A judge when posted in different state is bound to deliver justice in the language of the state otherwise a translator should be provided by the hon' court. Judge when posted in Bihar not speaking in Hindi atleast should have deferred the case to a certain date when the translator is available. Hindi shouldn't be imposed. Hindi isn't our National Language. And no, it isn't permitted in the High Court, it is only in the lower courts. You may love your language, and I can love mine too. Perhaps stop your imposition and try to accommodate. If you have an issue with language used in court, feel free to file a writ.

Judge was right. This country is multilingist , if some advocate files case in Tamil language to a Bengali origin Judge in Tamilnadu, judge has no ability to understand that. Judiciary should have accept English as common language. A advocate have to qualify LLB, and medium to Study LLB degree is in English all over India.

The advocate is foolishly arguing before the judge. He needs to understand that the high court judges are appointed by the President and the high court & union judiciary have been given a common language for official purpose that is English. If a north indian judge goes to kerala, TN, Karnataka, Andhra, etc. And if the advocate presents his argument in native language before the north indian judge, how will he be able to understand what he is saying. For fast official working purposes English has been issued as a common language for judiciary and that's the only language court has to work on that linguistic line. The judge is completely right here in accordance with the constitution.
@@Karanbansal007 Yes what you are saying was read out from para 139 of the rule book, but it nowhere says that the lawyer must provide the translated copy. A lawyer can but he does not have to. It is the duty of translation department to provide translation and a judge can anytime ask for the translation from them. It can be found in para 79 of the rule book derived from a division bench judgment made in light of judgment on which para 139 is codified. If a lawyer can translate it then why will he submit his petition in Hindi in the first place? In patna high court lawyers have always submitted in Hindi and various non Hindi speaking judges have gotten the translation from translation department. He was transferred to Patna High Court in 2021 iirc, so he obviously doesn’t know the rules and tradition of Patna high court and that is fine, it can happen to anyone. But what astounds me is his level of arrogance and rudeness towards others.
Seeing the common people of my country being insulted by this anglophone judiciary pushes me towards the idea that this institution must be teared down. Enough is enough. Article 348(1) of the Constitution of India provides that all proceedings in the Supreme Court and in every High Court shall be in English language *until Parliament by law otherwise provides.* 2. A full bench consisting of *Chief Justice Amreshwar Pratap Sahi, Justice Ashutosh Kumar and Justice Rajeev Ranjan Prasad* held that petitions can be filed in Hindi language at the High Court along with their English translations. (30 April, 2019) Half baked intellectual.
These judges do everything except Justice, if something is pending in this country that is Cases , they don't even listen and gives next date , i have experience in one case, they don't even listen for 15, 20second, and skip to next.
This is quite interesting! Looking at the comments, I feel there is a need to put things in the right perspective. The Ld. Advocate has submitted the following: 1. A full bench of the Patna HC has held that Hindi/English as a language is elective and not exclusive for proceedings before Patna HC. However, where a party has produced the records in Hindi- A translated English version of the same needs to be supplied. (As per para 139). 2. A division bench, being aware of the full bench judgment has directed the translation department (in-house department in the HC) to supply the translated copies, instead of ordering the party/advocate itself to produce it. 3. The Ld. Advocate here has sought to rely upon the Division Bench order and seeks indulgence of the Hon'ble Court to pass a similar order and direct the translation department to supply the translated version of documents. 4. The Ld. Counsel has further contended that since the party as well as the counsel themselves are not adept in English Language, they cannot be directed to mandatorily provide the translated version. Especially given the fact that a translation department exists for this very purpose and an Order passed by the Division Bench of the Hon'ble Patna HC has also considered directing the translation department fit for the job, rather than the party/advocate. On the other hand, the Hon'ble Court had on an earlier occasion directed the Ld. Counsel to supply translated copies (which, for that matter, is a routine order). On finding that the earlier order has not been complied with, the Hon'ble Court deemed it fit to dismiss the matter. Personal opinion- In this case- I believe there has been a communication gap as neither the Ld. Counsel was able to entirely convey what was intended to be conveyed, nor was the Hon'ble Court able to fully appreciate the submissions. Clearly, owing to the level of discomfort with the concerned languages. P.S.- Firstly, these videos are for the purpose of learning and getting an insight as to how our Courts function. Such submissions and orders cannot and should not be judged as right or wrong. While the Counsel is 100% entitled to make his submissions (without any fear or judgment by anyone), the Hon'ble Court is empowered to proceed as it deems fit in light of the submissions made and records presented.

The judge could simply request for the transfer of this particular case to another seat who could understand the Hindi language instead of cancelling the petition directly. If honourable Justices aren’t able to understand the language of almost 80 crore of his fellow countrymen, then he should separate himself from this case or at least look for the possibilities. This thing seems little ironic that after 75 years of independence, till this date, Indians don’t have a common consensus on one single indigenous language of communication throughout the country. And this country dreams about topping the world. Will never happen.
I agree that the judge should have been more nicer. But at the same time I would like to remind you and help you out of the Hindi speaking myth, less than 30 % people of India have Hindi as mother tongue and less than 47% are native speakers. We need to stop saying assi crore ki aabadi hindi bolti hai… sab ko bad Lagta hai but Aisa nahi hai.

If the parliament is also said to continue its preceedings in English I don't think all the politicians could speak and explain in English then why it is happening only in court especially in india where major population is Hindi speaking and not English speaking. Hindi is not national language. It's the lawyers job to file the translated copy to the bench. He's arrogant to tell the judge to get the judge to get the translation and when the Advocate is not able to satisfy the judge he brings up Hindi out of context. He's lucky he is suffering contempt proceedings. Also people don't mistake in to thinking that the judge is objecting to filing in Hindi but problem is with not filing translation. Hindi being local language in Bihar Filing in Hindi there is correct but when judges from other States come it's for the Advocate to file English translation for the convenience of the bench. I will try to get the judgements being referred to in this video. That Advocate's tone while telling the judge to obtain a translation which itself is appalling and the tone in general is certainly not right.
People should understand that judges of high court are transferred to different states. What would a judge from MP, who's a sitting judge in the kerala high court do? Speak in english or listen to the hearing in Malayalam.

People are defending lawyer for sympathy! But as per law the proceeding should be in English language only! Because southern parts of India has different languages so during 1965 they were fighting to get permit to proceed in regional language, But this was denied by the chief justice council. The reason was many judges are from different places it will be difficult for them to proceeding in Regional language, and there will be high probability of misleading or wrong decision by the judges. The judge could have used translator but he was arrogant because of his position

Judge was right. This country is multilingist , if some advocate files case in Tamil language to a Bengali origin Judge in Tamilnadu, judge has no ability to understand that. Judiciary should have accept English as common language. A advocate have to qualify LLB, and medium to Study LLB degree is in English all over India.

The advocate is foolishly arguing before the judge. He needs to understand that the high court judges are appointed by the President and the high court & union judiciary have been given a common language for official purpose that is English. If a north indian judge goes to kerala, TN, Karnataka, Andhra, etc. And if the advocate presents his argument in native language before the north indian judge, how will he be able to understand what he is saying. For fast official working purposes English has been issued as a common language for judiciary and that's the only language court has to work on that linguistic line. The judge is completely right here in accordance with the constitution.

@@Karanbansal007 Yes what you are saying was read out from para 139 of the rule book, but it nowhere says that the lawyer must provide the translated copy. A lawyer can but he does not have to. It is the duty of translation department to provide translation and a judge can anytime ask for the translation from them. It can be found in para 79 of the rule book derived from a division bench judgment made in light of judgment on which para 139 is codified.
If a lawyer can translate it then why will he submit his petition in Hindi in the first place? In patna high court lawyers have always submitted in Hindi and various non Hindi speaking judges have gotten the translation from translation department.
He was transferred to Patna High Court in 2021 iirc, so he obviously doesn’t know the rules and tradition of Patna high court and that is fine, it can happen to anyone. But what astounds me is his level of arrogance and rudeness towards others.

Looking at the comments, I feel there is a need to put things in the right perspective.
The Ld. Advocate has submitted the following:
1. A full bench of the Patna HC has held that Hindi/English as a language is elective and not exclusive for proceedings before Patna HC. However, where a party has produced the records in Hindi- A translated English version of the same needs to be supplied. (As per para 139).
2. A division bench, being aware of the full bench judgment has directed the translation department (in-house department in the HC) to supply the translated copies, instead of ordering the party/advocate itself to produce it.
3. The Ld. Advocate here has sought to rely upon the Division Bench order and seeks indulgence of the Hon'ble Court to pass a similar order and direct the translation department to supply the translated version of documents.
4. The Ld. Counsel has further contended that since the party as well as the counsel themselves are not adept in English Language, they cannot be directed to mandatorily provide the translated version. Especially given the fact that a translation department exists for this very purpose and an Order passed by the Division Bench of the Hon'ble Patna HC has also considered directing the translation department fit for the job, rather than the party/advocate.
On the other hand, the Hon'ble Court had on an earlier occasion directed the Ld. Counsel to supply translated copies (which, for that matter, is a routine order). On finding that the earlier order has not been complied with, the Hon'ble Court deemed it fit to dismiss the matter.
Personal opinion- In this case- I believe there has been a communication gap as neither the Ld. Counsel was able to entirely convey what was intended to be conveyed, nor was the Hon'ble Court able to fully appreciate the submissions. Clearly, owing to the level of discomfort with the concerned languages.
P.S.- Firstly, these videos are for the purpose of learning and getting an insight as to how our Courts function. Such submissions and orders cannot and should not be judged as right or wrong. While the Counsel is 100% entitled to make his submissions (without any fear or judgment by anyone), the Hon'ble Court is empowered to proceed as it deems fit in light of the submissions made and records presented.

*11. AC बंगलो में रहते हो, शानदार गाड़ी से चलते हो, घर पर खाना भी नौकर पकाता है, न्यायादीश की मेज पर पानी भी कर्मचारी पिलाता है, तो जी तोड़ मेहनत क्यों नहीं करते हो ??*
*12. आप सबको केंद्रीय मंत्री मण्डल के मंत्री की सुविधायें मिलती हैँ!*
*निवृती आयु बढ़ाने की कोई आवश्यकता नहीं है! जो सर्वोच्च न्यायलय, एक वर्ष में सिर्फ 168 दिन काम करता हो, उसके कार्यदिवस बढ़ा कर न्यूनतम 300 दिन कर देना चाहिये!*
*जब प्रधान मंत्री 365 दिन काम कर सकते हैं, तो न्यायमुर्तियों को 300 दिन काम करने मे कोई कठिनाई नहीं होनी चाहिये!*
*गरीब देशभक्त जनता अब और सहन नहीं कर सकती! न्यायतंत्र सड़ गल चुका है! इसमें सुधार लाने की अविलम्ब व महती आवश्यकता है!*

The judge could simply request for the transfer of this particular case to another seat who could understand the Hindi language instead of cancelling the petition directly. If honourable Justices aren’t able to understand the language of almost 80 crore of his fellow countrymen, then he should separate himself from this case or at least look for the possibilities. This thing seems little ironic that after 75 years of independence, till this date, Indians don’t have a common consensus on one single indigenous language of communication throughout the country. And this country dreams about topping the world. Will never happen.
I agree that the judge should have been more nicer. But at the same time I would like to remind you and help you out of the Hindi speaking myth, less than 30 % people of India have Hindi as mother tongue and less than 47% are native speakers. Hindi is not national language. It's the lawyers job to file the translated copy to the bench. He's arrogant to tell the judge to get the judge to get the translation and when the Advocate is not able to satisfy the judge he brings up Hindi out of context. He's lucky he is suffering contempt proceedings. Also people don't mistake in to thinking that the judge is objecting to filing in Hindi but problem is with not filing translation. Hindi being local language in Bihar Filing in Hindi there is correct but when judges from other States come it's for the Advocate to file English translation for the convenience of the bench. I will try to get the judgements being referred to in this video. That Advocate's tone while telling the judge to obtain a translation which itself is appalling and the tone in general is certainly not right.
People should understand that judges of high court are transferred to different states. What would a judge from MP, who's a sitting judge in the kerala high court do? Speak in english or listen to the hearing in Malayalam.

Because southern parts of India has different languages so during 1965 they were fighting to get permit to proceed in regional language, But this was denied by the chief justice council.
