  • He deals with cerebral palsy, but when he had a flat tire, he needed help changing it, and while help was on the way, his apartment complex had his car towed. Is that legal? It’s why he turned to Help Me Howard with Patrick Fraser.

    The best part of this story is the camera man and reporter stepped up and changed the tire. (Which by the way, should have been done by the tow company GRATIS for the illegal tow.

      no not a responssbilty of the tow company, but yes it would have been good if they had.
      but did they have s key? most likely they have the ability to pick the locks. as it is easy to do.

      If the property owner called for the removal, then the tow wasn't illegal despite your personal feelings about the matter.

      @@ManMountainMetals Yes. This is all on the property owner/management. But, if the towing company knew the circumstances after the fact, changing the tire would have been a good show of faith before or after returning the car. It would have been a five minute job for those guys.

The laws differ from state to state but most states require the property owner to post a removal notice especially if it is a apartment complex. The tow truck driver is responsible to make sure that all ordnances are followed prior to towing.

      I’m not sure the ADA covers this sort of thing. It’s really more of a lease dispute, where his disability would be taken into account. Especially if he was claiming damages etc.

      I agree, sue, but for towing without adequate notice. If you get a puncture on the way home and it goes flat overnight, this could result in a tow before you are even aware that there's an issue. I doubt very much if there's any ADA provision that applies to this situation.

    Glad the news people helped out. Noone has the right to tow away a car. Even if it is broke down as cars do, what does the management want you to do? buy a new one and they become rich off the old one? Ridiculous.
    Its theft of property.

    In the UK it is illegal to tow a car with a disabled badge showing, or clamp it. Even if it is parked illegally they can put a ticket on the car ,but they are not allowed to move it or clamp it. If someone blocks in a disabled car the driver could be charged with false imprisonment

    ADA laws would given him a lawsuit against the complex. Most complex would put a tag on the window with the date on it before towing it. Giving a tenant aware of thier car will be soon.

    Not supposed to just tow the car. They're supposed to put an orange sticker on it and give the owner a reasonable amount of time to fix the problem. If they don't fix it within that a lot of amount of time, THEN you call the tow truck.
    Especially when it's parked in his space... You're supposed to get at least 2 days...

      It took a total 3 years plus a Dr note being given on record for one full year before I was placed into a ground floor apt where I live. Also by that time I had already fallen down the stairs busting my tailbone and further exacerbating my hip and lumbar issues. Many apartment complexes are owned by companies/corporations many of which don’t really care about the tenants beyond collecting money…heck even IF you get a good manager the people they often answer to will veto an idea without any real regard as to why the request is made to start with.

    They quickly towed it away without giving any warning of a sticker on the window? Sounds like predatory behavior on the part of the owner and tow company. That’s a residential property not a business complex with a random illegally parked vehicle & I’m sure if the complex checked their resident’s records, they’d have figured out the owner of the vehicle. The fact that they claimed it had been sitting for 3 days when there are witnesses and owner who confirmed it was a mere 5 hrs since he drove it from work means they are scammers. Obviously they’re used to doing this on unsuspecting people. 😢

      If the car has an alarm they can drain batteries over time, if a car isnt being driven often, its best to disconnect the battery. The alternator and battery are likely still good.

    what some may not know is these chicken shix tow companies pay business owners and apt complex's a piece of the action every time a car is towed. here in san antonio tx someone can go rent an empty lot just on the outskirts of town, get a license from the county or city, go to a bank with the papers showing the license and the property and get a big loan to buy tow trucks they never had just to start getting in on the easy money. just about every hotel or motel or restaurant here has some little tow company signs out. the problem is they tow some for no reason, knowing you are either out of towners or too busy to take time to sue them in small claims court so you just pay.

    they lied about 3 day's. shitty tow company, didnt even offer to AT LEAST fix the tire or give him a jump. put that company out on blast. they got paid for nothing.

    This is how “low income/state owned” housing is. My mother was also disabled living in a similar complex. I was visiting her one weekend and my plates expired. I knew they were because i had my stuff to get a new sticker the next morning after arriving and getting some rest due to driving several hours. My plates expired at 12:00 that night, by 12:30 my truck was gone. I only knew that because i went out to grab a smoke when i saw it gone. I had to pay those jackals $500 ON TOP of the sticker cost. Tow companies are the LEAST ethical companies next to title loan companies out there.

    According to the ADA, it is unlawful to tow a car from a handicap parking space that has a valid handicap placard. End of story. The towing company should have refused the tow as they are completely aware of the ADA law. The towing company is more to blame than the landlord.

    Come on you could have a flat tire for 2 weeks. Or perhaps you need to wait till your next pay check, you absolutely should be allowed to keep a vehical in your spot or a spot period if you pay to rent a appartment. Almost everyone would probably agree that 30 days is a resasonable time period. Think of it as your own privet drive way, Everyone has to be in power these days, it makes them feel important in this big world.

    I paid a lawyer to represent me on a civil matter up to the trial, to keep me going. After I gave him the money and I gave him my evidence he worked against me. When I told him that he said he's not willing to defend me and he dragged it for a couple of months. Then he asked me and my wife to meet him in his office and it took another month. When we saw him in his office he said that he no longer wanted to defend me and I have to agree or we have to go before a judge. While the case was being dragged out there was correspondence between the two sides with which he did not want to defend our position so both sides ignored it. He broke our contract and refused to give me back the money that I paid him. He also changed my suit from personal to business so I can't represent myself. He did it out of revenge and I lost at least twenty thousand dollars plus the three thousand dollars I paid to him.
    Please help me.

      As a wheelchair bound person with seizure disorder, I can tell you that under stress it becomes difficult to communicate immediately after a seizure. It's called a postictal response. Cerebral Palsy, while not a typical seizure disorder is also effected by stress. Five hours to collect oneself is not unreasonable seeing that the car was in his parking spot.

      Anyone who gets home at night and waits until the next morning to call AAA.

      He was home. Who would call right away after a day at work?
      The apartment had no right to tow anyone's vehicle. It is personal property, and is tagged.
      An apartment tried that w me 1x and I sat on the car and police even showed up. They didn't tow the owners car. It was unlawful.
