He's a guy running around in spandex causing immense suffering for disadvantaged individuals and perpetuating a state of constant fear and chaos for the general public, and yet he's treated as the good guy. 1. He leaves thugs nearly dead, normal people that could benefit the most from a bit of consideration and lenency with regards to their punishment. Hell a simple "you didn't see me, I didn't see you." or "Walk away, before it gets ugly" would do more to accompilsh his attempts at scaring the bad guys straight than the millionth concussion would. People will gladly go down fighting tooth and nail if they think there is no escape but a single avenue of escape can make even the most dogmatic killer willing to consider surrender or retreat. 2. He refuses to kill those utterly responsible for what goes beyond simple crimes and have no evolved into acts of terrorism. By allowing the likes of Joker, Two-face and scarecrow is live despite the fact the justice system is uttterly incapable of properly punishing them his has become complicit in every death they. The people of gotham should not feel safe, they should be living in a state of costant terror that a villain will decide they've had enough fo a vacation and go on a rampage across whatever part of the city they find themselves in, reducing them to little more than a statistic in some dusty folder.
In that one episode of the new Batman animated series, Batman was being cruel to one of Joker's henchman in front of said henchman's son. Robin (Dick Grayson) did not like that one bit, and that eventually led to him quitting on him, especially when he found out Barbara working as Batgirl with Batman, but not before punching him in the jaw.

Anybody can be pushed to the breaking point, and Justice Leaguers are no exception, it would make sense for Batman to have contingency plans for all of them if they got out of hand.

The New 52 went to fix the damage done to Stephanie Brown, Tim Drake, and Barbara Gordon. I know it can be confusing at times. But this fixed the negativity of these characters. New 52 saved these characters back to the spotlight.
