  • Did you fail a DOT drug or alcohol test? Worried about what’s next and if you’ll ever be able to work in the trucking industry again? Kelli, the compliance manager at ATS, explains everything you need to know if you have concerns about this.
    She’ll start by explaining when and why you may be drug or alcohol tested, how you get your results and what happens if you receive a positive test. She’ll also explain the consequences of a test refusal. Your test results will show up in the Drug and Alcohol Clearinghouse.
    If you receive a positive drug or alcohol test (or refuse a test), you’ll need to undergo a Substance Abuse Professional (SAP) program before you can return to the trucking industry. After you complete the program, some carriers will hire you, while some will not. Before you undergo the SAP program, carefully consider your options and which companies you’ll be able to drive for if you decide to complete the program.

      100000% agree I use cbd for depression & chronic anxiety & it's 100% legal & I'm still labeled as a fail! F the DOT & there testing.

    I am a new driver and am looking for info on how to sign up to get tested for drugs and alcohol. Is there any place near where I live, in Oakland CA? Or is there any recommendations of companies I can schedule to test with?

      Thank you for your question! We are located in central Minnesota, so we are not aware of any specific locations for testing in the Oakland, CA area. However, we do know that many clinics provide testing.     Regulate weed like alcohol, if you drink alcohol on the weekends, i guess you need substance abuse as well, that would make the majority of people that exist go through sap, every driver needs to park their trucks on 4-20 in support

      The two problems that currently exist is that marijuana doesn't leave your system the way alcohol does, as well as it being illegal on a federal level. Until the federal government legalizes it, this won't become a reality.

    There is nothing random about my company picking me and a handful of other guys all the time about 80% of guys never take one. And they contact the employee first not the employer

    I went to a DOT testing site and the medical Tech that was reading the temperature of my sample dumped it in the sink then threw it in the tbash. According to DOT's rules and regulations regarding urine specimens and out of temp specimen must still be submitted for testing as well as a direct observation sample where they watch me pee.
    They told my supervisors that I could just come back with new lab orders and it flagged me as a fail and now I'm trying to Sue the hospital and my employer because the hospital did not perform their job responsibilities properly or follow DOT regulations and my employer also did not follow DOT regulations and they should have known that if I left it would be deemed a fail. Nobody told me it would be a fail if I left but I did find out while researching some information that it counts as a fail if you leave and I don't know what to do or who to talk to this is probably the lowest point I've ever been in in my life

      @@AMVRebirth I think it's absolutely ridiculous that there isn't some type of verification program that you could go through that determines that you're not a drug user and that after examination of the facts that it's all a misunderstanding or a mistake on the Clinic's part. There's no reason my entire career should be shattered just because somebody was too stupid to know how to do Drug screens but I can say that because I was too stupid to know that if you left it counted as a fail I was just doing what my boss told me so I didn't lose my job

Stop with all the extra "im trying to sue" you are only lying to yourself. Everyone knows at any drug test if you leave you fail, that is common knowledge.

    If I get hired at a new company after testing positive, will they still look for me on the clearing house if I’ve been hired as a dock worker and not to driver?

      Yes, your positive DOT drug test result will likely be in the Clearinghouse, and new employers, even for non-driving roles, can access this information. Be transparent with your new employer about the positive result, as it may impact your employment.

    What happens if your halfway thru the follow up testing after RTD, and you decide trucking isnt for you anymore so you decide to pursue an entirely different career? Does your cdl go back to prohibited? Or are you just on the clearhouse for the remainder of the five years?

      If you fail, you'll still be marked as a failed test under the Clearinghouse. As for the 5 year comment, a failed test does not fall off of your record after 5 years. You need to go through the SAP program to have it removed.

My question was referring to what happens if you decide to quit trucking while your halfway thru your follow up testing (the 6 required after returning to duty) I know your on clearing house for 5 years but does leaving the trucking career affect your cdl if you dont finish the follow up tests?..

    I'm upset today because I was fired because I was told that I failed a DOT Federal drug test and I had Trace amounts of marijuana I do not do drugs or alcohol I don't drink and I don't know what to do next

      Sorry to hear that! Do you consume CBD products? Sometimes they will leave trace amounts of THC in your system.
      Otherwise, speak with your MRO and have them dispute the results.

    What if you were never hired and you failed a pre employment test? Are you still reported?

      Thanks for the question. I just talked with our compliance manager and she said yes. DOT regulation requires reporting to the clearinghouse for any failed test.

    Can I work for ATS after completing the SAP RTD? I applied for a company to get my cdl through them. I went to the pre employment drug test and failed cause I still had a little CBD in my system. I then later applied to another company and passed the Clearinghouse and Company drug test. I drove for that company for a year and passed every drug test until my FM told me I about the violation while at the terminal.

    What if I quit my job in the morning after my night shift then get called by my manager that he needs to see me in the office in person I did not know for what at the moment turns out I went to see him that same day in the afternoon after my 10 hr rest but he never showed up and got told by a supervisor that I need to do a random but I had already quit earlier and had a new job line up for next week so I called HR and notified her about the situation she said she would take care of it with Dot compliance and don’t need to take the drug test. Well turns out my new job calls me the next day saying they need to check my clearinghouse cuz there was a change, well I went and check my clearinghouse and turns out my former employer put on my clearinghouse DRUG TEST REFUSAL also I am clean and have nothing to hide been with my cdl for 12 years and never had a problem like this. now I can’t get a job anywhere as of now… Help anyone?!! 😢

      It won’t affect you at all. It will only affect you with the specific company that you applied for

      The Clearinghouse does not include pre-employment drug tests that are not required by the DOT. For example, if you failed a drug test for a job at a restaurant, that would not show on your Clearinghouse record.Pre-employment DOT drug tests are required when someone applies for a safety-sensitive position.

    Good info, but the drug testing process is a joke.
    My company will let you know you're coming up for a random, then send you to a local lab that doesn't care if you sneak fake urine in.
