Worked at the VA as a temp and my opinion is the lack of bodies to process these claims. People are burnt out and leaving. Hiring process is outrageously slow and health staff hate how they are treated

I filed in March of 2018 for a service connection for Type II diabetes from my time being stationed at Fort McClellan. I have been denied twice. I am a legacy case. I had called the White House Veterans Hotline making inquiries and their CURRENT decision was supposed to be made on June 13, 2022. Now I am two weeks post that phone call and have not had any communication given to me from the VA. I am glad you are doing what you are doing to help all veterans not just those of CCK. Not only is the VA slow, they send us for C&P exams over and over for the same issues, even if you have been rated the month before, if you file a new claim. Just simply ridiculous
Know this, a lot of the companies that the VA uses to C&P Exams are mostly owned by Prior VA Management persons. Sounds a lot like Kickbacks and Bribes to me. That is why there are so many unnecessary C&P exams...FOLLOW DA MONEY!
Unfortunately rich I can relate to you. I went to three different C&P exams for my bilateral corns and calluses that I claimed all the way back in 2001 but they jacked up my address so bad on the letter I never received it. So when I put in my first claim, I was shocked to see I had to denial all the way back then. I showed them the error on their own letter stating the address listed and name on it was the wrong name and also my address was spelled wrong. Long story short, they tried to screw me and said that it's service connected at 0% but your feet aren't that disabling, I showed them the CFR where I was taking the medication shown that warrants a 10% rating each foot. I won the claim, but after a year and a half, and many sick leave taken at my government job, they finally got somebody that can actually read the code of federal regulations. I'm not looking forward to the plethora of issues that is stemming off my feet and my gastrocnemius equinas deformity that has caused other problems. I might get a c&p exam by 2025
I went in for a C&P and the doc seemed to understand my issues so I left feeling good about the claim. About 1 month later, they sent me to another C&P for the same issue??? And this time, the new doctor didnt believe anything I said and was really just being an asshole, I didnt win that claim… Oddly enough, that same asshole doctor had to see me again for a different claim and after I saw him, I really didn’t give a shit anymore and was being brash with him, I ended up winning 2 claims that I didn’t think I’d win with this guy assessing me 😆 🤷🏻♂️🤷🏻♂️🤷🏻♂️
The problem is....they have no oversight committee that holds them accountable for their lazy and slow "process." My paperwork sat on a desk for 3 months and it wasn't until my lawyer put pressure on them and then it moved. Great job CCK for looking after the veterans, thank you.
I have a legacy appeal heard by a va judge 10/15 and an ama appeal waiting,,,cck explained you can't take my cases until desicions are decided..the legacy appeal is overdue...cck are OUTSTANDING for ALL veterans!!!! Cck are the ONLYones standing g up for us!!!
Thank you for all you do for veterans. One big reason for so many appeals is due to bad decisions by the VBA...many of those denial only an appeal to BVA can adjudicate....there is no accountability at the VBA and the raters for bad malicious decisions by raters and DROs.
Only Lawyers like you can fight for Veterans and keep the VA in check and hold their feet to the fire and make them deliver on what they promised to do! We are so fortunate to have you in this fight and if you don't bring these matters to the surface and take on this fight, then they will continue to abuse the laws and system thinking "no one complained", so we can continue to do what we have always done. As a veteran I personally thank you regardless of your motives be it if you are doing it for your own personal gain or what??? I'm hoping that you are doing it for the veterans like myself that really need your and any other law firms across America that will actually take a stand for the veterans as we were promised the stars so to speak when we either enlisted or were drafted regardless the point I'm trying to make is how long any disability claim that gets have or any type of appeal they have the va's approach to anything takes forever and a day and it's been that way since Ive been involved with the va no one really cares!! I really like the emails they sent out saying and promising they were going to hire and train inforget how many people to help with the disability work load of claims on file or pending I believe it was in the neighborhood of 250,000 cases where are they at I haven't seen or heard anything new about that over two yrs or longer now!!! I'm trying to get help myself and it's been my experience since 1973 everything va or va related a dead end and I hope to live long enough to see the va change so thank you again for helping us veterans out or at least trying!!

Should there be an audit of VA expenditures on massive overhaul and rennovation of Birmingham AL veterans medical center, new mental health building in Irondale AL and other leased facilities in other states with funds obtained for veterans/ backlogged claims? Just curious
i am presently receiving compensation for 100% disability, however the original claim date was not allowed because I was late in refilling and the compensation was limited to the last repeal. When I was working with a va rep during the initial filling he told me after the rejection that I stood no chance to be awarded compensation. So I decided later to appeal losing probably two years of compensation. When my final appeal was submitted they said I waited to long and they would only retroactive compensation to the final appeal. My question is is it possible to recoup compensation to my original claim?
My VA claim for an increase is now over a year since submittal. My Congressman representative made an inquiry but told me on the phone they are powerless to act against an agency. I recently used the Email the President link to ask for help. No response. It is difficult to believe the elected officials when it comes to Veterans. I hope we can remember their commitment levels in November. I sure will!
I had a c&p exam last week with VES it lasted 9min from me sitting down to me being dismissed. I tried to tell the Doctor what was going on with my back and she only asked when was I diagnosed. The doctor said before I left that she dont make the decision and Thanks for my Service. I felt violated again
Keep your head up Lashenda. Most claimants feel that silenced by the process. You are entitled to: Legal representation- they have a fund to pay lawyers. Let your lawyers preview documents prior to submission. Write your own statement regarding your disabilities and give it to your examiner after your lawyer previews it. That way your voice is heard. Make a checklist for yourself to make all your points to the C&P examiner so you dont forget anything. Leave with confidence and pray for good news!
Are you partnering with other Law Firms that represent veterans that deal with BVA? Woods and Woods have represented me for years and they are dealing with the same thing....Im at 90% but STILL waiting on TDIU for 1 1/2 years now.
My big problem with the VA is why do they not allow me to download my C-File? I can download my medical records but not my C-File.... Seems like they just like making a veterans life harder than it already is.

Thank you ! Everything with VA claims is wrong! They delay and deny on purpose. Then put you through an appeal again! Its illegal and wrong and they should be held accountable. Medical care is still hurry up and wait as well! When is this crime going to stop! My last exam I went to a civilian VES they sent me to and they didn't even see me because of an issue with someone gave them the wrong diagnosis. Now the VES doesn't communicate with the VA so I have no way of proving that my claim was made without a proper exam . VES probably got paid for my visit even though they did nothing!
As someone who has a supplemental claim pending. There’s no way I should not know any updates about my claim. Also it should never take 3-6 months for a C&P exam results
I think maybe I got lucky. I put in a new claim recently (March 2022) and they came back with a decision in 2 months from when I put the claim in. The decision came 3 weeks after my C&P exam. When I got the decision I thought to myself “wow, that was waaay faster than last time”. My first claim took a year.
This is great news but with my experience with anything that involves litigation, it seems this may be another drawn out battle in court? Didn’t see anything in your video in regards to an anticipated timeline but then again, I don’t think that’s anything anyone can provide. I was denied a claim for my back injury that I sustained while on active duty. The VA admitted that I did sustained an injury to my back while on active duty but their reason for denying my claim was based on me not having a continuous medical care and moreover, my back injury isn't service connected. This doesn't make any sense at all. I've had one surgery already and about to go through another one for replacement of damaged parts to spine disc that causes nerves problems which in turn causes excruciating pain down my legs. VA is also closing claims without issuing a Decision Letter. They closed my SMC-K claim three time without issuing me a Decision Letter. I had two C&P Exams on this same claim. I haven't received a copy of these two C&P Exams.
Am a Navy Veteran residing on a comparatively small island and would like to thank CCK for this video .I have been trying very hard to follow up on a recently increased Va claim that i had with VA last year that did not include my dependents because according to them they are not US citizens. I am from the Federated States of Micronesia with no VA office, clinic or anywhere to turn to for assistance. I was legally recruited from here and joined the US NAVy for 4 years with an honorable discharged with a lot of promises that are not applicabled to here cause we are also considered as foreighners. Am kind of frustrated sometime cause I believe there are some legal misunderstanting wirh our relationship with the US government I was recommended to relocate to the US to received all my VA benefits. I am a responsibled parent who love these islands so much plus our borders are still closed. It is hard to file on line cause of poor connectionp and also with no tool or resource to try to do anything to find assistance.
My case was denied, when I was out I didn't know I was not aware I can go to the VA, that was back in 2000, in the denied papers said that even that my disability start during my services,I didn't continue get care.. I get care for some in civilian dr, that I summit...It's been getting worse..Do you think you can help me???
It would be nice if VA could simply state what docket number that they are working on in each of the categories under AMA so we can at least have an idea how much longer we may need to wait for our individual appeals to be heard. I filed an appeal with BVA on March 2, 2021 for a direct verdict for an increase for PTSD and have a docket number but have no idea where in the process it would be. It is simply the not knowing how much longer until they at least get to my appeal that is frustrating. Thanks for all the informational videos that you post and if my appeal is unsuccessful I will be heading your way for help in this final matter. FYI, asking for an increase from 50% to 70% and currently stand at 93% for other disability claims that have been decided.
That's the trick with VA. They indicate "You are in the docket", but the reality is there are at least 130,000 cases alongside you, and they still refuse to offer you a time frame. VA promised Legacy would finish in 2022, I calculate their numbers provided by appeal metrics and at their pace they could finish by June 2024.
I had a C&P exam in early Apr. for an appeal. The VA got my audio, hearing, exam results two weeks later. Before the End of April. In June I got another C&P exam notice. I called and asked why. What was different about this new exam. No one knew. They just said Go to the New Appt. Just in case!! So I went. The examiner said it looked the same as the previous rests. What the Heck. 3 months of nothing. 😡
CCK you have to meet very specific guidelines for them to help you. IF you are a VET and need help but don't fall with in the very narrow guidelines they tell you to call someone else like DAV. I needed legal Advise and got the brush off because I didn't fall with in the very narrow list of what they will help you with. I will admit they have great You Tube Video's. But what good does it do to need a Lawyer to get advice, but told to kick rocks. Don't worry I will find someone else to answer my Questions. Have a nice Day CCK. I possibly had a back pay issue for a big number, but they told me to kick rocks before I got to that, but hey they didn't want me so I will find someone else.
About time someone take legal actions against the VA this people got hired for nothing but walking around their building and blame COVID. We all know that the entried staff don't get COVID at the same time. Now hope they don't retaliate against veterans. Which is wrong from this agency mean the VA.
My first claim (2010) after retirement was 18mos, then another 10mos to get a 90% rating. Re-filed in 2021 with a lawyer and my exact same medical records (29yr USAF) and was finally awarded my 100% P&T. I was actually 320% with deferred items; skin cancer, spinal meningitis; burn pit (2 wars - 7 deployments to Middle East) hearing loss (flightline); I was also assigned to Area51 with a huge burn pit but no records of me working there (4450th). I'm truly thankful for my attorney and gave him 30% of my back pay (only 1yr instead of 11yrs). We've gone to lunch a couple times since. My nieces husband was a former Marine and stationed at Camp Lejeune in the late 70s. The VA does its' best to screw over veterans. All the Vietnam Vets shouls all be 100% from AG and 200+ days of combat. Period.
1ST claim 1984, result 10% rating, then after decades of denials and countless C&P exams by doctors and nurse practitioners, DAV referred me to CCK. Fast forward 2021, significant rating increase. I broke down when CCK gave me a copy of a critical medical record obtained from the VA after all those decades, denials and C&P exams. They had the info they needed all the time. I was even threaten by one C&P doctor who told me that if I couldnt be positioned the way they needed me to be to take measurements that they would report to the VA "COULD NOT COMPLETE EXAM" which further delays me getting the help I urgently needed. That exam resulted in a reduced rating. 2 - 3 additional years to get the rating restored with back pay. C&P exam doctor had cited "Slight Improvement". They have that much power. DON'T GIVE UP!!
I had my Law hearing on January 25, 2022, and I had the DAV represent me and I felt traumatized after that hearing! Calls for updates to DAV are being passed to other employees rather than the person that represented me during my hearing! In other words, my claims appeal updates are coming from non-VSO employees, Just office employees! My former case manager was “retired” by DAV here in Phoenix, and so I felt that my law judge telling me I had only 30 MINUTES to go over 10 ratings updates that he filed before he left was utterly insulting, and I was made to feel as if I wasted the court’s time for my hearing taking an hour and 46 minutes! I have MST and eye Statement in Support of Claim filed for a PTSD diagnosis I got back in 2013, but due to mishandling of my legacy case, lost the ability to claim before July 2017 unless I filed a new claim. I was not properly prepared for the need for nexus statements that I was told by other lawyers would cost me upwards of $2000 to get a proper one, and I’m worried the nexus statement I did file might be deemed too weak due to a slight language barrier of the PA that did it. I was shocked to learn these things are not done on contingency! Can you guys help?
I was supposed to get my disability @ 100% at first diagnosis back at 2020 according to many VA doctors, but I'm still here when the C&P finally started at February of THIS YEAR, then C&P said they don't want to reimburse me past THIS February, and to this day when the documents are finally in for analysis they STILL aren't done yet and I'm STILL not getting my benefits. I'm about to be homeless from the other side of the border against my choice, and they STILL don't want anybody to bother them while they're rich.
VA primary doctors, the VHA, don't get involved with, or hardly comment on what the VA benifits side, the VBA does. Two different sides of VA. It does not take 2 yrs to get a C&P exam and you didn't say when you filed a claim. Do you have a VSO to help you file and are you a US citizen ?
I am one of these Legacy appeals and my appeal date was april 2016. I had a hearing with a law judge in 2020 but he remanded back to the BVA who still hasn't been able to get my 2016 appeal back in front of the law judge. If they are telling you that the farthest back they are backloged is 2019, I can tell you that they are lying to you.
Evidently, the remanded appeals are not part of the 2019 year group. When appeals are remanded to the regional office, they are no longer part of the BVA. This is my opinion. Hang in there!
I would say you all should make it clear on your website that you only take cases that have been denied. I didn't see anywhere that indicated you did not file initial claims.
I’m one of those in that crazy appeal queue. Currently I’m 13,590 and that’s a good number 😛. I’ve been fighting since 1999. So frustrating!!!! Also I overnighted my appeal a week before deadline and they said they got it a day late!
My husband was 100percent and they knocked him down to 90 percent because he was cleared from prostate cancer. However he has Altimers,. And the recently found a mass on his lung have not given me a diagnosis and is still under more tests. He has other medical issues as well. I have heard of the pak law what's this all intail?
I'm 80%. I should be 100% and will be someday but they did me dirty stating my hypertension was denied because I'm not on meds and my kidney disease was denied due to no clinical evidence. Then the next sentence they stated that hypertension was already awarded under PTSD but to break it out for its own rating I needed to be on medication. 😑We all know I gave them my medication list showing blood pressure meds since 2016 and plenty of "clinical evidence" aka all my medical paperwork and labs for my kidneys. I had zero issue getting through the C&P exams but I have a feeling this appeal will drag out. Stay on their ass guys don't give up and don't go away until you get what you are entitled to.
The VA denied our ftca claim 😮 and it's literally a straight slap in the face 😢 but we are going to ask for a reconsideration , sad thing is it's so evident that they literally allowed our dad to die from nsclc !! No screening was ever offered even though dad met all the requirements signs and symptoms along with plenty of medical records to back it all up
Personally I think they want a backlog, so, they won't have to pay out. No one tells the young man or woman going into the military the price when they get older. Suddenly Uncle Sam moves slow like molasses when it comes to taking care of the damage they caused.
F.Y.I. If you are being treated at a vet center for p.t.s.d. The v.a. must request your treatment records in order to evaluate the percent of your p.t.s.d. Make sure it's in your claim that you are being treated at a vet center and inform who ever is filing your claim of same.
EVERY issue you go to the VA for is well documented (Not just PTSD). I wish more veterans would use the VA healthcare system if not for treatment but for documentation. It would definitely help the claims process.
Force the VA to make better decisions at the Regiional Office where the "FIRST" decision is rendered..... Process improvements not necessarily "MORE-MONEY!
They are spending an awful lot of money to question our conditions and nitpicking technicalities. How often to the appeals change the outcome of a claim? What I’m getting at is would it be more efficient to not require an appeal and give us what we deserve from the beginning? My claim got thrown out because of a paperwork error that was out of my control. Now it looks like I have to start all over again even though I had a fully developed claim. Seems like a huge waste of resources.
Yep took 14 months for them to award me something. Had I known about intent to file I wouldve done that before i sent in the claim. But of course VA never wants you to know the things that benefit you.
Vietnam vet, injured, carried off on a gurney, No purple heart, no service connect, all they do is denied me over and over again, where do i go.explain this.
I will call you July 5TH or 6TH. I need to file an appeal on my claims of secondary disability of my original disability award. I was denied sleep apnea even though the VA did 2 in house sleep studies and gave me a CPAP. I have been awarded for tinnitus and hearing loss. I was also denied on radiculopothy, even though my original knee disability lead to an award for plantar fascitis and heel spurs bilateral. I have nexus letters from a private physician who is also an occupational therapist, but the VA dismissed those.
The new system they lost my records, didn't know I had my annual appointment, didn't know my doctor quite, and couldn't give me a covid test so I could get into the fair. Thankfully I completely got my disability, and hip replacement decade ago. VA is a total failed, on my last appointment. They said call us back next year and provided me with the new phone number.
CCK, Check what case's are being filed by YALE LAW DEPT. They have filed many suits against the v.a. in the past. They do this pro bono on behalf of veterans. Good Luck !
If they just did their job the first time on half of claims it wouldn't be such a backlog. I get PTSD just to think back at the back and fourth I went through before I hired CCK. Vets do yourself a favor let CCK law handle your case. I could actually work, be a father, husband, and not be stressed by the VA's system!
I have mixed feelings about this due to your timing and the passage of the PACT Act. I love CCK but I wish you would have waited until after they passed that law before bringing this action. I agree they are ridiculous. Especially for people like me who have severe anxiety and can’t deal with them taking their time.
@@sargentking2436 I never even implied it did. What I said was they should have waited until after the PACT act passes. The reason is because the Act has infrastructure budget in it to address this. CCK suing may raise concerns requiring more be added into the bill to address the backlog and thus slowing it down further or even completely causing it to be put on a back burner when there are people who are in dire need of this bill right now. My concern is that their lawsuit is going to complicate budgetary concerns further which is the very reason the PACT Act has not passed yet. We need this bill now. They were set to pass it by the middle of this month and now with this pending litigation I am concerned it will just slow it down more still. I hope to God I am wrong.

If they wanted to really help Veterans they would it without being told to. Veterans been crying Vietnam War and some dont get a dime. So if that's your only worry, good luck. They don't give a damn about us. There are laws already on the Books, they need to uphold there. Another Act is a Smoke Screen. People waiting 5/6 years. I just personally have a stake in this PACT Act passing. I need it passed and I worry too much. The VA is getting better but there’s still a lot of work to do. 20 years ago I couldn’t get them to approve nothing. It was like hitting my head against a brick wall. Now finally I have been getting some results thanks to lawyers getting involved. I hear ya now!

Seriously? Husband filed for Disability and was denied a couple of times, we just assumed the last appeal was the final. Then out of the blue husband received a call from a law firm stating they had received husbands information from someone at the Veterans Affairs office on his appeals, and they would take his case because after reading the boards decision on why they denied his claim they found wrong doing. Long story short this law firm went all the way to UNITED STATES COURT OF APPEALS FOR VETERANS CLAIMS and Law firm won husbands case. Appeal was for July 31, 2017, then courts decision went back to the VA board and till this day waiting for their decision. What makes your law firm different? If your office takes on a case and you win the veterans case, it's still up to the VA board to deny your claim right? Law firm gets paid right away but veteran will still have to wait pretty disgusting!
Is it possible to have been erroneously discharged after being disabled by the military in the effort to cover the unjust order that caused the hidden disability to occur in the first place as a result of the miss judgment of the commanding officer!

According to my Understanding, Congress who wrote The US Title Code 38, legally gives The VA "Only" up to Two Years to Answer an Initial Claim. So how much time legally does The VA have in order to Answer an Appeal? Your Video was Uploaded in July 2022 and You say that the Legacy system has over 70,000 Veterans' Appeals Unanswered as of February 2019, so thats THREE & a Half Years since they Filed an Appeal. So Congress, being that they have only 2 Years to Answer (with a Determination of Approved or Denied, plus the Percentage, or Not) an Initial Claim, they most possibly were Late to begin with in Answering (so 2 Years or Longer) AND APPEAL means that after The Vets have already waited for 2 years+, they were DENIED (which is Why The Appeal) and Now theyve waited an Additional Three & half Years, so thats a Compunded Total of at Least Five & a Half to Six Years since theyre Initial Claim was Filed and Denied. That Is a Travesty and totally Unacceptable and a Disgrace on The VAs part. But THAT Is The VAs Infamous Reputation as it has been for Many Decades now. Worked at the VA as a temp and my opinion is the lack of bodies to process these claims. People are burnt out and leaving. Hiring process is outrageously slow and health staff hate how they are treated

I filed in March of 2018 for a service connection for Type II diabetes from my time being stationed at Fort McClellan. I have been denied twice. I am a legacy case. I had called the White House Veterans Hotline making inquiries and their CURRENT decision was supposed to be made on June 13, 2022. Now I am two weeks post that phone call and have not had any communication given to me from the VA. I am glad you are doing what you are doing to help all veterans not just those of CCK. Not only is the VA slow, they send us for C&P exams over and over for the same issues, even if you have been rated the month before, if you file a new claim. Just simply ridiculous
Know this, a lot of the companies that the VA uses to C&P Exams are mostly owned by Prior VA Management persons. Sounds a lot like Kickbacks and Bribes to me. That is why there are so many unnecessary C&P exams...FOLLOW DA MONEY!
Unfortunately rich I can relate to you. I went to three different C&P exams for my bilateral corns and calluses that I claimed all the way back in 2001 but they jacked up my address so bad on the letter I never received it. So when I put in my first claim, I was shocked to see I had to denial all the way back then. I showed them the error on their own letter stating the address listed and name on it was the wrong name and also my address was spelled wrong. Long story short, they tried to screw me and said that it's service connected at 0% but your feet aren't that disabling, I showed them the CFR where I was taking the medication shown that warrants a 10% rating each foot. I won the claim, but after a year and a half, and many sick leave taken at my government job, they finally got somebody that can actually read the code of federal regulations. I'm not looking forward to the plethora of issues that is stemming off my feet and my gastrocnemius equinas deformity that has caused other problems. I might get a c&p exam by 2025
I went in for a C&P and the doc seemed to understand my issues so I left feeling good about the claim.
About 1 month later, they sent me to another C&P for the same issue??? And this time, the new doctor didnt believe anything I said and was really just being an asshole, I didnt win that claim…
Oddly enough, that same asshole doctor had to see me again for a different claim and after I saw him, I really didn’t give a shit anymore and was being brash with him, I ended up winning 2 claims that I didn’t think I’d win with this guy assessing me 😆

The problem is....they have no oversight committee that holds them accountable for their lazy and slow "process." My paperwork sat on a desk for 3 months and it wasn't until my lawyer put pressure on them and then it moved. Great job CCK for looking after the veterans, thank you.
I have a legacy appeal heard by a va judge 10/15 and an ama appeal waiting,,,cck explained you can't take my cases until desicions are decided..the legacy appeal is overdue...cck are OUTSTANDING for ALL veterans!!!! Cck are the ONLYones standing g up for us!!!
Thank you for all you do for veterans. One big reason for so many appeals is due to bad decisions by the VBA...many of those denial only an appeal to BVA can adjudicate....there is no accountability at the VBA and the raters for bad malicious decisions by raters and DROs.
Only Lawyers like you can fight for Veterans and keep the VA in check and hold their feet to the fire and make them deliver on what they promised to do! We are so fortunate to have you in this fight and if you don't bring these matters to the surface and take on this fight, then they will continue to abuse the laws and system thinking "no one complained", so we can continue to do what we have always done. As a veteran I personally thank you regardless of your motives be it if you are doing it for your own personal gain or what??? I'm hoping that you are doing it for the veterans like myself that really need your and any other law firms across America that will actually take a stand for the veterans as we were promised the stars so to speak when we either enlisted or were drafted regardless the point I'm trying to make is how long any disability claim that gets have or any type of appeal they have the va's approach to anything takes forever and a day and it's been that way since Ive been involved with the va no one really cares!! I really like the emails they sent out saying and promising they were going to hire and train inforget how many people to help with the disability work load of claims on file or pending I believe it was in the neighborhood of 250,000 cases where are they at I haven't seen or heard anything new about that over two yrs or longer now!!! I'm trying to get help myself and it's been my experience since 1973 everything va or va related a dead end and I hope to live long enough to see the va change so thank you again for helping us veterans out or at least trying!!

Should there be an audit of VA expenditures on massive overhaul and rennovation of Birmingham AL veterans medical center, new mental health building in Irondale AL and other leased facilities in other states with funds obtained for veterans/ backlogged claims? Just curious
i am presently receiving compensation for 100% disability, however the original claim date was not allowed because I was late in refilling and the compensation was limited to the last repeal. When I was working with a va rep during the initial filling he told me after the rejection that I stood no chance to be awarded compensation. So I decided later to appeal losing probably two years of compensation. When my final appeal was submitted they said I waited to long and they would only retroactive compensation to the final appeal. My question is is it possible to recoup compensation to my original claim?
My VA claim for an increase is now over a year since submittal. My Congressman representative made an inquiry but told me on the phone they are powerless to act against an agency. I recently used the Email the President link to ask for help. No response. It is difficult to believe the elected officials when it comes to Veterans. I hope we can remember their commitment levels in November. I sure will!
I had a c&p exam last week with VES it lasted 9min from me sitting down to me being dismissed. I tried to tell the Doctor what was going on with my back and she only asked when was I diagnosed. The doctor said before I left that she dont make the decision and Thanks for my Service. I felt violated again

You are entitled to:
Legal representation- they have a fund to pay lawyers.
Let your lawyers preview documents prior to submission.
Write your own statement regarding your disabilities and give it to your examiner after your lawyer previews it. That way your voice is heard.
Make a checklist for yourself to make all your points to the C&P examiner so you dont forget anything.
Leave with confidence and pray for good news!

My big problem with the VA is why do they not allow me to download my C-File? I can download my medical records but not my C-File.... Seems like they just like making a veterans life harder than it already is.

Thank you ! Everything with VA claims is wrong! They delay and deny on purpose. Then put you through an appeal again! Its illegal and wrong and they should be held accountable. Medical care is still hurry up and wait as well! When is this crime going to stop! My last exam I went to a civilian VES they sent me to and they didn't even see me because of an issue with someone gave them the wrong diagnosis. Now the VES doesn't communicate with the VA so I have no way of proving that my claim was made without a proper exam . VES probably got paid for my visit even though they did nothing!
As someone who has a supplemental claim pending. There’s no way I should not know any updates about my claim. Also it should never take 3-6 months for a C&P exam results

I think maybe I got lucky. I put in a new claim recently (March 2022) and they came back with a decision in 2 months from when I put the claim in. The decision came 3 weeks after my C&P exam. When I got the decision I thought to myself “wow, that was waaay faster than last time”. My first claim took a year.
This is great news but with my experience with anything that involves litigation, it seems this may be another drawn out battle in court? I was denied a claim for my back injury that I sustained while on active duty. The VA admitted that I did sustained an injury to my back while on active duty but their reason for denying my claim was based on me not having a continuous medical care and moreover, my back injury isn't service connected.
This doesn't make any sense at all. I've had one surgery already and about to go through another one for replacement of damaged parts to spine disc that causes nerves problems which in turn causes excruciating pain down my legs. Especially, my left leg.

VA is also closing claims without issuing a Decision Letter. They closed my SMC-K claim three time without issuing me a Decision Letter. I had two C&P Exams on this same claim. I haven't received a copy of these two C&P Exams.

Am a Navy Veteran residing on a comparatively small island and would like to thank CCK for this video .I have been trying very hard to follow up on a recently increased Va claim that i had with VA last year that did not include my dependents because according to them they are not US citizens. I am from the Federated States of Micronesia with no VA office, clinic or anywhere to turn to for assistance. I was legally recruited from here and joined the US NAVy for 4 years with an honorable discharged with a lot of promises that are not applicabled to here cause we are also considered as foreighners.
Am kind of frustrated sometime cause I believe there are some legal misunderstanting wirh our relationship with the US government I was recommended to relocate to the US to received all my VA benefits. I am a responsibled parent who love these islands so much plus our borders are still closed. It is hard to file on line cause of poor connectionp and also with no tool or resource to try to do anything to find assistance.
My case was denied, when I was out I didn't know I was not aware I can go to the VA, that was back in 2000, in the denied papers said that even that my disability start during my services,I didn't continue get care.. I get care for some in civilian dr, that I summit...It's been getting worse..Do you think you can help me???

It would be nice if VA could simply state what docket number that they are working on in each of the categories under AMA so we can at least have an idea how much longer we may need to wait for our individual appeals to be heard. I filed an appeal with BVA on March 2, 2021 for a direct verdict for an increase for PTSD and have a docket number but have no idea where in the process it would be. It is simply the not knowing how much longer until they at least get to my appeal that is frustrating. Thanks for all the informational videos that you post and if my appeal is unsuccessful I will be heading your way for help in this final matter. FYI, asking for an increase from 50% to 70% and currently stand at 93% for other disability claims that have been decided.
That's the trick with VA. They indicate "You are in the docket", but the reality is there are at least 130,000 cases alongside you, and they still refuse to offer you a time frame. VA promised Legacy would finish in 2022, I calculate their numbers provided by appeal metrics and at their pace they could finish by June 2024.
It’s been 31 years for my high value issues Legacy appeal remanded but never 👎🏾 worked. CCK you know my issues returned for adjudication.
I had a C&P exam in early Apr. for an appeal. The VA got my audio, hearing, exam results two weeks later. Before the End of April. In June I got another C&P exam notice. I called and asked why. What was different about this new exam. No one knew. They just said Go to the New Appt. Just in case!! So I went. The examiner said it looked the same as the previous rests. What the Heck. 3 months of nothing. 😡
I never had a problem with backlog, but for adding a dependant it has taken a long time.
CCK you have to meet very specific guidelines for them to help you. IF you are a VET and need help but don't fall with in the very narrow guidelines they tell you to call someone else like DAV. I needed legal Advise and got the brush off because I didn't fall with in the very narrow list of what they will help you with. I will admit they have great You Tube Video's. But what good does it do to need a Lawyer to get advice, but told to kick rocks. Don't worry I will find someone else to answer my Questions. Have a nice Day CCK. I possibly had a back pay issue for a big number, but they told me to kick rocks before I got to that, but hey they didn't want me so I will find someone else.

About time someone take legal actions against the VA this people got hired for nothing but walking around their building and blame COVID. We all know that the entried staff don't get COVID at the same time. Now hope they don't retaliate against veterans. Which is wrong from this agency mean the VA.
My first claim (2010) after retirement was 18mos, then another 10mos to get a 90% rating. Re-filed in 2021 with a lawyer and my exact same medical records (29yr USAF) and was finally awarded my 100% P&T. I was actually 320% with deferred items; skin cancer, spinal meningitis; burn pit (2 wars - 7 deployments to Middle East) hearing loss (flightline); I was also assigned to Area51 with a huge burn pit but no records of me working there (4450th). I'm truly thankful for my attorney and gave him 30% of my back pay (only 1yr instead of 11yrs). We've gone to lunch a couple times since. My nieces husband was a former Marine and stationed at Camp Lejeune in the late 70s. The VA does its' best to screw over veterans. All the Vietnam Vets shouls all be 100% from AG and 200+ days of combat. Period.
1ST claim 1984, result 10% rating,
then after decades of denials and countless C&P exams by doctors and nurse practitioners, DAV referred me to CCK. Fast forward 2021, significant rating increase. I broke down when CCK gave me a copy of a critical medical record obtained from the VA after all those decades, denials and C&P exams.
They had the info they needed all the time.
I was even threaten by one C&P doctor who told me that if I couldnt be positioned the way they needed me to be to take measurements that they would report to the VA "COULD NOT COMPLETE EXAM" which further delays me getting the help I urgently needed. That exam resulted in a reduced rating. 2 - 3 additional years to get the rating restored with back pay. C&P exam doctor had cited "Slight Improvement".
They have that much power.

I had my Law hearing on January 25, 2022, and I had the DAV represent me and I felt traumatized after that hearing!
Calls for updates to DAV are being passed to other employees rather than the person that represented me during my hearing!
In other words, my claims appeal updates are coming from non-VSO employees, Just office employees!
My former case manager was “retired” by DAV here in Phoenix, and so I felt that my law judge telling me I had only 30 MINUTES to go over 10 ratings updates that he filed before he left was utterly insulting, and I was made to feel as if I wasted the court’s time for my hearing taking an hour and 46 minutes!
I have MST and eye Statement in Support of Claim filed for a PTSD diagnosis I got back in 2013, but due to mishandling of my legacy case, lost the ability to claim before July 2017 unless I filed a new claim.
I was not properly prepared for the need for nexus statements that I was told by other lawyers would cost me upwards of $2000 to get a proper one, and I’m worried the nexus statement I did file might be deemed too weak due to a slight language barrier of the PA that did it.
I was shocked to learn these things are not done on contingency!

I was supposed to get my disability @ 100% at first diagnosis back at 2020 according to many VA doctors, but I'm still here when the C&P finally started at February of THIS YEAR, then C&P said they don't want to reimburse me past THIS February, and to this day when the documents are finally in for analysis they STILL aren't done yet and I'm STILL not getting my benefits.
I'm about to be homeless from the other side of the border against my choice, and they STILL don't want anybody to bother them while they're rich.
VA primary doctors, the VHA, don't get involved with, or hardly comment on what the VA benifits side, the VBA does. Two different sides of VA. It does not take 2 yrs to get a C&P exam and you didn't say when you filed a claim. Do you have a VSO to help you file and are you a US citizen ?
I am one of these Legacy appeals and my appeal date was april 2016. I had a hearing with a law judge in 2020 but he remanded back to the BVA who still hasn't been able to get my 2016 appeal back in front of the law judge. If they are telling you that the farthest back they are backloged is 2019, I can tell you that they are lying to you.
Evidently, the remanded appeals are not part of the 2019 year group. When appeals are remanded to the regional office, they are no longer part of the BVA. This is my opinion. Hang in there!

My husband was 100percent and they knocked him down to 90 percent because he was cleared from prostate cancer. However he has Altimers,. And the recently found a mass on his lung have not given me a diagnosis and is still under more tests. He has other medical issues as well. I have heard of the pak law what's this all intail?

I'm 80%. I should be 100% and will be someday but they did me dirty stating my hypertension was denied because I'm not on meds and my kidney disease was denied due to no clinical evidence. Then the next sentence they stated that hypertension was already awarded under PTSD but to break it out for its own rating I needed to be on medication. 😑We all know I gave them my medication list showing blood pressure meds since 2016 and plenty of "clinical evidence" aka all my medical paperwork and labs for my kidneys. I had zero issue getting through the C&P exams but I have a feeling this appeal will drag out. Stay on their ass guys don't give up and don't go away until you get what you are entitled to.

The VA denied our ftca claim 😮 and it's literally a straight slap in the face 😢 but we are going to ask for a reconsideration , sad thing is it's so evident that they literally allowed our dad to die from nsclc !! F.Y.I. If you are being treated at a vet center for p.t.s.d. The v.a. must request your treatment records in order to evaluate the percent of your p.t.s.d. Make sure it's in your claim that you are being treated at a vet center and inform who ever is filing your claim of same.
EVERY issue you go to the VA for is well documented (Not just PTSD). I wish more veterans would use the VA healthcare system if not for treatment but for documentation. It would definitely help the claims process.
Force the VA to make better decisions at the Regiional Office where the "FIRST" decision is rendered..... Process improvements not necessarily "MORE-MONEY!
They are spending an awful lot of money to question our conditions and nitpicking technicalities. How often to the appeals change the outcome of a claim? What I’m getting at is would it be more efficient to not require an appeal and give us what we deserve from the beginning?
My claim got thrown out because of a paperwork error that was out of my control. Now it looks like I have to start all over again even though I had a fully developed claim. Seems like a huge waste of resources.

Yep took 14 months for them to award me something. Had I known about intent to file I wouldve done that before i sent in the claim. But of course VA never wants you to know the things that benefit you.

I will call you July 5TH or 6TH. I need to file an appeal on my claims of secondary disability of my original disability award. I was denied sleep apnea even though the VA did 2 in house sleep studies and gave me a CPAP. I have been awarded for tinnitus and hearing loss. I was also denied on radiculopothy, even though my original knee disability lead to an award for plantar fascitis and heel spurs bilateral. I have nexus letters from a private physician who is also an occupational therapist, but the VA dismissed those.

The new system they lost my records, didn't know I had my annual appointment, didn't know my doctor quite, and couldn't give me a covid test so I could get into the fair.
Thankfully I completely got my disability, and hip replacement decade ago. VA is a total failed, on my last appointment. They said call us back next year and provided me with the new phone number.

If they just did their job the first time on half of claims it wouldn't be such a backlog. I get PTSD just to think back at the back and fourth I went through before I hired CCK. I have mixed feelings about this due to your timing and the passage of the PACT Act. I love CCK but I wish you would have waited until after they passed that law before bringing this action. Pact Act have nothing to do with the Back Log. Don't be Distracted with the BS, thats what they do to Us All the Time.
@@sargentking2436 I never even implied it did. What I said was they should have waited until after the PACT act passes. The reason is because the Act has infrastructure budget in it to address this. CCK suing may raise concerns requiring more be added into the bill to address the backlog and thus slowing it down further or even completely causing it to be put on a back burner when there are people who are in dire need of this bill right now. My concern is that their lawsuit is going to complicate budgetary concerns further which is the very reason the PACT Act has not passed yet. We need this bill now. They were set to pass it by the middle of this month and now with this pending litigation I am concerned it will just slow it down more still. I hope to God I am wrong.
@@Michael-dz2wg obviously you dont know how government works. There are thousands of Law Sues against the VA. One law suit dont scare them. We need more law suits. If they wanted to really help Veterans they would it without being told to. Veterans been crying Vietnam War and some dont get a dime. So if that's your only worry, good luck. They don't give a damn about us. There are laws already on the Books, they need to uphold there. Another Act is a Smoke Screen. People waiting 5/6 years. Hell hire more help with $750 Billion dollar Budget. It's going to VES, OTC, H?? whatever. Private companies get 50% of the money. Peace
@@sargentking2436 You just convinced me! I agree with everything you said. I am really sad for what they have put Vietnam veterans through and many more since still. I agree with you here. I just personally have a stake in this PACT Act passing. I need it passed and I worry too much. The VA is getting better but there’s still a lot of work to do. 20 years ago I couldn’t get them to approve nothing. It was like hitting my head against a brick wall. Now finally I have been getting some results thanks to lawyers getting involved. I hear ya now!

Seriously? Husband filed for Disability and was denied a couple of times, we just assumed the last appeal was the final. Then out of the blue husband received a call from a law firm stating they had received husbands information from someone at the Veterans Affairs office on his appeals, and they would take his case because after reading the boards decision on why they denied his claim they found wrong doing. Long story short this law firm went all the way to UNITED STATES COURT OF APPEALS
FOR VETERANS CLAIMS and Law firm won husbands case. Appeal was for July 31, 2017, then courts decision went back to the VA board and till this day waiting for their decision. What makes your law firm different? If your office takes on a case and you win the veterans case, it's still up to the VA board to deny your claim right? Law firm gets paid right away but veteran will still have to wait pretty disgusting!

Is it possible to have been erroneously discharged after being disabled by the military in the effort to cover the unjust order that caused the hidden disability to occur in the first place as a result of the miss judgment of the commanding officer!
Please crush them. I'm at 9 months for a basic claim. I waited 3 years to have my child added as a dependent. Shut them down already. They're broken beyond repair.

According to my Understanding, Congress who wrote The US Title Code 38, legally gives The VA "Only" up to Two Years to Answer an Initial Claim. So how much time legally does The VA have in order to Answer an Appeal? Your Video was Uploaded in July 2022 and You say that the Legacy system has over 70,000 Veterans' Appeals Unanswered as of February 2019, so thats THREE & a Half Years since they Filed an Appeal. So Congress, being that they have only 2 Years to Answer (with a Determination of Approved or Denied, plus the Percentage, or Not) an Initial Claim, they most possibly were Late to begin with in Answering (so 2 Years or Longer) AND APPEAL means that after The Vets have already waited for 2 years+, they were DENIED (which is Why The Appeal) and Now theyve waited an Additional Three & half Years, so thats a Compunded Total of at Least Five & a Half to Six Years since theyre Initial Claim was Filed and Denied. That Is a Travesty and totally Unacceptable and a Disgrace on The VAs part. But THAT Is The VAs Infamous Reputation as it has been for Many Decades now. ThankYou You Two & CCK Law Group for what Youre doing For Veterans. God Bless Yous & I Salute My Fellow Veterans; God Bless *In JESUS Name). To My Fellow Veterans, I say, do Not give up!
