He actually was retconned into being a Pirate Lord in the third movie. So he was not actually a Pirate Lord when this movie was released. It also raises some logistic issues because apparently Barbossa was too and he was not even a Captain back then.

You may have the right to free speech, but if you are oppressed, it matters little. The law may say you CAN NOT steal, but nevertheless it CAN be done regardless. All it really boils down to is this: Can you physically assert yourself amidst others, or can you not?

For most ships, yes. The helm almost always controls only the rudder. However, some are able to control the backsail as well as the rudder
