By allowing another person to operate that vehicle with expired tags and no insurance could possibly set the officer and department liable if the neighbor/friend was to have a collision while driving the vehicle home for her. You not only knowingly allowed someone to violate the law, and did in fact aid them in violating the law. And towing the vehicle would have cost her a couple hundred dollars to get it back from the impound/tow yard, and in light of her behavior, she would deserve it. Just saying.

For instance, in most of the southeast states, and the other states that believe in freedoms, all you need is a state issued ID card such as a drivers license to verify your identity and do a background check to purchase a firearm. Alternately it can be inherited, or you can purchase it in a private party sale. All of these things are legal in many states. Not every place is like the People’s Republic of New York, for instance, where you have to have a firearm owners identification card. Likewise, if her current suspended drivers license is in question, it’s entirely possible she purchased a firearm prior to it being revoked.

I saw a police video from England where if they pull over an unregistered car, they tow and impound it, and the owner has 7 days to get it licensed or it is destroyed. That sounds like a good idea for here with all of the unregistered cars people have here.
I wish California did that for uninsured and non licensed drivers! We have tens of thousands of them here. Or auction them back to the public after a month. But it’s too soft here, we never will do that
They did the same in Germany when like 20 years ago people tried to play the sovcit game. When their cars were gone, their license were suspended and they had to stand in front of a judge and had to explain why the laws dont apply to them, the game was over in a very short matter of time.
My Dad was a police officer for 25 years until a drunk drive injured him into early retirement. He carried an official note book that had its own special pocket. The note books were kept in storage when they were full. The notes in one of these books, resulted 5 years later, in turned a murder charge, into a history of a woman who was a battered wife and all charges were dismissed. He felt that making those notes was one of his best piece of routine police work that saved a miscarriage of justice.
You see so many videos where cops go from 0 to 100 for seemingly minor things. The calmness and professionalism of these officers is amazing. They truly represent the best of their profession.
I'm not familiar with the laws of Oregon, but they may have a provision for a person to operate a vehicle with the purpose of registering it. For example, when buying a car from another private party. As for the insurance, every state I've lived in (6 so far) issues automobile insurance to AN INDIVIDUAL. Their rate is based on a number of factors, including the type of car, but it's the PERSON who is insured. So, when I rent a car from Hertz, it is MY insurance, not the rental car company's. Or, if I'm driving my friend's car and crash it, it is MY insurance that is at fault, not theirs. All that is to say, that if Oregon allows a non-licensed vehicle to be moved on public roadways in a limited fashion while trying to obtain registration, the insurance wouldn't be a problem either.

I was admitting that, apparently like you, I'm not a lawyer in Oregon, but that my experience in many other states is that there are situations where it might be legal. I am a retired highway patrol officer from New York State. When we find a vehicle that is unregistered, and or uninsured, we must, must, tow it. An uninsured or an unregistered vehicle must not be operated on the public roadways in the state of New York. If an Officer in New York allows an unregistered or uninsured vehicle to drive on the highway, and that vehicle gets into an accident, that officer can lose his job!
@ as a young, baby officer in 1976, we were warned about the liabilities involved in this kind of action. I’m a very old man now, and things have probably changed, but I still think that vehicle should not have been moved.
@@bmcc12 i have talked to numerous americans who peacefully use their rights to success. sometimes the police depts eventually issue memos saying "do not ticket this person" because they keep winning in court. should this car be towed? probably, this seems like a scofflaw. should every plateless car be towed? Here in Australia I once got pulled up for having expired registration. My own stupid fault of course-should've managed that better. Anyway, I said to the cop "If I get an unregistered permit for the drive home, would you reconsider giving me a ticket?". The answer was yes, so I got one online and showed the cop. Away I went with no ticket.
As a former Oregon resident who was a little wild when I was younger, if you are just suspended they most of time will issue a ticket and off you go, but if you are revoked, at least 25 years ago when I lived there, it's a free ride to the clink and then you can get booked and walk home, and get a friend to go get your car out of car jail.
Once it has been established the driver is: 1. Unlicensed and/or Revoked ....Issue the Cite or Arrest...2. Tow the vehicle...They can travel on their own two feet. By the looks of her vehicle, that woman is a menace on the roads...You ABSOLUTELY don't want her to continue to have access to the vehicle, and possibly kill a family minding their own business, after your stop.
The rest of us are entitled to make sure others are competent to drive, insured and respectful of the rules of the road and other drivers. These items are why we have laws for licensure, insurance and traffic. She lacks respect for the rest of us.

That's how legislation is worded in Australia. You're not necessarily DRIVING a motor vehicle, you're OPERATING a motor vehicle. Recite that "travelling" BS until the cows come home, but if you're in possession of the car keys and sitting in the driver's seat, well....... Here you can be charged with "operating a motor vehicle whilst under the influence of alcohol" even if you're parked up and sitting in the driver's seat.

If you have a car with a hood, no broken lights and up to date registration your risk of getting pulled over is reduced 90%.

For example, when buying a car from another private party. As for the insurance, every state I've lived in (6 so far) issues automobile insurance to AN INDIVIDUAL. Their rate is based on a number of factors, including the type of car, but it's the PERSON who is insured. So, when I rent a car from Hertz, it is MY insurance, not the rental car company's. Or, if I'm driving my friend's car and crash it, it is MY insurance that is at fault, not theirs. All that is to say, that if Oregon allows a non-licensed vehicle to be moved on public roadways in a limited fashion while trying to obtain registration, the insurance wouldn't be a problem either.

@@gardenx5574 Because you stated that the officer DID NOT know the laws of his own state and shouldn't have allowed the vehicle to be driven off. I was admitting that, apparently like you, I'm not a lawyer in Oregon, but that my experience in many other states is that there are situations where it might be legal. Therefore, giving the officer the benefit of the doubt, that HE knew his local laws, was an appropriate course of action.

I am a retired highway patrol officer from New York State. When we find a vehicle that is unregistered, and or uninsured, we must, must, tow it. An uninsured or an unregistered vehicle must not be operated on the public roadways in the state of New York. If an Officer in New York allows an unregistered or uninsured vehicle to drive on the highway, and that vehicle gets into an accident, that officer can lose his job!
And there probably will be a civil suit against the officer and the department.
@ as a young, baby officer in 1976, we were warned about the liabilities involved in this kind of action. I’m a very old man now, and things have probably changed, but I still think that vehicle should not have been moved.
@@bmcc12 i have talked to numerous americans who peacefully use their rights to success. sometimes the police depts eventually issue memos saying "do not ticket this person" because they keep winning in court. should this car be towed? probably, this seems like a scofflaw. should every plateless car be towed? No, so i sort of agree with you. At the end of the day, we shouldn't live our lives burdened by flimsy permits attached to every part of life. And a responsible person can engage in most activity without bothering anyone.
Here in Australia I once got pulled up for having expired registration. My own stupid fault of course-should've managed that better. Anyway, I said to the cop "If I get an unregistered permit for the drive home, would you reconsider giving me a ticket?". The answer was yes, so I got one online and showed the cop. Away I went with no ticket.

As a former Oregon resident who was a little wild when I was younger, if you are just suspended they most of time will issue a ticket and off you go, but if you are revoked, at least 25 years ago when I lived there, it's a free ride to the clink and then you can get booked and walk home, and get a friend to go get your car out of car jail.

Once it has been established the driver is: 1. Unlicensed and/or Revoked ....Issue the Cite or Arrest...2. Tow the vehicle...They can travel on their own two feet.
By the looks of her vehicle, that woman is a menace on the roads...You ABSOLUTELY don't want her to continue to have access to the vehicle, and possibly kill a family minding their own business, after your stop.

That's how legislation is worded in Australia. You're not necessarily DRIVING a motor vehicle, you're OPERATING a motor vehicle. Recite that "travelling" BS until the cows come home, but if you're in possession of the car keys and sitting in the driver's seat, well....... Here you can be charged with "operating a motor vehicle whilst under the influence of alcohol" even if you're parked up and sitting in the driver's seat.
