      Trump basically called the judge a bbich. And then threaten the judges daughter. Several times and even after he was asked to stop.
      There is no reality the judge would not give prison time if convicted.

      What is the governments subject matter jurisdiction argument as to Trump v. Anderson such thst the mere conduct of a trial at the current time is not then illegal under federal law because of the impact on campaign speech? Or do we order Joe Biden not to engage in any election speech whatsoever on trial days? Or do we set aside any Biden victory in 2024 upon grounds New York deliberately undermined the federal election process? In any event, Im sure Roberts and Co. are about to internationally embarass the New York courts for not knowing the federal law.

      He's too wealthy and given way too much preferential treatment to face any real consequences for his actions. In Georgia he has a GOP activist judge doing everything she can to ensure he faces no consequences. So not optimistic.

    The idea of a "jury of your peers" comes from the Magna Carta, but the phrase doesn't actually appear in the U.S. Constitution. Instead what we have is a right to "an impartial jury" drawn from the surrounding region. There's an interesting question in whether "impartial" means "disinterested," because "partial" is derived from the same Latin root as is the word "peer."' So it is inconsistent to require a jury to be impartial and then also require it to be made up of peers. In old English cases they would often have to import a jury from your local area, made up of people who would be familiar with you, and expected to know something about your character, reputation, local standing, and local habits and norms.

      Peer also means of the same rank (within an aristocratic caste system). It wasn't until *2009* that members of the House of Lords in the UK were required to be tried in the normal UK court system. It changed in the wake of controversy after a Lord got out of (iirc) a vehicular manslaughter charge because his jury had to be made up of the rest of the house of Lords, naturally leading to a not guilty verdict

      ​​@@AbsolXGuardianThis is untrue: trial of peers in the House of Lords was abolished in 1948. The last such trial was indeed for vehicular manslaughter.
      Also it's considered disqualifying now if a juror knows the defendant, because it's assumed they are biased by their prior knowledge.

    I've been on some juries, including one for a murder/arson case. It's always very interesting, at least to me, to watch the process of seating a jury. In the murder/arson case, a name was called, and a heavily pregnant woman got herself to her feet and headed for the jury box. The judge asked her, "When's your baby due?" The woman said, "Last week!" She was immediately excused. After a few hours I ended up an alternate juror for that case. The defendant was found guilty of arson, but they never proved that she had killed the victim. I don't live in New York so there's no chance I'll be called for Trump's jury.

      I came to the comments to see if anyone had said anything about that option of volunteering for jury duty in New York. This is the closest I've seen so far.
      The thing is, having also been a juror in a pretty sad criminal case myself, I imagine it could be an interesting and educational experience for law students in particular, as long as volunteering for jury duty doesn't land you on some crazy long case that takes up too much of your time and energy.
      i was a student when I served on that jury and it was quite doable. Much more so than later on with little kids at home etc. and interesting enough that I may well have considered volunteering if that had been an option, with the possibility of setting some limits yourself on what exactly you are able to volunteer for in terms of trial length (and intensity - I couldn't do murder cases, for example).

    "Jury of Peers," despite its common usage, appears nowhere in US or NY law. The US Constitution guarantees an "impartial jury," and NY law requires juries to be selected by an unbiased process.

      True, but the language does stem from the Magna Carta and has been paraphrased in cases pertaining to the 6th Amendment (and as my ConLaw prof will tell you-every time the Supreme Court releases an opinion, the Constitution is altered due to changes in interpretation). So “jury of peers” may not literally be in the Constitution from a pure textualist perspective but it does have some origins historically and in 6th Amendment precedent (:

I would object to an invasion of privacy if i was subjected to that, am i entitled to? Or is all they can find using your real name and public-only posts good enough?
    I probably have 80+ forum accounts which i no longer even remember, most people have a throwaway account on Reddit which they used to ask a potentially embarassing question, etc.

    You should do an episode on how different the justice system is for the rich and powerful. The most frustrating thing about this is how different these people are treated and how fines are only for poor people.

      The rich aren't exactly above the law per se, it's just that they can afford to sit in court for years on end while a poor person can't. Also a 5k fine for a billionaire is nothing but a 5k fine for someone who works for a living is a major kick in the teeth. Personally, I think fines should be a percentage of your anual income instead of just a flat fee. I think that would go a long way in starting to level out the playing field.

      I agree, as a Mexican it's a weird thing to order people to do, at least in our case you can "affiliate" yourself to a political party separately and even become a militant or Party Officer but there's no way you should be forced to choose a party from the get go, in fact you're even allowed to register a non-vote or vote of no confidence in the government by writing so on your ballot.

      Many states in the USA have a primary that limits voters to their registered party. The regular elecrions don't matter for that

    3:36 other countries actually rely on volunteers for jury duty. But then again there are less of them per trial and they can do things like ask the witnesses questions which makes it way more appealing to them I imagine.

    I was thinking we should have asked the Amish to help us with trying Trump. They are less likely to have been following this case as closely, so they probably aren't as biased. Doing it in Amish country would help prevent him from turning it into a TV spectacle. I do know that there are practical, and jurisdictional problems with that though.

    Thank you for trying to answer a question that has been spinning through my mind every time T gets brought up. If I could make a suggestion, could this channel please go over what is considered contempt of court and what is not? And what the penalties for such actually are? The way I see it, violating a Gag Order is contempt of court at the very least, but perhaps I have seen inaccurate portrayals in TV and film on this matter.

      Contempt is anything the judge says it is. It's a judicial power, not a crime. Especially when the courtroom isn't filled to bursting with lookie loos and reporters. Not standing for the judge, not sitting, making noise or talking, making threatening gestures or just being disruptive could all qualify.
      In New York, the statute says up to 30 days in jail per offense and up to a $1000 fine.

    I was called for jury duty once where the judge allowed anyone to opt out no-questions-asked because the trial was likely to last several months and had something to do with child abuse.

    3:48 yikes that's an issue.
    In a sane country with sane election procedures (if you consider a country where people could be charged for felony for trying to vote just so the votes are disqualified, you do you, but let's be serious), everyone is qualified for voting, without needing to apply to it. And local voting polls select people at random to oversee the voting procedure. And it's **important** that it is random, so people could not try and fish for tables to overturn the results in the ballot.
    That's why my country's voting procedure is not only great, but also fast (most times, we get the results by the end of the day).

      Or you could have a redundant system that will be almost impossible to tamper with without a) getting yourself arrested and b) not materially impacting the election at all.

      The best recommendation I’ve heard is from Vivek: single day voting as a federal holiday, paper ballots, voter ID confirmed at the polling location. Mail in ballots by necessity only.
      We’d have fair and honest elections again. Anyone that says voter ID is discriminatory or racist is the racist, because black people are in fact NOT too stupid to find the DMV

      The reason that many Voter ID requirements get struck down as discriminatory is because there is no way to get one for free (making it effectively a Poll Tax) and/or its made super difficult for people to get the free ID.

If Article VI, Paragraph 2 of the U.S. Constitution, commonly referred to as the Supremacy Clause, supersedes State Constitutions and State Laws, why should law abiding citizens follow State Laws that are clearly unconstitutional???
    And why aren't treasonous politicians held accountable for subverting our Constitutional Rights???

      Because of amendment 10. The State holds the powers that aren't already held by the federal government. And laws are only called unconstitutional if they are challenged and are considered unconstitutional by the various courts and circles of both the state and federal government.
