Former police officer Kimberly Ann Potter, 49, stands trial for killing Daunte Wright, 20, in a disastrous traffic stop. Potter’s attorney has also said that she will testify. You can watch jury selection in the player above. Opening statements are scheduled for Wednesday, Dec. 8.
There is no dispute that Potter fired her gun. The question is whether Potter’s actions constitute first and second-degree manslaughter under Minnesota law.
As seen on body cam video from April 11, 2021, officers with the Brooklyn Center Public Department pulled over Wright for a traffic stop. Officer Anthony Luckey began to handcuff him against the driver’s side of the car. He suggested Wright was about to resist.
“I’m not doing nothing,” Wright said. He eventually yanked away, getting back into the driver’s seat. A struggle ensued.
“I’ll tase ya!” Potter said, pulling out what turned out to be her gun. She repeated her warning, then finally yelled, “Taser, taser, taser!”
She opened fire, striking Wright, who then drove away.
“Holy sh*t!” Potter said. “I just shot him.”
Wright later crashed into another vehicle, authorities said. He was pronounced dead at the scene.
Potter resigned.

Potter had her Taser on her left side of the duty belt and her gun on the right side, authorities said.
“The complaint alleges that former Brooklyn Center police officer Kimberly Potter committed first-degree manslaughter by recklessly handling a firearm when she fatally shot Daunte Wright during a traffic stop in Brooklyn Center on April 11, 2021,” The Minnesota Attorney General’s Office said when adding the count of first-degree manslaughter. “The complaint continues to allege - as the original complaint did - that Kimberly Potter committed second-degree manslaughter by culpable negligence by using a firearm.”
Being a police officer for 26 years, Potter was trained in the use of guns and Tasers, they said.
“Defendant completed annual recertification training courses on each of these weapons,” they wrote in charging documents. “These courses included training on how to draw, aim, and use each weapon correctly. The training material for these courses also included notices alerting Defendant to the possibility and risks of drawing a handgun instead of a Taser. In the six months before this incident, Defendant completed two Taser-specific training courses. For example, on March 2, 2021, Defendant attended a four-hour training course pertaining to the Taser. This course involved a classroom component, which provided detailed and substantive information concerning the function, proper use, and safety concerns associated with using Tasers; a practical component; and a written test. After this training, Defendant was certified for use of the Taser X7.”
In other words, prosecutors said Potter knew better, and she has to take responsibility for it.
Potter’s defense is geared to argue that this shooting was an innocent mistake. In motions, they have been arguing against the state’s use of force expert and suggested that Wright was a danger to the community.
As things stand, jurors will hear Potter’s version of events from the stand. She will testify, defense lawyer Paul Engh told a potential juror.

She did a bit much in my opinion, Rollin all around on the ground hysterical for the cameras..the fact that Noone ran down to check on the victims involved in the crash is beyond me
Watching the reactions of the two other officers after she shot Wright is kinda disturbing. They were more concerned about her being an emotional wreck than the guy that she shot and had just crashed the car he was in. Seems to me that only one of them needed to stay with her and the other should've hauled azz to the shooting victim to render aid. As for Potter, she was extremely concerned and worried..........ABOUT HERSELF!!!

I still am dumbfounded that as an officer who is training other officers she does NOTHING to get medics, other officers the ‘trainee’ has more sense then she does.
To me she has an attitude right from the very start when he stops in a not optimal place, then she was making comments ‘it’s the wright brothers’

Officer Luckey, should have gotten Daunte out of traffic & moved him to the back of the car, while shutting the car door. At the back of the car, he could have spun him around; then told him he was under arrest. Making it much easier to place handcuffs on him. Then Officer Johnson, could have secured the passenger. Everyone would have been much safer.

@@karimb9157 An Officer's first duty, is try & keep everyone safe during a traffic stop. Those simple steps, could have stopped Dante trying to escape. He could have tried, but not been able to make his way back to the car. Some Officers, will take the car keys too.

I noticed from her Body Worn Camera that her gun was drawn early on in the scuffle. She was a danger to her own partners right off the bat. She was clearly reckless from the start and in violation of any training given by any law enforcement agency. The lead officer was directly in her sights when she pulled her firearm out and started screaming "taser, taser!" While the officer on the right side of the vehicle got in and out of the vehicle before and during the scuffle. And all of the officers failed to follow proper protocol when they didn't take the car keys out of control of the violator (suspect) when they moved Wright out of the car to initiate their arrest. Was this brought during the trial? Did the prosecution have the PD's trainer or superior officer testify during this trial? If this officer is not found guilty it's a travesty of justice. If this trial is determined to be a mistrial another trial is definitely warranted.
Sargeant says he tried to drive off with him in car which is considered attempted murder but the down fall for potter is that she shot him first.

I wanna see the so called Sargent who claimed his life was basically said basic of her act. Because according to protocol the sergeant should have backed off and he wouldn't have been in danger.
This could be looked at as a mistake but the fact that she switched the insurance card from her right hand to her left hand, clearly show that she knew what she wanted to reach for or subconsciously did it. She knew she blew it. Her cry wasn’t for the kid… it was for her life (both hers and her family) that she knew that she had now changed forever.

I really want to believe that the officer thought it was the Taser,
But its hard for me to believe that when she's pointing the weapon at Daunte and looking at her weapon being pointed at Dante for like at least 15secs and not realizing its the gun and not the weapon.. You can see from her dashcam view that she is looking at her gun while she's pointing at Dante, for a long time before she fire's it. And another thing is Police don't Point there Taser at someone's Chest. It agaisnt the Polcy to Tase someone in there Chest. So if she thought it was her Taser, why did she shoot him in the Chest, If she thought she was using her Taser??.? Ummm????🤔

If Potter hadn't felt Officer Luckey was incapable of carrying out a traffic stop and if she hadn't decided to flex her authority to show him "how it's done", Daunte Wright would not have died. Officer Luckey would have been able to handle it just fine. Potter overreacting, escalated and was negligent.

Exhibit 13 - Officer Potter's body cam shows having her gun out @ about 39:20. She also had plenty of time knowing that her service weapon was not her taser because it took her about 9 sec before hollering out Taser Taser Taser. She already hollered out Taser twice real slow while pointing her gun. Then she continue screaming Taser Taser Taser before firing her service weapon.
Maybe she was on medication that confused her. Was she drug tested..?

I just watch the mother testify ON ANOTHER CHANNEL that she waited there with her son covered with a sheet for 8-9 hrs but WOULD NOT LET HER NEAR HIS BODY...THEY HAD MOVED HIS BODY FROM THE CAR AND LEFT HIS BODY ON THE GROUND ...they also lied to her about a high speed chase

She held the gun in hand her long enough to realize that it wasn't yellow (the color of the tazer). At 43:26 when she said "I'm going to prison", it was at that point when they started getting their story together, I guess forgetting about the body cams.

They saw that they wrecked after shooting him, and no one rendered aid, but yet she was down in full meltdown(unstable person), and the focus was then on her not him, with aide right away they may have been able to save his life. Also, their actions led to another party being injured by the wreck caused by him being shot. All 3 of these officers are to blame. Not just her, and all that time on the force she A, is an unstable person with no logical thinking, so many years of training, I have NEVER heard of anyone making that mistake with a taser, and she shouldn't have either, she knew what she was doing, all of them did. I hope she gets a life sentence.
I believe that it was truly an error, however, it is my belief that she needs to be held accountable. A life sentence in this case is totally overkill. IMO the charges warrant a guilty verdict on both counts. 4+ years is a long time; I find it appropriate, and just. The Wright family deserves compensation for the inept actions of this police department. IMO.

Why didn’t at least one of these officers go tell the other officers he was shot? Instead they just let him die because they were worried about her not the person that was shot by her even though they had to know it was a fatal shot
That should have been the first thing done, to call out on the radio that he was shot and that there was two people in the vehicle. Those officers stayed back and sat with her while he's shot and not the mention the innocent person who was hit in the other car.

Why did they still allow Daunte to still have his keys in the car if they were going to arrest him? Why didn't they make him step further away from the car if they were going to arrest him? Why was officer Johnson allowing the female to stay in the car if Daunte was going to be arrested? He leaned right over her to get to Daunte. She could have been armed. They all botched that up terribly.

She held that gun for 5 seconds in her view she had a chance to change to the taser. While she was there waving the gun trying to get a shot she saw that gun.
Right away the cover up.. "I'm going to go to prison." "That guy tried to take off with me in the car." That's not why she shot him, and at no point did anyone think their lives were in danger which is the typical playbook excuse. She pulled the wrong gun period.

If you have handled guns for even a short amount of times but over 20 years...there is no way to mistake a taser for a glock...weight differences...color...and any shooter knows to look where you are shooting...especially if you are TRAINED...

But then she had the presence of mind to switch the paper between hands multiple times? And she remembered to yell taser multiple times to warn her fellow officers to back away, but fired before waiting for the lights to come on and the laset to show where on the subject the darts would land? None of that makes sense. Even if it was an accident, which it seems to have been, it is serious negligence on her part and there is no way she should be a cop. They are supposed to be held to a higher standard than the rest of us, not lower. She should serve some time and never be allowed to carry weapons again.

Officer Luckey seems like one of the good cops in the beginning. He treated Daunte with respect but then she got involved and screwed up! I hope he gets promoted for his professionalism in this case.
Officer Lucky was not allowed to serve and protect because POTTER butted in it was under control but smarty pants 🩳 showed her real personality. 🎯 Practice.

But, even if she accidentally 🙄 grabbed the wrong weapon, she still was in violation! Both officers and the girlfriend were in danger! I hope she gets the maximum! This has happened too many times for her not to know better!
I agree his interaction was very respectful just wish he had told him to turn off the car and move to the rear of the vehicle before the arrest process started. During her testimony Friday she almost seemed to insinuate that this whole thing would've never happened if officer Luckey didn't decide to pull him over. At the end of the day a whole series of unfortunate events that created this domino effect.

I believe she was edging Daunte on by repeating that he had warrants etc. She hoped something went left! Officer Luckey was outshining her and she didn't like his niceness! She was bloody hysterical! (around the 43 minute mark) It was all about her at that moment. What a shame the officers didn't run over to the scene of the collision, to render aid. I think a second vehicle was involved, multiple people may have needed emergency cpr. Instead, the officers stayed to comfort a hysterical woman. She might not be suitable in law enforcement. I didn't appreciate her condescending, "really?" when the car stopped in front of the road entrance. She kind of sounded unprofessional.
Notice how nonchalantly the sergeant stands there looking at the accident scene down the street as he stands on the grass near Kim? Was he crashing from the adrenaline rush?
You can tell she was annoyed amped up by the way she was talking to officer Luckey in the car. Also the way she showed up and grunting "You have a warrant!". Luckey had everything under control unttil she escalated the situation. It also looks like she let Wright go on purpose.
She never shot anybody in her 24(?) year career. But I didn't appreciate the crying and screaming. But who am I? I never shot anyone either.
Potter is a phony bologna . her attitude through out the whole body cam clearly shows her behavior and how she did not handle her job like she was supposed to . very unprofessional and careless .

It sounds like even if she'd used her taser she'd made numerous errors, not waiting for her fellow officers to move away from the person she was tasering, either way some serious damage would of been inflicted, I think she was trying to show off to her trainee, also handy to have a 30 second delay on sound, especially with tech these days

The defense attorney’s helping the prosecution. I love it! She just shot a man and they are not concerned for him or his passenger at all. Just this blubbering officer! He did have control of the vehicle, the car was on and his foot on the accelerator. His hands were not on the wheel because he had been shot! I love this attorney, he is making the prosecution’s case!

That is not true. They aim where suspect has least amount of clothing to impede barbs. As a medic of 18 years (now, ER/Hospice nurse), I've removed dozens of barbs from chest, arms, and legs if they were wearing shorts.

Prosecutor sounds like he's talking us into buying a car.
This Police officer said that Daunte was slow to open the door and to get out the car...Daunte never had his hand on the car door...he had something in both of his hands, papers in one hand and a phone in the other. Daunte was then asked to put the phone down and he did but the entire time the police officer opened the door (4:56...) and not Daunte, so the Police officer lied.
The officer did not say Daunte opened the door . He stated “ The opening of the car go slow” edited to add ( 1:18) The officer stated He helped opened the door he did not say Daunte opened the door. This officer was risking his life during this incident, with the way potter was behaving he would have lost his life too. Let’s not blame the one who is not suppose to be be blamed!

I agree about the assumptions. What really wow'd me was that Officer Luckey said that HE assumes that every car he comes in contact with has a gun. Is MN really that bad with guns? Are "We' enemies and they 'military'? "We' KNOW they always have guns but it's not acceptable for 'us' to be fearful of officers? Do they even get trained about how some people (and they don't even have to be 'guilty' of something, react from unexpected police involvement?
Why do they always leave the car door open when they have someone step out of the car. I've seen so many body cam videos of people trying to jump back in the car when they find out they are getting arrested.

Why, oh WHY do officers who make *any* type traffic stop, ask the driver to turn off the car and hand them the keys until they're finished running plates, names, etc.? That should be policy, across the board. (As in, even if you're only pulled over for rolling a stop sign.)

Policing in general needs to change & until it does I don’t think individual police officers should be held responsible for what they are allowed to do (in most cases)… He had a misdemeanor weapons warrant for not having a permit in a state that does not require permits… So many things need to change. Neither a gun or a taser need to be used in this case, but if she hadn’t shot him by mistake, no one would have questioned her actions and that my dears is the problem.

All she was concerned about when they were in the car was the warrant for the weapons violation. So that's what was on her mind and u see her undo the button with her right hand on the right side of her belt for the gun when standing at the car when telling him he has a warrant. Also the amount of time, weight and feel of a gun from a tazer is not the same. And luckily officer Luckey didn't get hit other than by the projectile. As we wait...

Potter took aim at him. What do you mean luckily Luckey didn't get hit. Potter is positioning herself so as to take a good shot. Luckey was all over Daunte. Watch in slow motion 25%. Carefully aiming so as to not shoot Luckey in the arm or face. She hollered faster as she positioned the gun where Luckey could see in his peripheral vision. Luckey then moved his arms and stepped to the side. Then Potter took aim center mass and shot him. Due to possible heart condition that could be fatal, tasers aren't aimed at the chest area. That's basic police training.

Mr. Luckey's words weren't as significant to me as was the video. People are fallible as evidenced by this officer not recalling correctly what actually happened on that day, at that time. Did you hear him say in his narrative that he was inches away from the gun when it went off? NO. Did you hear him say that he felt something hit his face after the gun discharged? NO. He was trying to downplay Kim's actions. BUT, that's why a lawyer needs to ask the proper questions. Which I think Mr. Frank did with Mr. Luckey.

That's normal practice. As the FTO why didn't she take a more active role in the arrest and handcuffing. Imagine the defense trying to float the fact that Dante was a threat because of the warrant and weapons charge. Did you see them draw their weapons when they approached the vehicle.
