  • If you’re flying with cash, police can take it without ever having to prove you did something wrong. Channel 2 consumer investigator Justin Gray found out that it’s happening regularly at Hartsfield-Jackson International Airport and that it can be a long and expensive process to get that money back, even if you’re never charged with a crime.

    What people don't know is that this doesn't happen only in airports. You can be stopped on the highway and your money can be seized without the police having proof you had done anything wrong. All they need is suspicion or any excuse they can come up with. One man had $100,000 in cash on his way to buy a farm. His money was confiscated, and he couldn't get it back.

      Yep.........the same thing happened to me in Colorado the stole 33k from me while I showed everything needed to prove it was legally earned and of course I was never charged for that. ACAB And don't trust the government

      I came to say exactly this. This has been an ongoing problem. Everyone turns a blind eye because the people that are supposed to fix these problems, are the ones benefiting from the cash seized. Any cash they seize they get to keep. Highway or flying. I don't condone violence, but, I wanna see someone get pissed as I am about this. Everyone should be. These crooks need to be brought to justice. This should've been making national headlines two years ago. It is all across the US. We need to come together and call for change for this specifically. Cops are stealing our money!     I refused to hand over 9k and they got really pissed off when I told them is either you arrest me or let me go. If you hand over the money you literally giving them the higher hand; just refuse to give the money and ask to be arrested and if they arrest you the money becomes locked with the charges given to you and once you are acquitted of the charges, they are forced to give the money at the time of the release. Its basic guys if you are clean and you know you are clean just force them to arrest you. The moment you went after the plane is the moment you screwed yourself.

      Cash is worth less and less, and so for any use we need more. I routinely take $500 out of my checking account each month in cash for people who I hire for help (I'm 71, disabled). I wonder, is $500 enough for them to say it must be drug or crime related and seize it?

    Never talk to law enforcement. You are under zero obligation to talk to them and answer questions. Also, they will make you sign a form stating you are giving them consent to search your bags at the airport too. That’s why they took the money since it came from an authorized search. Tell them no to the search. I’d rather miss my flight than lose $8-$39K!

    Even if you sue and win, it seems the court won't award you your attorney's fees, which it really should. It should award the victims punitive damages too for all the time, energy, and aggravation they have to go thru to get their money back.

      @@ianbattles7290 One time I sued a business owner for refusing to pay me what he owed me. The court ruled in my favor, so in that sense I won my case, but the owner still refused to pay me. It wound up costing me money for court expenses, and the lien I put on his business, all to no avail. So I won, but I lost.

    NEVER agree to a search. Always say "I do NOT give you permission to search my belongings." If they say they will just go get a warrant and you'll miss your flight, repeat "I do NOT give you permission to search my belongings." You are under no obligations to speak with them. Ask "Am I being detained?". They cannot detain you without probable cause.

    This needs to be exposed at all levels. Journalists should show up at airport and expose the people seizing money without probable cause. Maybe they should go as far as surrendering money under cover and report on legal process to get it back. Unfortunately the recipe to get targeted is pretty simple to figure out.

    This is unethical at best, criminal at worst. They clearly wait until it's time to board the plane, then spring into action to seize your money.
    Note: Once you pass TSA search, you do NOT have to consent to another search by the DEA agents. They ask you for consent when boarding starts so you will just agree to not miss the flight. This was all described in another vid made by Atlantic Journal.
    TSA is likely notifying DEA when you pass through the security check.
    They should be forced to produce a warrant before search and seizure and that poor guy losing 90% of his money in legal fees just to get his money back is criminal.

    About 25+ years ago, I was boarding a flight from Houston to Costa Rica. In the jet bridge from the terminal gate to the airplane, there were several uniformed officers (custom?) who were asking passengers if they were carrying cash. I didn't answer or acknowledge their question, but a young Costa Rican woman made the mistake of admitting that she was carrying a LARGE sum of US cash. I never saw her board the plane. I felt bad for her because she probably legally earned that money and was returning to Costa Rica to financially support her family. I knew she was going to lose all her money to the US government for simply being honest. After all these years, that still gets me MAD.

I didn't mean to insinuate that it's the cops fault, however, there are definitely corrupt cops out there (Coffee City, TX, Marion, KS, Methuen, MA, Antioch, CA, Jackson County, FL...). In most cases it's still the department management that's at fault and in some cases this is a trickle down effect from local government and right on up the ladder to the highest offices in the country. Corruption exists on all levels of our governmental bureaucracies. I know a lot of cops. Some are great, some suck. The point is that governments in this country are corrupt and there's not a f***ing thing that any of us can do about it.

    Civil Asset Forfeiture should be required to be directly tied to a crime before it is legally allowed. It has become disgustingly obvious that Ethics, Integrity, Scruples, Honor, and Honesty are no longer Character Traits of our branches of Law Enforcement as they take money without tying it to a crime. The Legislature should take action to fix this immediately. And while they are at it, they should remove Qualified Immunity and Judicial Immunity, too, as they have been abused way too often!

Like me I need to buy a vehicle and I'm looking from me in texas to California because that span is the best place to buy a used vehicle. This gave me some great ideas on how to proceed from here.     This is literally interstate robbery. John Locke made the case that seizing your property, your livelihood, is as good as an attack on your person, on your life. I would argue that there is a case, as well, for self-defense, no matter that they are carrying a badge.
    *Furthermore: this point is academic. I am not advocating for violence. But if there is grounds for self-defense, then this practice is putting the lives of LEOs at risk.

    Jerry Johnson's case was key to the State of Arizona passing House Bill 2810 against civil asset seizure since his money was actually taken at Sky Harbor Airport in Phoenix. His case was quoted in passing the legislation that Gov. Ducey signed and made into law in 2021 and under ARS 13- 4305 , section E " The presence or possession of United States currency, debit cards or credit cards, without other indicia of a crime that subjects property to forfeiture, is insufficient probable cause for seizure of United States currency, debit cards or credit cards."

      Problem there is that it isn't Arizona doing the seizing. Feds could care less. On roadside stops where cash is found, the local PD calls in a DEA agent who shows up at the scene and does the seizure. Then,nthe DEA gives the locals a "finders fee", generally 85% of the amount seized.

      @@bradbrown6034The law was modeled after others that have passed after being challenged on those grounds the courts ruled the state can stop federal agencies from seizing anything because it was DEA that took Mr Johnson's money. When he went through TSA to board his flight the TSA saw the money and called the DEA and the DEA was waiting for him in Phoenix. Part of what helped pass the legislation is that the TSA acted as agents for the DEA and that was that was taken into consideration in writing the bill. Local PD cannot take anything for anybody from anybody because they are Arizona certified officers and aren't going to risk that certification.

    I was homeless and the cops "lost" all my personal possessions. Taking from the homeless there is no bar too low for them.
    Even the shirt on my back was taken literally.
    They did return my phone though, and I had shorts that's it.

    About 2k "lost"
    It took months at a minimum wage job to replace everything. I filed a complaint and they said "filing a false report is a misdemeanor".

    The state department through Bank of America intercepted my "zelle" transaction last year, which was a reimbursement for a trip we took to Cuba last year. My live-in boyfriend and I traveled to Cuba last year, and split all the expenses., like we always do, my note on the transaction was decribing what the funds were for, just for my benefit, they saw the word "to pay for 2 Airbnbs in Cuba. Airbnb is an American company. I used my American credit card to pay for the accommodations right here in America. Other descriptions were on the note, but they completely ignored the other descriptions. Descriptions like payment for light bill, and the address. They zeroed in and the name Cuba, confiscated my money and NEVER gave it back to me. I tried everything to get my money back, but failed. Americans give up their rights, and expect you to do the same, they seem to think the overreaching of the government is ok, because they are protecting us from "terrorism", but the only terrorist I am afraid of is, the United States government.

    This happened to me in California on a traffic stop they searched my car without a warrant took my 17k I own a locksmith company. But until I hired a private investigator on the two officer's and their sergeant. I took them to court with the evidence I had against them they quickly gave it back in court. Lol

    This just happened to my nephew. He drove to Vegas with cash, didn’t even fly, with cash he got from the life insurance policy of his mom’s passing. A maid cleaning the room called the cops about all the cash and the cops took it, until they can prove where it came from. And they took his car too. He had to ride the bus home. His mother had Hepatitis C and had been before he was born. She suffered for a while and finally lost her battle.

If the cash is guilty how are they gonna punish it? It's not about trying the money... that's a poor excuse! Because they've already got your money spent as soon as they take it. They've got plans with your money and there was never any trial of any kind either for you, or your money. But there should be for them!!

      @@dennisc6716 Well, as a matter of fact, the only way people could even try to get their money back was to sue for it but now, they can have a Jury trial to try whether or not the Civil Asset Forfeiture was a valid one. Meaning that law enforcement will have to prove their case to keep the assets. Can you imagine what the verdict will be?

      @@melparrishjr Can it really be called a trial if you have to go there to prove your innocence? It's a civil matter at that point, so the state has no burden of a 'guilt beyond a reasonable doubt' standard that it would bear in a criminal case. Which also means they can even appeal if they lose.

      @@dennisc6716 It's not about you proving anything. It's about Law Enforcement actually justifying their actions against you. They must justify it to a Jury and not just a Judge as it used to be. It was easier to manipulate a single Judge than it is to manipulate an entire Jury. But that's the law not my opinion about it. Another RUclips Lawyer did a piece about it a couple days ago. But it would be awfully rude for me to drop names and links in the comments section here. Still, people have a legitimate chance to get their assets returned to them. And in the future law Enforcement won't be able to take just anyone's stuff just because they want to.

    I've said this before and I'll say it again. Never, ever, ever, EVER travel ANYWHERE with large sums of money! All of this theft falls under the heading of "civil asset forfeiture". Basically, they say you *could* be a drug dealer or maybe your money *may have" been obtained via the drug trade and it's up to you to prove your'e innocent. Guilty until proven innocent. And if you're black (like the two men in this story), you know damn well you're going to be a huge target.
    Now sometimes this is hard if you're traveling overseas and want to have local currency on you. The exchange rate is usually better when you get money from your local bank, as opposed to getting the money in the country you're going to. So I'd limit things to $1,000 if you're traveling overseas. Or even less, maybe $300. Enough so you can get through the airports, get on a taxi and get yourself to your hotel. From there, find local places, where the exchange rate will be better.
    But if you're traveling in the US, do NOT travel with $5k, $10k or even more in cash, especially if you're a minority.

    It's ridiculous. However there's a lot more going on at Atlanta airport. I've witnessed abuse of elderly, international travellers by the airport staff. It's unbelievable.

    It's literally to the point now where someone can fly with $1000 in cash (which ain't that much these days) to Vegas to gamble and they will run you through the security wringer and seize it. Like no one has ever brought $1000 to Vegas before!
