    My wife (Brazilian) and I got married on the day we landed (tourist visa), then adjusted status after a couple months, and it worked out. This was back in 2011 though.

    Thank you so much for this wonderful video and for your take on this. We are mid-way through the K1 Visa process and it’s been such a long wait; our wedding may be delayed another 14 months as the London Embassy is showing to be very far behind. wishing everyone well during these difficult times.

    I have a theoretical question.
    If you and your spouse live abroad, and come to the USA for a few months on an ESTA for your spouse. What happens if when you're there you decide you want to stay? But didn't have that intention when you arrived.

    You said USCIS can look into emails but I just verified that's not true. What is your evidence?

      It happend with my Canadian friend. The CBP officer asked him to open his phone and checked all the emails

    A true scenario. A 15 year old came to the US in summer 2019 with a tourist visa for the summer to visit his father from Eastern Europe now a US citizen. So the son came in and brainwashed his dad to allow him to go to high school and graduate in the US. Because he think he is entitled. Now he is 19 and went three years of high school illegally and now planning to go visit his mother back to his rightful country. He is making big plans to return with a college visa before September 2022. Will that be granted to him by chance or an automatic 10 year bar or even permanent denial that he cannot enter the US?

    The actual written requirement for change of status is that you are inside the US at the time of change!

    What about if you and your wife are already married and their daughter is a US citizen....Can she come on a tourist visa and then I can apply for a adjustment of the 130 or 130A

    I have a cousin that did that, got his fiancee a tourist Visa and as soon as she cross the border they got married, I don't know how the hell they going to proof they didn't have previous intentions to get her the green card. I told him to do the K1, they are still waiting for the interview and they summited the paperwork a year ago, they got her the work permit already

    Hi! Came to the USA last december to visit my bf who is american (3 years relationship) and planned to come back home in april, but he proposed me a few days ago so we got engaged. I have a tourist visa and idk if we can get married or what would be the best way to stay together in the same place, thanks for your advice!

    Im UK citizen here on Esta Visa visiting USA from 10 Year's .
    my brother filled I-130 in December 2023 And got approved and received a letter asking me to fill up I-485 . My Esta is still valid And I'm back in London now And now i want to come back to US And filed my I-485 and go nack to uk and wait there .. come back when i was needed
    As a uk citizen, it's easy to come back .. please give me advice on my plan 🙏 thanks 😊

    I had a pending k1visa n the phil when i arrived here in the United States last dec 2, 2020..
    We didn't have plan to get married n here.. the proof and i had also my back in fort ticket ..And bc of this pandemic, we dicided to get married here in the US last march 18..And the first thing my husband did is filled a form 1-130
    last april..And it's on process now..did we violate the law?i read also that you can still file of change status while you had a pending 1-130

    If you marry after 90 days it’s safe so if you marry after day 92 you’ll be ok then you can adjust you’re status

      How can you marry after 90 days when the ESTAs only last 90 days at a time? Wouldnt that be overstaying your visa and then in turn illegal?

      @@noelmurphy3805 yes but you can marry and not leave until you file for a green card and overstaying by a few days will not lead to permanent bar stating 1 year and over will lead to a bar of 5 or more years depending how long you over stay

    I am senior citizen age 62 Yrs, frm Bombay. My son is a USA (citizen). I am visiting the USA on B1 / B2 fr last 28 yrs. When I tried to insert my passport into dropbox. Traveling agent advised me that since I have ANNOTATION:- DEPARTMENT AUTHORIZATION.
    This means I have to compulsory give an interview to meet my son, & obtain B1/B2 visa. Please advise
    If I am eligible fr dropbox, VHF may not allow me to insert, a passport due to Annotation. Please advise?

    Good Morning, I have a question: I came over a decade ago and was lawfully admitted with a C-1 (non crewmen) Transit visa, I was on my way to another country but I never took my next flight and overstayed due to some family circumstances. A few years ago I got married to a US Citizen and filed for AOS, we made some research on the USCIS Policy Manual which states that only aliens in Transit without a visa or C-1 and C1/D for Crewmen are barred from AOS so I filed for it. Got my EAD, SSN and already had my interview at USCIS which went very well, the officer was very pleasant and approved my I-130 but my I-485 it’s under review which is very common these days. I would like to know what would be your opinion or possible outcome on my process based on your experience! Thank you for your time and I wish you much more success!

      Hi Kello, are you saying a person who enters the US with a C1-D visa can adjust their status while married to a citizen or permanent resident?

      @@OnlyChry No, the USCIS manual states that a person who was admitted as a C-1/D crewman is barred from adjusting status unless he qualifies for 245-i . C-1 is for continuous Transit through the US and it can be also given to crewmen but not always and that’s where the confusion starts. I entered with a C-1 in Transit, married a citizen and I was never a crewman, that is why I filed for AOS.

      @@Latamarinde understood, because I was a bit confused I never knew they were different I thought C1-D and C 1 were the same thing.

      @@OnlyChry Basically “C1/D1” is a combination of both: while C-1 is the transit aspect of it the D1 is specifically for the crewmen’s and apparently that is why a lot of functionaries and attorneys tend to fall in misinterpretations.

    Yes but this is just about basic situations where people try to cheat. But what if you are already married, done your i130, and it's "out in the open" that you do intend to stay with your spouse (or you wouldn't have married them - common sense!) The ucsis published a document that says that in those cases it is allowed to apply for adjustment of status, even though the ESTA says that you are only visiting.

    I have some medical issues and my girlfriend lives in the Philippines I can’t medically go there so the only way we could do what we want to do is her come here on a tourist visa

    Thank you so much for your advice, I was told by a lawyer that it would be ok, but decided to go thru with the K1-Fiance Visa application.... I do have a question, can my fiance visit me on his Esta multiple times a year until our K1 visa process goes thru?
    I know they could stay 90 days at a time, if that is so how long in-between visits should he wait to come back?

      FYI, once you apply for a k1 visa, your Fiance can not enter the country while it is being processed. You can start the process once he is in the country, but he still needs to go home during the 90 days and will not be able to return. I would not mention anything about k1 visa when he comes on a esta, they will tell him to go home and start the k1 visa process.

      My husband filed for my K1 while I visted to USA back and forth, it wasn’t a problem. I am dual citizen now if USA and canada now

    I went to Disney land in 2007 my uncle who I work for I went to his house he owns in Kissimmee since then I was caught with 23 grams of cannabis with intent to supply , I've watched alot of videos that say anything over 30 grams is indamisable , but less is ok , I was young silly and 17 years old , I'm now 26 I haven't had any problems reguarding weed since haven't smoked it for 7 years , I wanna go on the same holiday now as I did in 2007 I wanna go with my uncle to his place in Kissimmee Florida and go to universal studios ect ect , am I gonna be indamisable or is there a way for me to come to the USA , seems so unfair a silly mistake I made when I was young and for a small amount of cannabis shouldn't stop me from coming on holiday to the USA , I'm not the person I was then I've grown up into a hard working clean adult , I've no idea what to do or how to go about it I have 50% of people saying you've got a drugs charge you'll never be able to go USA and then 50% saying it's only weed and not much you'll be able to go just do it right ? I don't know where to start

    Hi!! I'm french, currently a college student but on my last visit to the US my fiancé proposed and I was wondering if we could get married on my ESTA. However, being a student I don't plan on staying within the US and I do plan on going back to France, finish my degree and then apply for a Spouse Based visa. It is just more complicated for my fiancé to come to France.
    So would getting married on my ESTA without intent to stay and going back to France for at least a year be legal?

    My girlfriend and I have dated each other for 3 years... we haven't seen each other in over two years, she was supposed to come here last June but Covid hit, now it's been over the two year period for the fiancé visa. What are we supposed to do?! One of us has to visit the other, fly back then file for the fiancé visa, come over and THEN we can get married?!

      I understand your point, but I would argue that a loop hole is something that is perfectly legal even though common sense says it shouldn't be legal. This is not a loophole. Using a non-immigrant entry to the US with the intention of adjusting status is just illegal and people who do it are hoping they luck out and don't get caught. Totally different from a lawyer's perspective :)
