There is nothing illegal about using torrents and no section of the Indian constitution prohibits the use of torrents unless you are not downloading copyright material and distributing it illegally... Like you said already, torrent is a peer to peer file sharing protocol that keeps you anonymous (to a certain degree, for extra anonymity you need to take extra measures). Using it for file sharing is much better than downloading over http. But, because of the anonymity factor, people use it for sharing illegal files.

According to Indian Copyright act " creations or Intellectual property(Videos/movies/painting/Books) is copyright to creators during their lifetime and after 65 years of the death of creator. you can legally download movies or books whose creator died 65 years ago.
