expenses, and overpay my income taxes by about $15,000 for US and Kansas combined. I put it in an e-mail to the agent and that contract got cancelled. I lost a deposit but I got out of buying a property that would have caused me financial ruin and was way too much for me and our family (6,000 square feet for a couple with an adult child and a widow roommate).

      @@stevend8785 Every tax form you file based on the fraudulent mortgage could be seen as fraudulent, because you could wind up getting more income tax back than legally entitled to. Or at least that what the IRS and Kansas could say. I'm sure there's other issues which could arise out of this kind of deal. Good thing you walked away.

      In California, the contract defaults to 17 days however they can negotiate that to be shorter or longer if necessary. Often times we see the contingency time period be 10-14 days.

    Audra, news to me, I thought in Cali the buyer had 17 days for contingencies. Buyer to get money back for any reason, period. Sounds like I may have that wrong? I got my earnest money back on a property in 2017, however the other side fibbed about condition of septic system. Caught em red handed, in a Whopper!

In California, the contract defaults to 17 days for the contingency time frame, however this can be negotiated to be shorter or longer if necessary. Often times we see the contingency time period be 10-14 days.

    Here’s another scenario: The Sellers have a change of heart (could be for a myriad of reasons) and decide to pull their home from the market. They aren’t in a contract with a Buyer and have no issue with their agent or brokerage; life simply got in the way.

    The real estate industry is a joke. In all my 50 years of dealing with agents, I have only had a few ethical professional ones.The commissions are supposedly negotiable, but good luck with that. The exception: If you were local , I would hire you.

      Once you take your house off the market (cancellation of contract/cancelled in MLS) you have 91 days to wait until the Days on Market go to zero (That is in California, that is). Hope that helps.
