      In this case yes, as there was no danger to persons or property. The sergeant was making the rules and definitions up as he went along.

      No constable, I think today's police imagine they can apply any law they wish to cover any situation. In many cases inventing laws because they do not know how to admit they are wrong.

    You have got to love the old “Breach of the peace”. My son and I were quietly filming on our road (my son didn’t want any sound other than cars passing) but we were accused of a beach of the peace by the six police officers and three police cars that blocked the road to undertake a Section 1 PACE search! I meant to say, the threat came after we were no longer detained for the search, as they didn’t want to hear my feelings). Apparently someone didn’t like us filming so accused us of stealing from gardens, hence the Section 1 search.
    They cause the breach and have the audacity to threaten us with arrest!

    That Sergeant looked so dumb and clearly struggling. Any claim he now makes as an officer will easily be dismantled in court (from this videoed evidence) on the grounds of his shortcomings, like how he can't comprehend what a breach of the peace is. This only benefits criminals walking free.

    Well done Plod , you are one of the better auditors, you know your rights , you don't go looking for trouble and you show up bad police when they engage in the way this bell end did.
    Police like this are a disgrace , and he is a sergeant, its scary to think if someone didn't know their rights he would be arresting people , the amount of wrongful arrests are the reason the CPS have to be as careful as they are, people blame the CPS but it's the fault of bad policing that has meant the CPS have had to tighten up , as they know two thirds of arrests are wrong and solicitors have a field day.
    He was hoping for an arrest for BOP and that would go down as a positive arrest with a warning to get the figures up to make it look like the police are doing good work

      Not necessarily, he may keep that respectful stance. There a many officers who are in the police who still keep a similar ethic. The sergeant however,is old school I imagine. He comes from a different time earlier in his career, when camera's weren't prominent. Hopefully, like this lad is born into a different time where straight away he is sensitised into PINAC and GDPR.

    Despite the verbal failings, I felt the worst behaviour from the Sergeant was his petulant behaviour when the PCSO was engaging with you. Standing on the side lines like a petulant child who’s been told off! What an example to set a trainee! I cannot believe his behaviour during his silent moments…I thought the idea behind a trainee in training was to listen and learn from interactions even if it’s to learn how ‘not to do the job’
    My fear would be that the PCSO is in for a hard time behind closed doors…..

    Observing the Sergeant and his behaviour throughout this interaction I would summise he needs not only re-educating but also counselling. The young PCSO was not intimidated by rank but focused on being rational, engaged and fair. I hope he does well in the force.

    I'm surprised he didn't say "I am the law!". Clearly the Sergeants promotion exam just tests that they have a seriously low IQ. Luckily, he even looks at thick as he obviously is, so the public can have a sporting chance of avoiding him. Threat of unlawful arrest is a crime under Section 26 of the Criminal Justice and Courts Act 2015, therefore you should be reporting him.

    This demonstrates that police cannot be trusted in what they say. This officer was either Ignorant of the law and mistaken in his belief, or he deliberately lied knowing that there are no repercussions for him.
    He has tarnished all police by his rudeness and high handedness.

    Good on the PCSO, the Sgt wasn't the worst tyrant. He did try to abuse his powers and threaten you but he stopped short of carrying through with the threats. I know that's still an issue but I think it puts him towards the tamer end of the spectrum when it comes to tyrant cops

    Trespassing breach of the peace wow let's go fishing. Section 26 of the police reform act 2015 using powers improperly that is a crime.

    I must give the PCSO Credit. He engaged. Listened to you. Even read your paperwork.
    He also seems to know more than his superior.
    Which is nice but somewhat concerning 😂

    So typical of older cops that are used to years of having their own way and not having someone blindly accept their orders. They need to leave the force before they instill that behaviour in the younger officers.

    There was a saying/song some years ago that said "all coppers are bastards" This is the prime example. Arrogant, aggressive, thick, sullen, stupid etc doing just about the opposite of what a police officer is supposed to be doing, "serving the public and upholding the laws of the land" How ridiculous that a serving sergeant is made to look like a school boy with smacked legs in front of a very reasonable PCSO who has a completely different attitude towards the public. A very dangerous copper in a position of authority over other officers that dosen't know what a breach of the peace is. Disgraceful.
