      @Tenebarum Месяц назад +114

      @learnbyheart7 there used to be a squatters rights law decades ago because of abandoned property. No one was paying taxes on the property, and if you could live there and improve it, you could gain rights. That law is no longer necessary in any way. The squatters are taking over empty but not abandoned properties.
      A lot of people got squatters rights in the keys, when not many people wanted to live there.

      @@mb9662 Don't care. Just because the landlord refuses to fix the dish-washer, or a ceiling fan, that doesn't make the property _BELONG_ to the tenet. It means that the civil contract between the two is broken, and the renter can move out.
      Obviously you're a thief yourself, and so you need the mental gymnastics you've just exhibited in order to re-define your own theft. Have you tried being honest? Or hard work? Apparently not.

      @@mb9662 I understand that 'thinking' isn't your strong suit, but maybe if I use small enough words you'll grasp it?
      A renter and a landlord enter into an agreement: the landlord will provide these services, and in exchange, the renter will pay.
      If one of them fails to uphold their end of the bargain, then the deal is dissolved. Your idea of "it's over, so I guess I don't have to pay anymore" is built on pure, abject ignorance.
      I probably used too many words, your sense of permanent-victimhood and TikTok brain means you just don't have the reasoning _OR_ attention-span for an actual conversation.
      Not that it matters anyway, because the bigger issue is people who squat an "abandoned property", and then claim that it belongs to them. That has *nothing* to do with landlords or rent or a ceiling-fan switch that isn't reliable.

      Call BS to the two previous responses here. Been in law enforcement for decades and what they're saying is a tiny portion of the problem. The majority of squatters know exactly what they're doing and that it will take months to remove them. They then just go and do it somewhere else. There is no "nuance" involved, you either legally own the property or you don't, something that can be determined in a day, not months. This is exactly the kind of thinking that enables these people and perpetuates the problem, hopefully it never happens to you.

      Let me explain why the loophole exists. It has to be amended because it's being abused but primarily the intent was to protect the disadvantage people who usually are tenants. Where a living space is considered vital unlike having a car etc. Because abusive landlords could technically suddenly rip off your contract and call the police and have you thrown out in winter with your kids. Basically the idea is simple. Have the civil court settle it so it goes thru proper eviction procedures and tenants won't just suddenly get throw out in the street. Then the ahole squatters came to abuse it. Actually if the procedure was very fast like 1 week max in court. This wouldn't be an issue also. There should be tenants rights and expedited squatters complain committee.

    Edit: Holy crap so many people.
    While I agree that the Government should not be involved in homeowners property, I still think that at the very least they can do is put federal laws in that don't hurt us but help us, we live in the US yes?
    So why can't we ask those who lead our country to accept the grim reality we live in and find a silver lining in these nation wide problems and fix them, spending money where it should be is more important than what we already have, the US dollar is not some international good, it's our currency we use within the borders.

Squatters rights take 5 years to go into affect in California, so it is not a huge issue. However, landlord tenant laws require 30 days before the tenant, who has maybe paid rent once, now has at least 6 months to live in your property and you'll need a lawyer, and you can't collect rent, nor can you evict or not renew the lease to make improvements. I read the bill, and it doesn't directly. It only allows the landowner to fill out a paper, get the Sherriff's assistance in removing the persons within, and if they are seen on the property again they are guilty of trespassing. I think that is an optimal solution as anything more probably wouldn't have gotten passed.

      @@bluecat2991 I agree. Some houses may have been left empty by the owners for one reason or another--like their age or the age of the building. Then the property becomes an inheritance after several years and the new owners find out some homeless people have taken it over. Now, the homeless may not have been bad people. I know it would be rare for them to be good people, but that is why it shouldn't be mandatory jail time. Good people may have even been trying to improve the property as they made it their home. That wouldn't require restitution and if they were bad people, I doubt they'd have the funds for restitution. Just getting the intruders off the property would be my main concern. And anyone who owns property should have insurance on it to take care of issues associated with intruders. If the property was in good condition and the intruders had been trying to improve it, I might consider letting them rent it from me if I had no other plans for it. A rare situation to be sure, but I think this law would allow for leniency by the home owner and the law.
