I came to this video of your channel to understand more about Writ Petition. I recently received a copy of Writ Petition, which is filed against few public authority and two individuals, and I am one of the two individuals.
In that petition I find that the petitioner is falsly accusing me of some actions that I have never committed. The petitioner has also attached a copy of the complain that has been made against me in which all the accusations are false against me.
Thus, in this situation what should be my next course of action.

*AFR judgment is a final judgment. After that there is no hearing.*
*AFR means Approved for Reporting..
Court Judgments are usually reported in Journals, websites & media for academic purpose.But in some case there may be some issues i.e. privacy, no newness etc. Therefore the author Judge's approval is sought for "Reportable/Non Reportable " for each.*
That's all.. nothing significant to the merits of your case.*

Sir, I have a question. I filed a writ petition in High Court in February 2022. The ground of challenge was my candidature was rejected based on a point that is not valid(proof document is RTI Reply). Till today the respondents have not filed the affidavit in reply. Now, can the respondents raise other grounds of rejection at this stage? If they do, will the court entertain such objections?

हमने हाईकोर्ट में कुल 8 रिट याचिका दायर की थी जिनमें से 1 रिट याचिका एग्जाम होने से पहले तथा बाकी की 7 रिट याचिका एग्जाम होने तथा एग्जाम का रिजल्ट आने के बाद दायर की थी । हाईकोर्ट की सिंगल बेंच ने सभी रिट याचिकाओं को accept करते हुए फैसला हमारे पक्ष में सुना दिया ।
अब दूसरी विपक्षी पार्टी ने Divisional Bench में अपील कर दी है एवं दलील दे रहे है की इन सभी 8 रिट याचिकाओं में केवल एक रिट याचिका exam से पहले दायर हुई है बाकी की 7 रिट याचिका रिजल्ट आने के बाद दायर की है इसलिए ये 7 रिट याचिका खारिज की जानी चाहिए एवं केवल एक ही writ याचिका मंजूर होने लायक है ।
सर क्या ऐसा अब हो सकता है की हमे सिंगल बेंच में योग्य मानकर और अब divisional bench में बाहर कर दिया जाए ???

Hi sir, Mera service matter for selection Mat court Aurangabad ne final judgement date 18,feb2018 ko order kiya tha. How can writh pitition file high court
Yes. Challenging the order of Maharashtra Administrative Tribunal you can file a writ petition before the High Court. However the writ petition is to be filed within a reasonable time of approximately 3 months. In your case the order that you will be challenging was passed in February 2018 that means 4 years back. So in the writ petition itself you will have to explain the delay satisfactorily, by giving proper and acceptable explanation as to what prevented you from approaching the high court in writ petition within the reasonable time.

I think thats a practice in the Supreme Court of India. I do not work in the supreme court as a lawyer but I think from the terminology that you stated it's a matter before Supreme Court. For better understanding of your query please contact any lawyer practicing in the supreme court regularly.
सर हमारे विपक्षी ने चकबंदी आयुक्त के खिलाफ writ याचिका दायर करके stay ले लिया था 1986 मे उसमे हमने 1989 मे counter लगाया था लेकिन पैरवी नही की। 2010 मे petitioner का पुत्र इस case मे पैरोकार बना। 2011 मे वादी की मृत्यु हो गयी और 2019 मे प्रतिवादी की मृत्यु हो गयी लेकिन वादी पक्ष की तरफ से कोई substitution file नही की। क्या इसमें writ का abentment हो जायेगा क्या highcourt इस case को दुबारा सुनेगा

It's simple.
Apply for certified copy of the judgement by paying required fee. You will get a certified copy of the judgement.
Another option would be to download the judgement from the website of the concerned court. This will not be the certified copy but still may serve your purpose of understanding the judgement.
Now what is the website address of the court and how to download that order that you please find out yourself at own level.
How to deal with the govt. In judicial way when they do not follow the land acquisition procedure lawfully? We have submitted an application to the concern department but they are not entertaining the grievances. Now what is the legal procedure that we can follow? Please suggest sir

Please cover what are the points to admit delay and laches cases.
In case there are delay and latches then the petitioner has to explain in the petition itself what prevented him from approaching the court within a reasonable time period. The petitioner has to narrate all the facts and explanation in a chronological manner right from expiry of the reasonable period of limitation from the time of arising of cause of action for filing the petition, till actual date of filing the petition. This explanation should be of satisfactory nature and should be such that it would tend to be acceptable to anyone including the court. The crux of the matter is to show that the petitioner was prevented by "sufficient cause" in filing the petition at the earliest. The entire explanation can be incorporated in the writ petition itself and there is no need to file a separate application for condonation of delay along with the writ petition.

Sir agar High court s case haar jate hai to kya fir se dobara high court m re-apeal kar sakte hai? Case compensation s juda hai
जी नहीं। अगर हाई कोर्ट से एक बार केस डिस्पोज ऑफ हो जाए तो दोबारा वही केस हाईकोर्ट में नहीं की जा सकती। अगर डिस्पोजल आर्डर में हम हार गए हैं तो आपको वह आर्डर चैलेंज करते हुये ऊपर के कोर्ट में यानी कि सुप्रीम कोर्ट में जाना पड़ेगा।
अगर हाईकोर्ट ने अपना आदेश पारित करते हुए ऐसी कुछ गलतियां की जो रिव्यू में सुधारी जा सकती है तो ही हाईकोर्ट के उस आदेश के खिलाफ हाई कोर्ट में ही रिव्यू एप्लीकेशन डाला जा सकता है। मगर रिव्यू एप्लीकेशन तभी स्वीकारा जाता है जब कानून ने रिव्यू एप्लीकेशन करने के लिए जो ग्राउंड निर्धारित किए हैं वह आपकी केस में उपस्थित होने चाहिए अन्यथा रिव्यू एप्लीकेशन डिस्मिस किया जाता है। तो आप के केस में रिव्यू एप्लीकेशन करने लायक स्थिति है या नहीं यह केस को और हाईकोर्ट ने पारित किए हुए आदेश को पढ़कर ही बताया जा सकता है।
अगर रिव्यू एप्लीकेशन करने लायक स्थिति नहीं है तो आपको हाई कोर्ट के ऑर्डर चैलेंज करते हुए सुप्रीम कोर्ट में ही जाना होगा (अपवाद एक हो सकता है जैसे कि अगर आपके हाईकोर्ट में ऐसी प्रोसीजर है कि सिंगल जज के जजमेंट के खिलाफ 2 जजके बेंच के सामने अपील की जा सकती है तो वह एक रास्ता आपको उपलब्ध हो सकता है। मगर ऐसी प्रैक्टिस आपके हाईकोर्ट में चल रही है या नहीं यह जानकारी आपको वहीं से लेनी होगी। मुंबई हाई कोर्ट और उसके बैंचेस में पहले यह प्रैक्टिस थी अब वह बंद हो चुकी है)

Sir, झारखंड पंचायत राज अधिनियम2001 के अनुसार हर जनगणना के आधार पर पंचायतो का परिसीमन विखंडन पाँच हजार जनसंख्या मे पंचायत का गठन करने का प्रावधान है, लेकिन 2010 के जनगणना के आधार पर हमारे पंचायत मे 11621 जनसंख्या है फिर भी पंचायत का बिखन्डिकरन नही किया गया है । क्या रिट पेटिशन कर सकते है?
