The Lake Erie Bill of Rights is the first law of its kind in the United States. In February of 2019, the residents of Toledo, Ohio voted to give Lake Erie's entire ecosystem legal rights. That means any citizen of Toledo, if they have credible evidence that a corporation or government is harming the lake, can file a lawsuit on behalf of Lake Erie in court.
The Lake Erie Bill of Rights is part of a larger movement to give legal rights to mountains, rivers, forests, and other natural objects. The citizens of these communities -- from Pennsylvania, to Ecuador, to New Zealand -- argue that because their long-term survival is dependent on the health of their natural surroundings, anything that harms the lakes, rivers, or forests they depend on should be considered a legal harm.
It’s a totally new way of approaching the law, and it could change the very nature of our relationship with the natural world. This is how one community in Ohio started what they hope will be a nationwide movement.

I live on lake Erie. It was so polluted that they mentioned it in the Lorax(original film). Of all lakes that deserve protecting, this one, the shallowest, definitely needs it.
I live on the Saint Lucie river in Florida and we have the same problem here. Motherboard covered it last year, and said the damage every time they dump, lasts 50-years. People are selling homes in the area, land prices have dropped and only tourists go in the water.

I don't see how a right to do business is the same as the right to pollute and poison the water. Seems pretty clear cut, you can do business with your live stock but there are environmental regulations, specifically regarding output into the lake.

I can't ignore the possibilities this creates. Can natural bodies sue other natural bodies? I want that to happen.
Basically laws like this allow citizens to bring suits against harmful agents as guardians for the sake of the ecosystem itself. Prior, you would have had to have proven that you yourself had somehow suffered injury, which is why the Sierra club lost an environmental suit to Disney when they tried to destroy a mountainside to build another attraction.

Yeah it’s mostly small farmers which makes this a specially tricky situation because what’s happening to the lake is undeniably wrong and leaving half a million people with no safe drinking water is unacceptable. Yet at the Same time we don’t want to hurt small farmers and their families. Maybe if somehow we found a Way to make the cow poop not liquid like instead of mixing it with water they mixed it with something else to make it solid because she mentioned in the video that it’s because the cow poop is liquid that it Sipps into the ground and flows to the river and eventually the lake.
Give animals rights too. If the small farmer is not undercut by factory farms then they can afford to let their cattle graze naturally as they should.
@@cjreeve79If it is a group of dairy cows, which is most of the cows that are in the smaller areas, they don't need a football field of length since they usually move in groups and milked. I would say a normal amount for dairy cows and small animals such as goats and pigs is 10-15 animals per half of a large barn. Of course, this number could vary on how big the barn is and if they are not walking around in their own manure all the time.
@@brycenlantz924 what is your point? Cows should not be made to stand in their own feces. They should be outside grazing for most of the year. Part of our current climate crises is being caused by feeding cattle human food crops grown on chopped down rain forests. For environmental reasons all cows should graze. Small farms are able to deal with their manure and needn't be part of the problem.
As a student at the university of Toledo, this videos speaks to me. Every single summer we hear about the algae blooms, but yet nothing is ever done. I’m proud to see this. Because “you’ll do better in Toledo” means nothing if you don’t actually stand behind that statement.

Reminds me of the Flint water crisis....which is still going on to this day. They still have brown tap water, and the donations to help them have dwindled significantly. Now they were recently allowed to sue the federal gov. for taking too long to help them

Never thought I'd see a video on my home area. It's common knowledge here that the Maumee River is basically polluted as hell. I remember the bloom very clearly.
As an ohioan this is important to me, lake erie is our drinking water and where our beaches are, we need to protect it at all costs.

I live literally 1 minute away from lake Erie it's like in my back yard and as I grow up it looks more disgusting I refuse to even down in it now and most places restrict it it's not sandy it's very rocky most rocks are big Like 4x the size of a fist and are sharp enough to cut you the water is so pollutes if you had goggles then you can't see more then 5 centimeters ahead of you.

There's plenty of sand along lake erie ...large rocks arent an indication of a polluted lake anyways .. Are you sure your local landscapers didnt replace alot of the sand shores with rock? It would make no sense for rocks to cover a once said beach based on a polluted lake....

What if you don’t liquidate the manure?
It would destroy the crops in the longterm. Compost/manure needs "natural time" to be worked on. What they could do is dry it all up and create Bio ecofriendly bricks for all those organic chads. But considering the state of the manure coming from those caged animals is most probably toxic...? Or is it not? Maybe its all too expensive who knows.
A lot of the manure is liquid already. The liquid is absorbed in the ground better

Hey, that's my city. I voted for this. Something had to be done. As a fisherman and avid lake goer, the agriculture sector has single handedly been destroying the lake and river systems.
The answer to the last question is simple: you figure it out. You can still turn a profit and farm if you're not a POS about it. When that water supply is ruined, how do you feed the livestock? You going to import Dasani? GTFO. That lake is just as important to the farms.

Coming from a dairy farmer in northwest Ohio. If agriculture is the main cause, which in not denying it isn’t, then why do municipalities get about 80-85 percent of the funding when farming is the main problem?

I really appreciate the background information presented in the video on how this problem developed and the details about what these farms are like. As a city dweller I found this information illuminating and useful. We need to pay better attention to how our human activities are impacting our most important resources. What a great video! The algae is the lake's only way to detoxify itself from all the manure. The lake's working as it should, but the manure shouldn't be there in the first place.
The corporations can move, but the lake can't. We can get food elsewhere, and we don't even need to eat meat, but the people there can't live without the water. The lake is unquestionably a more important resource than the farms, and so its rights need to win out. That's just the most pragmatic outcome.
It’s not really detoxifying, it’s just the excess nutrients allow for the increased growth. This also leads to a lack of oxygen in the water suffocating all other life including decomposers, so dead matter ends up staying in the lake.
Unfortunately the swamp lands that are now farms usually do a good job of filtering out these pollutants but they’re destroyed now
Agreed although I think a practical solution should be worked out as these farms are peoples livelihoods too. Perhaps an alternative method of waste disposal can be created or an alternative to the current drainage system that was setup many years ago.

Well, it detoxifies in the sense that they absorb all the extra phosphates, and when they die, the algae settle to the lakebed, bringing the excess phosphates with them. Once the excess phosphates have been consumed by the algae, they cannot continue reproducing so quickly, and the algal bloom dies, allowing the water to re-oxygenate, and the system returns to normal. The lake's doing what it's always done to stay in equilibrium
Danielle Spargo true, unfortunately the excess phosphates are constantly being pumped into the lake so I don’t see a likely return to its original state without action

there's a similar problem in the baltic sea, where manure from farms create toxic algae in the ocean water, depriving the sea creatures of oxygen and killing them en masse. however, as the baltic sea is surrounded by a bunch of different countries, with wildly differing gdp's, agrarian practices, and stakes in the area, drafting policies to change this is extraordinarily difficult, especially since Russia is one of the bigger culprits.
Perhaps if the UN could somehow recognize the rights of the Baltic Sea in the same way then it could step in and try to enforce change wherever it was needed. Hell we could apply this to other places like the Amazon. It would be a major source of change.

The legislation just passed in an election in Toledo, so presumably a lawsuit will soon be filed (or maybe already has) on Lake Erie's behalf to somehow reduce or eliminate the runoff from farms going into Lake Erie. Unclear how that will be achieved but there is now a legal basis to bring a lawsuit of that sort.
The most likely solution would be a treatment plant of some description along the river that takes as much as much nutrient runoff as possible out. This would be expensive and inefficient but is basically the only option. You cant ban manure fertilizing because the farmers will just use other fertilizers and those will likely be worse. You cant change the drainage system because then the land will flood again. And you cant ban farming in the area due to the economic impact
LORDOceanus unless of course you force the farmers to go organic and stop abusing fertilizer or they have to leave. They can claim higher prices and it’s good for the environment
Organic farming DOES use fertilizer. Usually far more than normal farming since the crops they use are less nutrient efficient. I am not saying Organic is bad it just take a lot more work for a lower yield. The problem is mostly down to the types of crops grown. Modern agricultural crops are very good at becoming a lot of food quickly and because of this they deplete the soil quickly. A single crop of soybeans or wheat or especially leafy vegetables will ensure fertilizer is needed to let a second crop grow the next season. Its not a matter of maximizing profits by using fertilizer its genuinely required with mono-cropping. The solution is to use rotating crops and letting fields fallow periodically. The problem is this is inefficient from a yield and economic perspective since A: you are not using all the land available at all times and B: soil rejuvenating crops are usually in much lower demand and produce less food for humans meaning implementing this worldwide would lead to famine.

The best solution should be to build biogas plants, all the manure goes to the biogas plants, you produce electricity, or natural gas, and you take the solid manure to the fields, while the liquid one can be applied only outside of the restricted area.
This is the best solution I can come up with.
The problem is that biogas plants cost money to build, so the government should build and run them, or at least put some money to work and use it as facilitation (o tax reduction) for farmers who built biogas plants

Demonetisation is an interesting issue, also perhaps the caste system and systemic corruption. Yeah, but most of India also believes that Ganga is a goddess that can't even be polluted in the first place, so it's hardly surprising that nothing is done about the pollution. It's basically an open sewer at this point, but people will still drink its 'holy' water in order to cure all their ailments (which were probably caused by drinking the water in the first place). India doesn't make for a very good test case.
America can implement more laws and procedures so something can be done about it. It's just fertilizers and manure.

It's a lawsuit machine, not regulation. It is a way to solve nothing, it answers no difficult problems.
I mean, I'm pretty sure that it gives pressure to those that are creating an extreme amount of pollutants to be better. Who knows if anyone would ever sue, but it is a first step in protecting the Great Lakes, the largest resources for fresh water in the world! Not to mention the importance of keeping them clean for local economies like fishing and shipping as theyre extremely important for that. As someone whose lived on 4 of the 5 Great Lakes for most of my life, I know the importance of these bodies of water on not just the region, but on North America and the rest of the world. I think the fault lies in the draining of the swamp, people in Toledo are a little pissed about it, but I dont know how we change that and dont think we can.
@@fallonsmyl3292 The bottom line is that lawsuits can't replace regulation, technology that allows people to dispose of waste in a more environmental fashion as dictated by government would. This is essentially the laziest way to solve a problem that just burns money on lawyers and has such a vauge criterion that no one has any clue how courts will interprit it. It's a feel good law that I doubt will do much good.

Ahh, Eutrophication, practically what we learnt back in middle school.
It's crazy that even after scientific testing and research in eutrophication, people still think mixing fecal matter and water and then putting it through porous soil is a good idea, extreme cases of eutrophication can completely destroy ecosystems, no clean water is the least of your problems, no oxygen reaches the water so fish die out, the unicellular plants absorb most of it during respiration and would oxygenate the water during photosynthetic processes but not enough as dissolved oxygen, wiping out natural predators of insects such as mosquitoes, causing swarms to rise on Lake erie, those larva if they even survive can cause a mass epidemic especially for the cows and livestock that are nearby as well as residents, but sure go right ahead and pour that phosphate based solvent into porous soil.

We learn that while phosphorous contributes to eutrophication but we far more often consider it in the context of synthetic fertilizer which has amino groups as the greater contributor. It’s interesting to see the calculus flipped with CAFO waste.
I'mma say this right now Toldeo has no power over Erie, at least not as much as Buffalo, New York or ever Erie, Pennsylvania I find it stupid that they voted to give a lake rights, even when they has less control over the lake than Canada, also the fact that Erie feeds from Hudson, Michigan, and Superior and then feeds into Ontario from the Falls, so if anything Ohio has no right to give a lake rights when New York, Pennsylvania, and Michigan have more control over the lakes than they do, in this way technically speaking the Bill of Rights for Lake Erie goes to all connected lakes, otherwise they can just easily move the pipes to feed into any other lake and it'll still get to Erie
ZFG Jerky I understand your sentiment and you do have a good point. Control over the whole lake would have to be gifted or claimed by a higher authority than just Toledo. I’m fairly certain the good people of Toledo are well aware of that. The right they bestowed on the lake extends only within the city of Toledo and entities that operate within its jurisdiction. For instance interested parties can now claim a tort on behalf of the lake against a company (or perhaps more likely a farmer) who violates these rights within Toledo’s legal reach. It may not be much now but when said company/ farmer fights the ruling all the way to the State Supreme Court or even the SCOTUS, that is when things get interesting and the extension of these rights can spread with or without the direct and express approval of the citizens of Ohio in general or other states. It is also possible that the referendum example may be followed elsewhere and rights will spread in that manner. Time will tell.

People don't want logical and specific solutions that address the problem, they want stupid and outlandish "solutions" that don't actually do anything and just create a dozen new problems to deal with. Why bother actually combatting the issue and passing legislation to solve it, when you can waste everyone's time by passing legislation to give legal rights to an inanimate body of water.

@@vinny9868 But tearing that stuff up and replacing with it isn't easy nor cheap to do. There's actually a really efficient way to have cars run on electricity, it's similar to how slot racing cars work (where a metal beam runs down to a metal track and charges the car). Problem is, we'd have to rip up ALL of our streets and roads to make it work. It's a similar effect here where you'd have to rip up hundreds of miles of pipes and such to change where that runoff goes.

The problem is not the liquid state of the manure or that the lifestock is living in big herds.
It's the ammount of (liquid or solid) manure per acre, that is spread out. Or more precisely, the ammount of nutrients (nitrogen, phosphorus...).
In my country there are general reuglations about that.

The answer is buy your beef from Saskatchewan and Alberta where the cow still has an acre per cow on the open prairie. They are only brought together for the winter months and then let back out to huge pasture for the rest of the year.
The cattle farmers of Western Canada do their best to mimic the Bison habitat of old.
