So how it works is someone may not want to press charges but when it comes to WOMEN, CHILDREN AND ANIMALS. The state automatically has the right to follow up and press charges if they want. And if they feel they have the evidence even after the victim doesn't want to be involved. They'll go after them for sure.
The reason they searched the apt is to make sure there wasn't anyone there who may come out shooting.They didn't really do a good sweep tho,but,I guess it wasn't necessary in this case tho.
In some states the victim doesn’t have to want to press charges if the violence happens the person has to be taken to jail no matter what. I like this law bc it keeps some victims safe who are too afraid to speak up for themselves or have been manipulated into thinking it’s normal for their partner to beat on them or that’s it’s their fault
Here in Wichita Kansas here are they basically if you have a domestic even if they don't press charges you go to you go to jail 72 hours if you're getting evicted at the same time they lock it up till you get out and then they personally have someone put it in a pod and then you got to pay for that as well as your back and then put that on your court cost

If the victim feels threatened, they often don't pursue charges, so the State won't leave it up to the victim.
The state can still press charges if there's enough evidence even if the victim doesn't press charges originally or afterwards.
