I own a V Chicago series flying v and its my favorite guitar. I wish they will win this lawsuit. They seemed disoriented the last couple of years but now they are back on track.
I think the point needs to be iterated. Gibson had basically given up on the V and the Explorer design. They hadn’t made them for 10 years. Dean hit on at the right time an idea of bringing back those designs and Gibson was delighted because they eventually made those guitars and money again. 40 years later they want to call foul. I believe they will lose because they didn’t mind their p’s and q’s by not protesting much earlier.

What’s great is that very recently Dean won against Gibson. Gibson being so lawsuit heavy is super annoying. Seeing the fallout with the Dime Estate is sad though. I have a an older Dean From Hell and still a huge Dime fan so when everything happened with Rita I was really disappointed. I still cherish the guitar I have though, it’s not a USA but it’s the guitar I dreamed of having as a teenager and being lefty it was just hard to come by lefty Dime stuff in Mid 2010’s. Dean used to be very lefty friendly as well, nowadays not so much.
Honestly I wouldn’t put too much into someone like Jon Donais. Don’t get me wrong I am a massive Anthrax fan and I like Shadows Fall but that guy changes guitar companies like people change underwear. Now I went to NAMM this year and the Dean section was in a tiny little room whereas before they had this huge awesome looking booth and a bunch of artist signings. This year was just so much smaller. I don’t know maybe they’re trying to start from the ground up but I guess we shall see 🤷

Here is some funny bit of trivia KKR & Co. Inc. who owns Gibson was founded in 1976 just like Dean Guitars was founded in 1976. One thing different though KKR is a multi billion dollar investment firm. KKR is one of the oldest and most prominent private equity investors in the world and is often credited with popularizing the leveraged buyout as an investing strategy. So KKR's army of lawyers are not gonna let this one go. And other American brands who are infringing best tread lightly. This is not gonna be the last we hear about Gibson in the legal realm cause they have the money now to go after anyone who crosses them. KKR also owns Endeavor/TKO (UFC and WWE), Epic Games, Door Dash, 1 800 Contacts, just to name a few. Hell they may buyout Dean Guitars/Armadillo Enterprises lol.
Love the perspective with the shared founding year. Gibson having a backer with $$$ is certainly a factor, but not the only reason that they went after these body shapes 40 years later. When I was at Gibson in the 90's they looked to protect these body shapes, but the case law at the time indicated that they could not. Several things have changed with new case law that allowed them to get legal protection for vintage shapes, this along with some deep pockets likely lead us to where we are today. You are correct that this is not the end of the story with Gibson working to protect their historic shapes.
