Investigation raises questions over communication breakdown prior to NMSP officer's death

  • ALBUQUERQUE, N.M.- There’s more information available about what led to the death of 28-year-old New Mexico State Police Officer Darian Jarrott on Feb. 4.
    Investigators’ reports show a breakdown in communication throughout a federal drug investigation and bring into question how much Jarrott knew about the suspect who shot and killed him at a traffic stop in southern New Mexico.
    KOB 4 looked over hundreds of pages and hours of video and audio in state police incident reports.
    Jarrott’s body cam video and the dash cam video show him pull over and approach the suspect, Omar Cueva, on Interstate 10 in Deming around midday. Jarrott asks Cueva to step out of his truck, and seconds after he does, Cueva begins shooting. He hit Jarrott at least six times, including once in the back of the head.
    Cueva sped off, headed east, shot at more officers, and injured one in Las Cruces, before police shot and killed him.
    Back in Deming, federal agents in tactical gear arrived on scene within minutes, but could not save Jarrott.
    The investigative reports reveal two federal agents watched the shooting happen from about 200 yards away.
    Other details in the reports help explain why.
    THE BOLO
    According to the investigation reports, Jarrot had limited information about Cueva. The information he had came from a BOLO, or “be on the lookout,” which said Cueva was a drug dealer with a criminal history known to carry a gun. It also says, “Officers must Develop their own pc (probable cause) for stop and subsequent search.”
    It’s unclear if Jarrott knew that a different state police officer was supposed to pull Cueva over that day.
    THE HOMELAND SECURITY PLAN
    Federal agents with Homeland Security had orchestrated a drug buy that day for five pounds of meth in Las Cruces. It would have been the second time an undercover agent had bought from Cueva.
    There was also surveillance of Cueva getting on the road that day.
    There were two plans within the sting operation.
    The first plan called for a different state police officer to pull Cueva over while he was on route and then call some of the many federal agents who were geared up in armored SUVs on I-10, ready to take Cueva in.
    If that didn’t happen, the second plan was for a buy bust, in which agents would storm the drug deal in Las Cruces.
    Before any of that could happen, Jarrott had made the stop.
    There was a briefing that morning, but the investigators’ report shows no one from state police was a part of it.
    STATE POLICE INTERVIEWS
    Jarrot was reporting to state police Sgt. Mark Madrid. Investigators asked him a lot of questions:
    Sgt. Madrid: “An individual was supposed to come into Deming with a load of drugs.”
    Investigator: “Was there a criminal history done on this guy that you know of?”
    Sgt. Madrid: “No. We were just going off the BOLO that came out.”
    Investigator: “Have you ever dealt with the suspect?”
    Sgt. Madrid: “I don’t even know who the dude is.”
    Madrid said the BOLO was just like the ones they get every day, and he had talked to Jarrott on the phone about it.
    “You see one of your guys that you just talked to, a young kid, sitting there -- for what s*** did we lose our lives over? I don’t get it. I don’t understand it,” Madrid said to investigators.
    Madrid says he never would have allowed Jarrott to stop Cueva if he had known what federal agents knew: that Cueva was a felon, that there was a sting operation and that an undercover agent reported Cueva saying, “if anyone tries to arrest him, he is not going back to prison.”
    FEDERAL AGENT INTERVIEWS
    Federal agents say they didn’t expect it to be Jarrott who stopped Cueva.
    In an interview with investigators, Homeland Security Agent Hector Huerta says federal agents knew Cueva was dangerous.
    “That’s why we were surprised as to whoever made the stop. Initially, we thought Leo (another state police officer) was going to make the stop because he knew -- everybody knew this guy was dangerous. It was going to be a high-risk kind of stop,” Huerta said to investigators.
    He says he did warn state police that Cueva was dangerous and that federal agents should be there for backup.
    “I had talked to Sgt. Madrid last night. We explained to him, ‘Hey, listen, we’re looking for this guy,’” Huerta said. “And he said, ‘Okay, we’ll be on the lookout also.’”
    The investigative reports say, “Agent Huerta stated he does not know where the breakdown in information happened.”
    There’s a wrongful death lawsuit on the way, alleging that Jarrott did not have enough information on Cueva before stopping him. The attorney says they plan to file against both the state and Homeland Security.

      Looks to me like there was an undercover sting happening by federal agents and the officer who was killed stopped him at the worst possible moment for having tinted windows.

    Communication breakdown? They told him to stop a known killer, heavily armed without warning him. Told him to make up excuse for the stop. The cops got him murdered and not one of them will face charges.

      If you check out CopWatch channel. There’s 10 videos breaking down the entire day. The BOLO was put out for officers, but they had to have probable cause to stop Omar Cueva. The PC in this traffic stop was dark tint. It was odd how 45 seconds after the Trooper was shot HSI agents roll up

      No. They were told to use two vehicles to pull him over and to call it in. Jarrott did it on his own and called it in as a routine traffic stop and not the BOLO

    Ive been in law enforcement for a while now and it never fails, the feds rarely communicate. I once was almost involved in a friendly fire incident, due to the feds failure to communicate information on a drug raid. I hope Jarrott’s family get the money they deserve!

      Guess why The Feds dont want to communicate with local Law Enforcement? Because most of you guys are CORRUPT (or you're 'protecting and serving' those under investigation by The Feds).
      I've read a lot about the history of Law Enforcement in America. The 1st Police Force that formed in America...was in 1839...to protect the shipping interests coming into The Boston Harbor (stuff had a way of walking off the docks, lol). Shortly after that, in 1841, police forces started popping up in The South....for the sole purpose of catching Runaway Slaves (I'm sure that you 'law and order' types justify Law Enforcement back in those days catching Runaway Slaves because The Slaves were 'breaking the law' by running away). After The Civil War ended, LE in The South started rounding up poor people (mostly freed Black Men) for being 'vagrants' (criminalizing being poor)...for the sole purpose of putting them on Penal Farms (giving local business access to free labor...much of the work back breaking work that often put the inmates lives at risk). In the late 1800's, when Organized Labor started going on strikes to protest low wages and horrific working conditions, LE, at the best of local businesses, routinely rounded up those who strike..often beating them and putting them in jail. In the 1910's..when women were organizing for the right to vote....LE often intimidated those women. And of course we all know about LE in The South during The Civil Rights Movement (I'm sure that the likes of you are big fans of Bull Conner).
      I tell my Black friends that a Black man should never get into LE...because once they do..they aint Black anymore..they are BLUE (look at what happened in Memphis with Tyree Nichols earlier this year). The very organization (LE) that put their knees onto Black people since 1839....is the very organization (LE) that forces Black people in LE to 'pick a side'. Black people think that if they integrated LE that they can 'change' LE. LE will NEVER change...because the purpose of LE is to 1. protect and serve the interests of Big Business/The Rich...2. protect and serve those in power....3. protect and serves others in LE. That is it! LE could care less about protecting and serving 'the community'.
      I hear White people all the time that they get into LE to 'protect and serve The Community'. Really? I'm expected to believe that most White people really care so much about Black people (because they sure arent hella policing White communities to the extent that they are policing Black communities) that they are willing to risk their lives 'protecting and serving' Black people? If White people only wanted to protect and serve their communities...they would only work in the very communities that they LIVE IN (White cops live in White communities....finding a White cop who lives in any Black community...is hella harder than trying to find Waldo in one of those "Where's Waldo" kids books). However they mostly work in Black neighborhoods...OR...where businesses that are mostly White owned (protecting and serving those interests).
      If Black people really want to change LE....they only way to do that is to form LE units that are Black only. Why would I say this? Because White cops cant be trusted to fairly treat Black people. History has proven me correct on this. Black people in LE are basically forced to prove that they are all about 'protecting The Blue'. If there were LE units working in Black Communities that were all Black (and all their bosses were Black)...then there would be a chance that Black LE officers could find a way to balance 'protecting and serving' the community WHILE not violating the rights of those they arrest. Why would I say this? Because Black cops, in general, live in The Black Community (I'm sure that there are 'exceptions to the rule'..but the exception to the rule DOES NOT make it 'the rule')...and when someone lives in a community that they are policing....chances are they may be more mindful of how they treat those that they are charged with policing..given that they go home at night to live amongst those that they are charged with 'protecting and serving'.
      It's easy for White Cops to sleep at night after putting their knees onto those they come in contact with while working as cops....because they go home to a totally different community after their shift is over. However, if White cops were forced to live in the communities that they policed....either White cops would learn how to treat Black people like they are human..or they would be forced to find some other career to go into.

      @@rz9wbI think they’re talking about how Officer Jarrott handled the traffic stop. However, NMSP released an uncensored documentary that shows the tragedy go down and how they took down Cueva. I highly suggest you do not look for it. It’s very gut wrenching seeing how things went from 0 to 100000 in a matter of seconds and it’s made worse when you realize he had 4 kids and wife waiting for him back home. His life wasn’t just taken away from him, it was ripped away from him.

      He he no idea this Guy was dangerous. The only info he hd was he was told to be o. The lookout for him and then told to pull him over, no one told him there was a sting operation going on or that he was armed like they knew. Jarrett had no clue he was walking into this horrible deadly scenario. Heavily armed fully kit HSI special operators showed up within 45 seconds of his execution armed with full body armor and heavy assault rifles , med kits etc. someone needed to radio “SUBJECT IS ARMED AND DANGEROUS , DO NOT TAKE UNTIL BACK UP ARRIVES.” No one did and he was murdered , shot 11 times. He didn’t. Do anything wrong or not take proper precaution, he was not informed of the danger . So sad. “Cop watch” RUclips channel has a 90 minute video of all the body cams fron the murder to the killing of the felon. It’s worth a watch for sure!

    Stuff like this is why a good cop is dead. When there is a dangerous person driving around you Must Notify local police and highway patrol to avoid things like this happening. Officer Jarrott’s family should sue the government for their negligence in not contacting local police. R.I.P. Ofc. Jarrett. 🙏

      He called it in as a routine traffic stop and Jarrott didn't call it in as the Bolo. They were told to use two Officer patrol cars to pull him over. And you never have a person exit a truck carrying the gun that you see. Jarrott knew this

      @@realboss10 The Officer never disarmed a handgun he had on him. That's not in the video. He saw a firearm and that should have been enough to keep in in the truck and approach from the driver's side to make sure he didn't exit with the gun.

      Seeing the video it clearly is the officers fault,he noticed the weapon in the truck,told the suspect if he the officer can remove it for his safety, and took his eyes off him.Suspect or not ,he should of never let him exit the vehicle knowing he had that weapon on him.

I will wait beside my vehicle call for back up, in letting them know I have encountered the driver they're looking for, and with my gun drawn to that suspect.

    They watched this officer being murdered and stood by doing nothing. They (HS) knew the suspect was a danger and yet they let the unsuspecting officer walk right into his death. Sad....... That's not right!

    Basically the fact that agencies failure to share information got this trooper killed. Facts! The bottom line is when you start something you stay on it and let all agencies laterally know what is going down. Anything short of that can be considered negligence. This guy dies due to lazy and selfish police work. The moral of this story is as follows: if you want the glory then keep the other players of the feild.

      @@4A5R6T you are definitely in the ballpark. My father and brother were both Cops, and spent 24 years in the military . Watching this young officer murdered was tough because he did everything right. The problem was know one else did. 47 seconds is how far they were away from him and left him without back up, without so much as a warning.

    Pardon my thoughts here but shouldn't any drug suspect violent or not be pulled over & approached with extreme caution regardless.... it wasn't as if Officer Jarrott didn't know Cueva was armed he saw the weapon & even questioned him on it but yet allowed Cueva to exit the vehicle with his weapon that's just downright crazy... Cueva easily ambushed him & it was over in seconds.... what Officer Jarrott was thinking allowing a suspect to exit his vehicle seeing him armed I don't know....

    If they saw him taking arresting the vehicle, SWAT should have advised him on the spot and request him to clear the area ASAP. But no, amateurs as they were, they let the incident occur well knowing how dangerous the suspect was. Poor, very poor judgment.

      Officer Jarriott had ran the tag, but couldn't find out where the tag was registered to. And plus they didn't know who Officer Jarriott had pulled over first, he call it in as a traffic stop

    This officer was a unique type of person . A very good natured person you could hear the goodness in his voice and face, he was one of a kind. He should've have man handled this felon and held him at gun point with out any mercy but he was so innocent hearted without any malice smh. He let the felon get out of the truck with the firearm in his hand dang. I saw another video of this same officer offering a ride to a homeless person and even bought him McDonald's and gave him personal money. This officer should not have been in the streets he should have been handling important stuff in the upper tiers of the department handling stuff that only a good person knows how to handle , with a heart and mind like his you can't be in the street it was to low of a position for him. Hope his family gets the compensation they deserve.

Federal officers were 200 yards away and watched this happen, they were setting him up to catch him. So yes, big miscommunication!!

      They were worried that local cops were on the take and would have alerted him- that's why the Intel was kept in a small circle.
      New Mexico is known for corruption and people on the take, it is what it is, and it's sad he was hung out to dry.

      Every stop is high risk and never routine. But any police will tell you that once you see a firearm you tell the driver to exit the vehicle without the firearm

    This criminal didn't even need to be pulled over by Jarrott. The department of homeland security need to throughly inform NMSP to not pull this guy over, because he was extremely dangerous. This was a negligent breakdown between the two agencies that was a factor in Jarrot getting killed, for shame.

    I live in New Mexico right now for my job and I can tell u it’s the worst state in the US, crappy deserts filled with tweakers with guns. I don’t understand this place and why the police and governor let all these tweakers run every town. WORST PLACE I HAVE EVER LIVED. I already had my truck broken into twice. The Dispatcher could it gave him more information on that vehicle why he was talking to him. 2. I really don't like the cops going to the Passenger side of the car

    Unfortunate. So many mistakes on this officer.
    When he stopped him why did he approach the passenger side of the truck? He left a huge barrier in case something were to happen. If he was at the driver side he'd have full control and once he saw the weapon he could have secured it.
    Also why did he need him to come to the car to run his information? He could have gathered it there and went to his car on his own to check and have full eyes on him from behind him.
    His fatal mistake, once he saw the weapon, instead of taking it then and there, he let the man walk out of the truck with it so he could secure it? This makes no sense. Now Cuevas has time to get the gun ready and has a truck between him and the officer. Poor training on this young officer.

They knew this guy was out there and they were a few feet away, they could of stepped up as soon as they saw the traffic stop go down.     I was both in Narcotics and a State Trooper while with Texas DPS. It doesn’t surprise me that the Trooper was fully informed because lots of time Feds won’t share this information because the Feds wants to toot their own horn. Arrogance is and will always continue be the norm in Narcotics and the Feds. Been there and done that.💯

    the problem is they need to approach as if the people are a threat, by checking their movements, the surroundings everything in the car, never take your eyes off them, look for visible weapon imprints in the typical areas, be ready to quick draw while positioning your body out of harm, but still able to light a bitch up, be serious, until till you prove there is no immediate threat, then be really nice to good citizens. i watched it, he did everything wrong, even if society is making a fuss about you doing the right thing, still do it, you know your not harassing or profiling, doing wrong, then be professional in every circumstance. this lack of seriousness is what the bad guys want, so they can get the drop on you. he treated this as non threatening and lost his life to seemingly easily spotted weapon.

    Dangerous or not, that could have been mr Rogers driving that truck and you still shouldn’t let him get out of that truck out of your eye sight with a gun on him. Sad to say but Ofc. jarrot could have prevented his own death. He made a fatal lapse in training that day that cost him his life. It’s a bolo and he literally saw the gun on him and he let him get out of the truck out of his view. I hope this video shows new officers what mistakes not to make
