It has been and it’s still continuing but the man is not being charged despite being in contempt for years. to make things worse, through the maintenance officer, the man asked to settle a lower amount than he actually owes. These cases are straight forward but they take a considerable amount of time and require money to succeed.
It's good progress. If this was manipulative tactic by the mother, serves her right. On the other hand some parents both men and women are not good for the child. It's better if they don't see the other parent at all or supervised visits. Some are depressed and are prone to kill their kids. Some use them for rituals. Some hated the kid from conception so they can harm the child through rape etc. The court should also look at such in future.

They can't do anything to someone who hasn't been served. In this case the lady was served, she was given an order by the court and didn't comply and the dad followed up on that. Contempt of court, once you take someone to court and court order is issued you have no choice but to comply. It is not her refusing access. 1) Was the court order not about the denial of the father's rights, which actually also with the child's rights? 2) Doesn't this whole episode give enough grounds for the termination of the mother's parental rights, especially seeing that she'll be in prison for an extended time?

If you open a case for that the court will order the father to support, if he disobeys order then he may get arrested. if the mother denies father access she will be made aware of the contraventions may be ordered by court to give father access. If the mother disobeys she may then be arrested.
It is about time that we see more judgements like this. The child need his or her father. My ex husband did not pay me any maintenance for my child. Inspite of that he was welcome to take my 2 sons excess whenever he wanted to see his children and pay their father visits. My children are close to his family. It is not about us the couple, it is about the children. Wake up ladies, leave these dirty manners and allow children to have a relationship with both parents. Children did not ask to come into this world. Grow up and become matured women. Without him, that child would not be there. There are also men who were ordered to pay maintenance but they are continue to be in contempt and are not held liable.

It has been and it’s still continuing but the man is not being charged despite being in contempt for years. to make things worse, through the maintenance officer, the man asked to settle a lower amount than he actually owes. These cases are straight forward but they take a considerable amount of time and require money to succeed.

It's good progress. If this was manipulative tactic by the mother, serves her right. On the other hand some parents both men and women are not good for the child. It's better if they don't see the other parent at all or supervised visits. Some are depressed and are prone to kill their kids. Some use them for rituals. They can't do anything to someone who hasn't been served. In this case the lady was served, she was given an order by the court and didn't comply and the dad followed up on that. There are men who are given jail time for not following court orders to support their kids but if you don't follow up as a mom then ofcourse they won't do anything.

All I want to warn you as fellow SA is that South African justice system is for sale. It depends who has the money. Take your time read that case for your yourself I'm going to do that before I can judge a poor. The fact that the father had to pay R15k is because the child's needs had to be met. It is not easy to raise a child there are many factors that determines the amount to be paid. The money is not for the mother it is for the child.
