  • This presentation is an excerpt from a longer (live) presentation about the America Invents Act, commonly known as the AIA. This particular section generally concerns the procedures and practices for US patent applications that were filed on or after its implementation date of March 16, 2013, but claim priority to patent applications filed before then. Specifically, it describes the new rules concerning the timing and procedures for AIA transition applications. In addition, it discusses when and how to make Statements under 37 CFR 1.55 or 1.78 to designate that the AIA's First Inventor to File standard should apply to an AIA transition patent application. The presentation provides specific examples of when the AIA transition application statement applies and when it doesn't. It provides instructions on how to make the statement and what particular docket dates to consider.
