I don't understand how you must sign a contract where you agree on Adobe using your data for machine learning (AI) and at the same time you can manually disable AI learning through the software, de flagging some boxes. Is pretty clear that something is fishy here, basically contractual terms and what you did in the tutorial are in conflict, it's pretty clear that one will override the other, which one is it ? I think the contract has much more legal value and all the boxes regarding AI will magically disappear in the next upgrade.

Just so you know, Adobe will STILL collect "analytical" data from the apps as it's part of their EULA, so I doubt turning these off is going to do much. It will probably prevent them from uploading your data behind the scenes (ie. work you might be doing), but that's about it. They will continue to collect data (generally statistical data). But this isn't specific to ADobe, as this "analytical" data collection is done by almost every software company. But this will at least reduce what Adobe can do with your data. And by the way in most EULAs the phrase "By using the product or service, you agree to..." is used and means that if you use the product, you automatically agree to whatever terms, and the only way to DISAGREE is to not use the product at all.

    • @leimertanimationstudio
      @leimertanimationstudio 3 месяца назад

I asked Chatgpt about what you said this is it's response:
Yes, the statement you provided is generally accurate. Here are the key points broken down:
      Analytical Data Collection by Adobe:
Adobe, like many other software companies, collects analytical data as part of their End User License Agreement (EULA). This data typically includes usage statistics, performance metrics, and other non-personal information intended to improve their products and services.
Even if you turn off certain settings in Adobe apps, it may not completely stop the collection of all types of data. It might prevent the upload of specific types of data, like the work you are doing, but general analytical data might still be collected.
      Industry-Wide Practice:
The practice of collecting analytical data is common across the software industry. Most software companies include similar clauses in their EULAs to gather usage data that helps in enhancing their products and services.
Impact of Turning Off Data Collection:
Disabling data collection features in the app settings can reduce the amount of data Adobe collects, but it is unlikely to eliminate it entirely. This is because some level of data collection is typically embedded in the core functioning of the software and is often covered under the terms agreed upon in the EULA.
      EULA Terms:
EULAs often contain phrases like "By using the product or service, you agree to...," which means that by using the software, you are consenting to its terms and conditions. The only way to disagree with these terms is to not use the software at all.
In summary, while you can reduce the amount of data collected by tweaking settings, some data collection will likely continue due to the nature of the EULA and the standard practices in the software industry.

I’ve always had the second option unchecked. I will have to double check now to see if it is still off or was reset. Of course I haven’t updated to the latest Photoshop because of the whole Generative Fill/AI BS and not getting answers since I’ve been asking before it’s launch of sourcing. Appreciate the info. Hopefully it works. It should be an opt-in system or at least give us an opt-out.
Update: after checking the first option was rechecked, so I’m guessing that’s something we’ll need to check often. Also, their notations on selections say that Adobe Stock content will still be used for machine learning as well any content that uses their AI. I don’t use the AI and won’t, so hopefully I’ll be fine.

I think the first thing to do, until the issue is fully clarified by ADOBE, is to inform collaborators and clients that when working with personal or sensitive content (of whatever nature they may be) ADOBE products will not be used, warning that the production process could be slower but with guarantees of privacy that otherwise could not be guaranteed.

For me it was a painless transition. I suspect some professionals are locked in to Adobe products for various reasons, but if not, then I recommend dropping them as well. The sad fact is that if folks stick with Adobe then Adobe calls the shots. And much like Apple, Google and YT, they don't care about you except as a resource.

To not have Adobe stealing art from people would be to jump platforms entirely. And not just deleting apps and accounts. AI on Android and Microsoft are leaking addresses and personal information.
Your not prone to being hacked on Linux or BSD or even Apple products as often as Android and Windows because encryptions are completely different.
Windows and Microsoft need a software overhaul, but it means have other programmers from different platforms to help with Google Gemini and Windows Copilot+PC.

Lightroom doesn't (yet) appear to have this specific Photoshop preference - in Lightroom you can go to Help/Manage My Account ... to set the Adobe CC 'Data and privacy settings' preferences as explained in this video.

Is it just for Windows users? I cannot see these options either under Data & Privacy settings on my Adobe account or in Photoshop preferences. There are no such options on my MacBook Pro (Sonoma 14.4). Data & Privacy settings say "There are no 3rd party apps linked to your account." Then I opened preferences in Photoshop and typed "AI" in the search bar, and then I was able to see these options. And it was not checked.

Could there not be a case that we should have been paid for this, I mean they have been making huge profits and all without it users knowing. Surely there could be a case too, for all future profits, born from their unwitting participation. Sounds like a class action to me.

I predict the day of reckoning is coming for AI. I would very much like a copyright lawyer to see this post and give his opinion. I’m not a lawyer. This is just tidbits I’ve picked up over the years.
    1) Part of copyright is reproduction through mechanical means is not allowed. The output of AI is “mechanical means”.
    2) Everything is copyright *except* things specifically put into the public domain. Thus, 99% of everything on the internet is copyright by someone somewhere.
    3) AI is trained by content found on the internet.
My conclusion is that everything AI produces is a mechanical manifestation from its training. E.g. there is no human creative element to it. Everything from its training is from the internet. 99% of the internet is copyright. Thus, all of the output from AI is copyright by multitudes of people and all those people would have to give explicit permission to use its content - which isn’t going to happen.

@@StudioBuilder But you OWN the Affinity software. The problem I've had with Adobe is ... when you stop paying, the software stops working. I.e., you can no longer (natively) edit your own files! I was with Adobe for MANY years, almost from the very beginning, but the subscription model, to me, is abusive, at best. When that became the only option, I left. Yes, Canva is an unknown-who knows how it will turn out. BUT they seem to align much more with my values than Adobe, so far. I'm cautiously optimistic.
