Witness describes final moments of Alabama prisoner Kenneth Smith killed with nitrogen gas

  • AL.com reporter Ivana Hrynkiw was one of 5 media witnesses at Kenneth Eugene Smith’s execution tonight. In his final 32 minutes of life, Kenneth Eugene Smith, executed tonight by the state of Alabama using an untested method of nitrogen gas, thanked those who supported him in his final year on Death Row.
    And, as he breathed his final breaths, witnesses could see him writing and thrashing for several minutes, his face covered by the mask used to administer the gas.
    Smith, sentenced to death for the 1988 murder-for-hire of a pastor’s wife, said that he saw humanity “rise up” after he “suffered everything (he) did last year.”

      The victims husband was the one ordering the murder. This was a very warped case. On top of that he maintained he wasn't the one who killed the victim, but his accomplice, but the accomplice got a sweater deal by putting the blame on him. What is true or not was as far as I read never actually proven. That's also why the jury asked for life in prison, but thn the judge just overturned the jury and put him on death row instead. There's a lot of really warped shit in this case. When you then consider that any appeals were failed because SCOTUS is conservative and the state of Alabama is republican, this seems more and more like a politicized thing aswell.

      It's not honest of the system to give one man life and another death if they both were implicated. Kenneth Smith maintained he didn't kill the victim but the other guy, and the other way around. Goes to show how corrupt and dysfunctional the system is, and the judge overturning the decision of the jury is just ridiculous, but that practice got abolished, so if he had been convicted today he would have gotten life. - But the husband, a pastor even, that he took out life insurance on his wife because he was broke and needed money and hired someone to kill his wife, jesus christ, that is criminal if you want to talk criminality. But if you look objectively at it all, it was a bunch of people who acted insanely. And the victim was the one who paid for their mistakes. Sure, you can say Kenneth Smith had it coming, but it's only in Alabama that 35 years prison and a botched 2 hour execution isn't enough payment. This guy in essense was executed twice on top of his prison time. - USA is also out of touch with reality to have sentences that are so long lasting. In Europe if you get life, you get around 10-20 years tops, but in the US life is how long a person lives (afaik). And does it hinder criminality, - apparently not. I'd rather see a justice system that gets down to the core of why people commit the insane crimes they do and find out how to solve that problem. Sure, the world is rid of a killer, but there are a thousand others waiting in line and a thousand more going in the same direction that isn't stopped that isn't hindered and that will come to a similar end. Better to find out why people do what they do and reform their thinking so they come to see the light of a better way. You can say I'm being naive, and perhaps I am, but I have the hope that people can become better than they were, can realize the mistakes they made, and can change as a person. Who knows if the Kenneth Smith of yesterday was the same as the one 35 years prior? He had a spiritual advisor, he allegedly had gone sober, had taken an education, so all the signs were there that this guy realized the mistakes he did. Perhaps he was not outspoken about it, but then again, if he realized that what he did wa inexcusable, he maybe also realized there was no need to apologize, because what is that going to do, bring the victim back to life? I don't know, but I try to believe in the best in people, and I do not believe you reform anyone or make a better world by capital punishment. Sure you can say that the victims familiy has some closure now, - that is probably the best there is about the situation, I will acknowledge that, - but other than that, I think it's better to rehabilitate than just plain discard and kill. I don't know if you can see my point, or if I make any sense.@@ammocan2796

I knew nothing about this person or this case before this execution, but from the little research I did, he seems to have become a Christian while doing his time. Either way none of us know.       We don't have any right to judge. As someone who has been involved in the death sentence..... If someone is destined to lose their life it should be non-tortious. According to the God almighty...he is the final judge and jury.

    He wasnt awake when he was shaking and moving. He lost consicousness from the gas. Those were involentary movements. Way more humane than anything he ever did to his victims.

      @newytuser24 Well it sounds like she described Agonal Breathing. Which is when there's not enough O2 in the brain and the unconscious person's body tries to get air into the lungs and muscle spasms can occur. So the person is unconscious about to die but the human body tries to fight. It's common.

    Elizabeth Sennett was taken from the rear and "blind-sided her." A beating then ensued, in which the victim apparently struggled for her life. The evidence indicated that during the beating any item within reach was used as a weapon. The men apparently used every piece of a fireplace set, a walking cane, and a piece of galvanized pipe and, after beating her, stabbed her eight times with a survival knife

    Yes let's just keep stating how he writhed and shook as he died. Now let's just think about what his victim felt as she was being butchered by this man. I bet she screamed and writhed also to get away. I bet every time he plunged that knife into her body she felt unimaginable agony and fear. But we can't ask her now can we? He lived and breathed for years. She never got that chance. Now he knows how she felt.

      He lived and breathed in fear for 36 years in a tiny jail cell. He made a big mistake - but that was no excuse to put him down like an animal. His life had meaning regardless of what he did for no other reason than he was made in the image and likeness of God. Do you think on judgement day Jesus will forget you said this about one of His children? And when Jesus doesnt forgive you, will you be surprised when He says "now you know how Kenneth felt."

      What are you on about? Alabama claimed it was “the most painless and humane method of execution known to man." While the UN saw it as risky, experimental and could lead to a torturous death or non-fatal injury. Therefore they’re reporting on the effects to see if they can substantiate Albama’s claims.

      @@Doris1888 every statistic on the us prison system shows being locked up is a form of mental, emotional, and physical torture. He sat in a jail cell for 36 years. He was tortured by the state in November and struggled as the state shoved nitrogen down his throat with a group of people watching, calling it "justice" to justify this murder. This isnt a math equation, what was done to him was pure evil.

      The victim went through hell, no doubt about it, - but if you call yourself a christian, or if Alabama or the nation of America hopes to call itself christian in any sense, - Jesus words about forgiveness, should have some resonance with you. This man already went through hell, he was attempted to be executed for two hours already, which they botched, and on top of this sat for 35 years on death row. In most nations without capital punishment he would have paid already more than tripple what people get for murder, - so at least according to the standards of other civilized nations, he did pay. But most people who call for executions simply cannot get enough of it, - it's like in the old days with burnings in a square, lynchings and what not. - Capital punishment is simply not civilized, if anything it is cowardly!

    I’m pretty certain the woman he beat and stabbed 10 also had difficulty breathing and also convulsed as well. Did he care about her life then, NO he did not. So why should we care about his life or if he has some difficulties dying. His death was still less agonizing than his victims death.

    He knew it was happening and was holding his breath to prolong the inevitable, leading to the panic and writhing and heavy breathe once he can hold his breath no longer.
    We know nitrogen gas is dangerous to industrial workers because it is painless and there's no indication that anything is wrong. You just slip off into unconsciousness and die. But if you know you're breathing nitrogen and are dying, then of course there'd be some level of panic.

    The thrashing and heavy breathing are involuntary movements that happen AFTER he lost consciousness. It's called agonal breathing, it happens a lot when people die. The way they are reporting this though they are making it seem like he was writhing in agony.

    I see it as eye for an eye. How did his victim feel when she had 8 stab wounds to the chest and was left to die slowly? I don't have any sympathy for people that take other lives and expect to live out theirs like it never happened. Examples have to be made in order to deter others from committing heinous crimes like this.

The evidence indicated that during the beating any item within reach was used as a weapon. The men apparently used every piece of a fireplace set, a walking cane, and a piece of galvanized pipe and, after beating her, stabbed her eight times with a survival knife."

Don't you think he paid already a huge price for what he did? And how about the husband of the victim, who were the one who hired him and another guy? I would say the husband was the real menace, - because without his actions, the victim would have been alive.

    Yup. That sounds like hypoxemia to me. Chances are he was unconscious within a minute, more or less. Just because the brain is quick to shut down, the rest of the body takes a lot longer. When the Pressure of arterial Oxygen (PaO2) drops too low, the brain can't function. Lights out. BUT, breathing is important. So, the body has a back up system to stimulate breathing in low oxygen states called the Carotid Bodies. So, they're going to keep firing away for some time providing the stimulus to keep breathing. That's not the end. There's also Oxygen Content (O2con) measured in Vol%. That's oxygen stored in the cells themselves. The brain has a high metabolism so it burns through that very quickly. Not the rest of the body. I've seen patients in asystole (clinically deceased) for 30 minutes still having agonal respirations. We can expect to hear it described like this every time. That's the body's natural response to hypoxemia.

      I think one does not really know until it happens to you with different circumstances in life what you will do.Then it all depends how you chose to be- a good or not so good person. Thats when your true self and character comes out.
      He hired people to murder his wife: that speaks for itself what character he had. His pastor life looks like it was a facade/ mask.
      I think suicide is when one reaches a place of desperstion with no way out.
      I don't think anyone really understands if it is unpardonable or what happens to a soul.
      This is just my way of looking at it

    Not sure why nitrogen would cause shakes/convulsions, as our atmosphere is 78%. Was the gas not heated to room temperature? Really cold would probably not be comfortable. Years ago, there was a welder at a TI facility that suffocated in Xenon gas (I think, it was one of the noble gases) which settle into a pipe trench, because he wasn't aware he was being suffocated he didn't climb out.
    I always thought watchers might not like N for death penalty, because sometimes it causes euphoria before causing unconsciousness. That might upset the victim's family.

      The difference between our atmosphere and pure nitrogen gas is that oxygen isn't present in the latter. The nitrogen gas itself isn't the problem, that's inert (hence why it's called "inert gas asphyxiation"), the problem is the lack of oxygen.
      And yes, someone breathing xenon gas would experience the exact same thing, that's also an inert gas. You pass out within seconds and never regain consciousness, so unless someone gets you out of the situation quickly at that point you are for all intents and purposes dead already at that point, even though your body will continue to live on and make some involuntary movements for a little while.
      Also, note that inert gas asphyxiation is not suffocation. Suffocation happens due to the hypercapnic response, which is what happens when carbon dioxide builds up in the blood because you can't breathe out; this is an extremely uncomfortable sensation. In contrast, inert gas asphyxiation doesn't trigger the hypercapnic response at all, because you continue to breathe out, so there's none of that uncomfortable sensation at all, you just lose consciousness very quickly, and then die unless you somehow get to breathe oxygenated air again before brain death occurs.

      The cause of death listed on the death certificates of those executed is homicide, so yes, he was killed. Doing it legally doesn't make it not killing. He didn't die naturally and he didn't kill himself.

    All the people saying that this was not humane, I will remind you how the victim suffered. She had been stabbed and beaten with a fireplace implement. They used a fireplace poker to kill her horribly while she fought them. According to the sheriff that did the investigation, he said that she was still alive when he showed up. She had a pulse but then later died at the hospital. So, she lived for a while after being beaten and stabbed with a fireplace poker and suffering for a lot longer than her murderers did. It is obvious that she's suffered a lot more than they did while she was being murdered. Her murderers suffered very little compared to her death, in my opinion. Also, his victim died in 1988 at the age of 45, but her murderer lived to be 58. The murderer lived for 36 years after killing her. He lived for minutes after they applied the nitrogen only because he held this breath for that long. I guess they could have made it more humane by administrating a seditive before the execution. Thus, he might have been asleep and could not have held his breath. He could have then possibly died in his sleep. That would have been too easy for such a murderer in my opinion. Too bad for him. No one asked me for my opinion before doing this, or they might have actually given him a sedative and made it easier for him. I have been told I do think outside the box and see obvious things that people miss. How many more companies could have benefited by having me as a consultant...

    This guy claimed to have found religion and made sure to have a priest with him. But never, in the past 30+ years did he ever try to apologize to the victims family for what he did. He never said the words, wrote them a letter… *NOTHING!* He tried to stop this execution in many different ways but the saddest part is the victims family said they would’ve advocated for him not to be executed if he had only made some effort to apologize. Since he didn’t, they never attempted to intervene and try to stop him from being executed. It really makes you wonder… *WHY?* Why on earth wouldn’t he have sincerely apologized and then he would’ve had a much better chance of avoiding execution. He continually stated how scared he was and afraid of the execution but clearly, he wasn’t humane enough to be remorseful for what he did. Good riddance to him and the only thing in disappointed in, is that it took so long before hood sentence was carried out. *FINALLY* the victims family can have some closure and know that this man that took so much from them, he will never do that to anyone else again. ✌️

    I’m so glad the victims family finally got justice. I get that he was terrified to die, but he had no regard for the woman he killed. He had the audacity to say on a news report a month or so before he was killed “Man isn’t meant to kill other people”, when he literally murder that victim with no remorse. If anything, this was a mercy to him. I’m sure there are many vigilantes out there who would have put this man to death themselves had the state not done so

    So sad listening to the murdered victim's son talk. I feel bad for the family that has to lose their loves one, I also feel bad that they had to witness this killer die.
    I hope they aren't bothered nor remember that moment for a second. They don't deserve to be victimized by that killer anymore.

      I think part of your statements make absolutely zero sense no matter where one stands in the debate about death penalty.

      They didnt. They simiply didnt. Nobody is forced to witness an execution. This is a choice. If you dont want to attend, you dont attend. That simple. They WANTED to see that person die.
      They deserve sympathy for what they suffered through 35 years ago. But while it was a cruel fate to have a loved one taken away by a murderer, keeping hate in the heart for 35 years is ones own responsibility. I dont want to judge it, because fortunately i never walked through anything like that. But its with all adverse things that happen to you in life due to things outside your control (such as, a killer). You deserve sympathy for the bad fate you had, but still how you deal with it an how your react is your own choice.
      I dont think that keeping the desire for revenge in their heart for 35 years very likely did not do them any good. And when you make getting someone dead a central topic of your life for such a long time and that person is finally killed, life likely becomes hollow. Initially they were victimized by the murderer, and as said, they deserved all sympathy and compassion for that. But with how they dealt with this, they kind of victimized themselves on top.
      However, for this, society is to blame, too. In my opinion, there should be a strong state funded or federally funded support infrastructure for crime victims where they get all the help - particularly psychological help - they need for free to recover from the crime. I think this would be well invested tax dollars. Imagine that you spend 35 years of your life bothering with hate in your hard and the desire for death. As said, i dont want to judge them but i would assume it made the blow of loosing a loved one even worse.
