The Supreme Court has refused to allow an open court hearing this time around. What are the grounds petitioners believe for this case to be reopened? As far as cultural arguments is concerned, Same fear was created while 377 judgement which has been struck down. Now has the society been collapsed ? If not then legalisation of marriage equality won’t either.
1)Now the constitutional right, under the judicial review provision of the constitution S.C can intervene if any act of the parliament discriminates against the rights of citizens and
2) under the WRITS provisions S.C can issue command to the government authorities if it does not give the right that is due towards citizens under HABEAS MANDAMUS.
IF the court believes that marriage is not a fundamental rights it cannot issue WRITS. BUT High Courts can issue writs even if it is not F/R

You can get a mutal aggreement from a cout binding on each party. Let's not call it marriage laws. Make your own contracts.

You are trying to go to the line as if the religion is discriminatory, but you are actually fighting in the court fight on one ground either the constitution or the religious basis don't mix religion and the traditions and customs with other influences. Rather take what you want from the court and the parliament if it means making a provisional law then that's the route that you need to take
