  • How can you best prepare for your telephone Social Security disability hearing?
    Since the start of the pandemic, SSA has closed all of its hearing offices and canceled all live hearings. As of the recording of this video, all disability hearings are being held by phone or by online video.
    I have had good results with phone hearings because your medical record is by far the most important factor regarding whether you win or lose.
    But your testimony is also very important because it allows the judge to assess your credibility and believability and you can really help your chances of winning if you testify effectively.

    Covid messed up a lot of things. I have not been to the dentist in the last 2 years just because the office was closed. Now it is likely to be open but in those 2 miserable years there was no one in there and I doubt they would have answered the phone either. You can imagine the misery a toothache would have been then trying to find a dentist who could help make it go away. I have had toothaches before and they are horrible with all the inflammation. It can make someone grouchy!!

    One thing you can do if possible is connect your phone to WiFi and enable WiFi calling. Without that I would lose someone just walking into another room in this house. It is in a valley and the bring exterior probably messes with the cell signal too. That may be especially true if the bricks contain any iron based pigments to give them their color.

    Are you taking on new clients to represent then for disability overpayment?

      I have done a little of this but since there is usually no "back pay" I can't take these under a no fee unless you win contract and most people don't have the money to pay me (or any attorney) up front.

    What if your a Veteran and the VA has classified you disabled veteran? Are you not disabled? It’s the same process. Other doctors look at your files and determine whether your disabled or not. Why can’t you classify yourself as disabled if VA have? That’s the other issue. VA classified you disabled but the SSDI won’t. That is shady. Logically they should but it’s a political funds issue. They have monthly quotas on how many they will approve and deny. That’s the truth. You may actually be legally disabled but SSDI may not approve you just cause. It’s terribly rigged.
