Half of Kashmir was lost due to negligence of Neheru, Neheru went to UN and made it an international dispute, Neheru did not change Article 370 neither Indira Gandhi did although she almost changed the entire constitution. Now when the the temporary article is removed, Congress is again creating trouble to bring it back. What Congress really want?

Sibal is fighting for money and nothing else. He knows that his argument is hollow and he will only face failure. For Sibal temporary provision can be permanent 😂. How much money he has taken to fight this case which he will lose without a doubt.
Sibal wants 370 to stay not because it's abrogation he deem was unconstitutional but because there is no clarity on when and how a temporary provision became permanent.
Looks like it became permanent on it's own without exercising 368 because no government said anything till date.
I think such cases should be dismissed simply based on Article 1, 2 & 3 which gives centre enough power to parliament to reorganise or change the boundaries of any state without state's consent.
He's testing their patience. They will strike down this petition soon.

Sibal needs to take english classes again if he doesn't understand the basic difference between temporary and permanent. This will be a good judgement to also remove caste based reservations which was also temporary.
The National Conference and the like think that they will always have the dine in and India will take care of the washing and kitchen.Then they were worried of their minority status and reservation. Whats wrong if we say let's all be at the dinner table and enjoy?All states are equal for last 76 years and prosperous.

As a lawyer he may be doing good, his argument struck like Gramaphone needle at one place, he do not want the judges to even debate/venture into other relevant points. if this is what law is, then i do not subscribe to it, my understanding is law should be for greater good not for one or select few!

As a Kashmiri i have always rejoiced the 370 abrogation since it was nothing but a dead horse and most probably SC will uphold the abrogation as well. What i fail to understand is why is it irking so many people. The deliberations upon it in the highest court only reflects the true character of Indian democracy and the fact that arbitary legislations are liable to be struck down if passed in an illegitimate manner. If you ask me the proceedings itself is enhancing the democratic spirit of the country rather than doing any harm.

it feels so sad that we are hearing this kind cases being accepted in the courts of our country that challenges the authority of our country over our own state. Sibal is appearing for some anti-India client here, court shouldn't have accepted the Plea in the first place.
It's a wastage of taxpayers hard earned money and resources. Moreover, it further raises question on the non-transparent model of working of the judiciary itself.

SC has made it clear in its famous judgement that parliament has the power to amend the constitution or enact laws without affecting the basic structure of the constitution. Then why can Art 370 not amended or abrogated or deleted by the parliament? Removal of Art 370 does not affect the basic structure of the constitution !

@@drsubashn4025 Sir,it was explicitly mentioned that the abrogation of article 370 can be held by the President but only on the advice of the Constituent Assembly of the J&K which Sibbal is arguing of.What the Union has done is through an implicit process,which is right in the sense and logic but a question on the process of abrogation of the article.
The recommendation to remove 370 should come from constituent assembly because at that time jnk Constitution was not in place. Then Constitution came and elections and constiruent assembly was dissolved. So arguably the recommendation should come from legislative Assembly which wasn't there because of President rule. This isbthe argument.
When J&K constituent assembly was dissolved and J&K constitution was replaced with Indian constitution , was the replacement not 100% ? How come some laws of Indian constitution were not accepted in to-to ? That's what one would expect. All provisions of Indian constitution were accepted and according to the same Indian constitution, govt of India and Indian parliament have the right and capacity amend any law without touching the basic tenets of the Indian constitution. I am not able to understand how some provisions were left out when J&K constitution was replaced with Indian constitution. . .
During British time many Indian lawyers use to appear against Indians and one of them was father of j l Nehru. They made lot of money by going against Indians, the same breed of people are still practising even today. No country in this world will have such type of people thriving.

Very unlikely that your ID is real. The new law which has been presented in parliament will definitely make life miserable for such a lot , which passes opinions as judgements and truth. Jammu and Kashmir is an integral part of India and all states should follow what is practised from immemorial times. Vallabhai Patel and Ambedkar was not fir article 370. Article 370 has done so much harm to hindus and particularly Kashmiri pandits.

Whatever may be the arguments J&K is one state among the other states of India. There were Maharajas in all other states also. Democracy is now the King of India. J&K must be treated at par with all other states. It needs no special status. Hyderabad Nizam did not wanted to join Union of India. What was done then? Same applies to J&K also. Article 370 must end. This is the opinion of more than 80% of the people of India.

The entire nation stands with Modi Ji in the issue of Article 370.
Since the Constituent Assembly of J&K was dissolved, there is a provision which says J&K state legislature will be taken as the Constituent Assembly which can pass or ammend laws. At the time of abrogation, the J&K State Legislative Assembly was dissolved and the legislative power was transferred to Parliament of India by the laws of our Constitution. That's how Parliament worked as the Constituent Assembly of J&K. Simple.
