What if a qualified happens to someone who is still in their permitted b1b2 visa stay period. Will they be eligible to report crime to acquire this U Visa?

Please Luis Help me out. I am a mental victim of a gang shooting in a neighborhood. I was in my car in the middle of a mass shooting and escape from there by having a near death experience. Shots fired like 10 times near me and this incident made me mentally sick and mentally unstable in my daily life. I have contacted police and went to the fbi to help them out telling the story. Ever since I have been going to the doctor and seeing mental therapist because I am traumatized by witnessing this unholy and dangerous crime or murder Infront of my eyes. Am i eligible to apply for the U Visa? I am a F1 currently and I have my dependant with me. I fear death everyday ever since that happened Infront of me. Please let me know if I am eligible and should I apply or not?

Is it possible to wait for a green card approval outside from USA after staying in us for 3 years a non immigrant U visa status?
I didn't get U non immigrant status 7 years ago because of negligence of immigration lawyer so i cant wait for other 7 years for the green card inside USA. My parents are very old- i cant leave them for too long. Is there any way to use that i stayed already in USA for 11 years before that. And because my layer didn't send the right form to Immigration in 2017 and lied to me about that, i was refused in U visa, but i stayed in USA after that for over 3 years. Also do i have to stay in USA for 3 years non stop in non immigrant U visa status or i can go to my home country sometimes during that term as long as there will be 3 years in total before applying for a green card?
