I've used direct access Barristers on 3 occasions. I really like the system, great for getting an opinion from someone who is a specialist in their field. As a law graduate myself, I can do the administrative stuff, that I would normally be paying a Solicitor for. I'm looking at the possibility of making a claim soon against a supplier, and I'll no doubt go direct access again to get an opinion on the prospects. But I will meticulously prepare all the documentation in an orderly way to assist.
A barrister argues whichever way the wind blows for the most cash. Even if they give an opinion on the prospects that's all it is! Anybody can get a book on the relevant area of law which will highlight the important case precedents and statues to rely on. Combine that with a trial to PracticalLaw/Westlaw and you'll get the forms, notices, and templates to start the case. What happens if you rely on the barristers opinion and then lose the case? Was the barrister wrong? This is why I never trust any lawyers or barristers. Money grabbing ad infintum without any risk or consequence. If their payment was success dependent then you could trust it more, but they'll never agree to that would they?
@@TheRealD4 when I hired the guy to do my driveway I looked at the work he'd done previously and got good recommendations when I asked about him. With something that required a barrister would you not do the same? Look at their track record. Find out if they are any good. I guarantee a competent barrister is going to be better than you
What a useful video. To be honest I wasn't aware that one could go directly to a barrister. Sounds much better to able to talk directly to the organ grinder rather than through the monkey: and to not have to pay for the monkey too.

From a solicitor's point of view it's not really just about adding fees, because solicitors and barristers have two different roles. Sure, there is some overlap and time spent when the two lawyers communicate with each other which would otherwise be avoided, but by and large on the traditional route solicitors prepare cases and barristers act as advocates. So if a barrister was also preparing your case, there would still be the same amount of work to do, you'd just be paying one lawyer to do it rather than paying two lawyers to do slightly more than half each. Even if you're talking about just getting legal advice, the solicitors spend time with you, getting all the relevant facts, focussing on the parts of the matter that need expert advice, and presenting the case in a way that the barristers are used to, which means that the barrister doesn't have to spend time going through everything with you and preparing files and notes. They concentrate on reading the facts and preparing the advice. I do think there are advantages of using a single lawyer all the way through a matter )and for that now solicitors can get the same rights of audience that barristers have), especially for simple litigation matters, but bear in mind that "being pushed from pillar to post" usually comes with a cost saving, as junior lawyers and assistants are much cheaper than partners. If your case is large or complicated then you need a team of people working on it - something barristers often can't provide as they are self-employed and don't have partners or assistants to help. All of which does beg the question of whether it's worth paying a barrister £750 an hour for doing a job that another lawyer charges £450 an hour for (from another poster's example). Having said that I have never used a barrister through the direct access route so some of those concerns might easily be remedied, such as by charging different rates for different value work.

Then again they are definitely worth the money - when my sister's drug-dealing ex beat her to a pulp at the hotel on my wedding night...then beat up my father-in-law who knocked on the door to see what was happening... then verbally abused and threatened hotel staff who asked him to leave... then drunkenly trashed a hotel room which was waitnessed by three people, he, with his drug dealing profits, paid for a barrister who went on to successfully argue that he'd done nothing wrong and it was all conjecture. He walked past me leaving court with a smirk on his face after his barrister spent the trial attacking my sister's character and saying there was no evidence of violence. Never mind that police took photos at the time of her beaten to a pulp, or the broken ribs on my father-in-law that I suppose all just 'magically appeared'! So barristers are definitely worth the money, I'd say.

Showed how much attention he paid to the answer to the questions he had asked. He did not even know who the defendants were. BTW the £1500 for the solicitor and barrister ie £3000 is plus Vat
I was sectioned under mental health act against my will. They have never told me Why?....there was absolutely no proof to hold me. 5 solicitors said I need to appeal to the Hospital Trust who sectioned me??? I have all evidence I need and proof to represen myself....can I appoint a barrister???...can I get legal aid or no win no fee?? I am now ready to take on NHS....after a year of Hell. The General hospital sedated me without my consent on challenging them about it they decided to shut me up by breaking into my home and abducting me..... Please advise

Never mentions the ACTUAL costs. When I was involved with a barrister - via my insurance company - a few years ago, the costs were simply staggering. Way beyond what normal people can afford.
I've used solicitors, barristers through solicitors and also direct access barristers - all lawyers are expensive, but barristers can be better value as they tend to have lower overheads. But you tend to pay very much for experience with Barristers, and I find the charges very transparent. Whereas with solicitors I find charges to be much more complicated and the invoices extremely onerous.
What can I do to get a solicitor disbarred for FALSIFYING my Mother's will back in July 2022... I have 100% proof that Mark Shannon from Bernard Campbell Solicitors, 17 High Street, CARRICKFERGUS, Northern Ireland. I am currently in receipt of benefits and did have a solicitor who led me down a false road, right up until 3wks before the 6mth cut off date for me to contest. She, Claire Homes Reid Black Solicitors Limited, 59 Main Street, Ballyclare said she had found a barrister to take on my case for a 'security payment'? of £1000. I borrowed £1000 and she IMMEDIATELY dropped my case.?
i tried to sack my barrister because he wanted to lie, i was told i couldn't he stitched me up and i ended up doing 3 years for something that should had been 2 suspended.

A barrister , as they are in England will be somewhat similar to Advocates as we have here in Scotland.
