Recess appointments without confirmation was a thing when horse and buggy and telegrams weren't fast enough to allow government to operate and yet now we have cars and planes so the use of an outdated law to avoid accountability and the normal transitional rules and laws is beyond ridiculous.
Recess appointments were how the executive checked the Senate when the Senate used procedural moves to prevent an up or down vote on the Presidents nominees. If the Senate didn't like it all they had to do was have a vote. The Senate started doing these ridiculous "Pro Forma" sessions in 2007 to block Bush's appointees. They are a Constitutional abomination. Congress is in recess. Everyone knows they are in recess. One person banging a gavel ever 10 days doesn't make congress in session. Pro Forma sessions are very similar to the long since agreed Unconstitutional "silent filibuster" once employed by the House. Where members of the house would refuse to call present when the roll was taken. The minority argued that without a quorum, because members were not calling themselves present, no vote could be taken. Eventually this bullshit was shot down because they were present, everyone knew they were present, and refusing to call present didn't mean no quorum was present.
Even Obama did recess appointments. Trump could just leave the position vacant and appoint a "Czar" to make the orders. Trump can command everyone who serves beneath his cabinet picks.
