    Just wanted to say thank you for your help! My trademark was published yesterday! I had some minor corrections but the trademark attorney at the uspto was the best! I am now legal! People just follow his directions. Good luck to everyone!

      The USPTO is just 15% of what is out there, that can affect you. Even if the USPTO accepts your filings, you could get a cease & desist from a company with Common Law rights, State trademark rights or even Federal trademark rights if they think you are infringing. The USPTO only researches it's own database when you apply for a trademark. The fact is you needed a COMPREHENSIVE SEARCH before filing, and you still needed. Then in a few years you'll need it again to protect your trademark rights.

    Brian, this is VERY helpful. I'm a musician planning on trademarking a band name. It appears that I would use the intent to use application. I'm guessing the the example of use would be a pdf of the main page on the website, true? I figure a band name is pretty basic and shouldn't be too tough. Plus the name I've chosen isn't trademark by anyone in any industry. can you think of any reason why I should consult an attorney. Thank you!!

    Great video. How much does your firm charge to file this for someone. If I do it incorrectly, I know I'll have to pay again to file. If you do if incorrectly, well, of course, that wouldn't happen :)

      LLC in case someone wants to sue. They will sue the LLC and not you personally. You protect your personal assets that way.

    I don't know why so many people dislike lawyers. In my mind they're not much different than accountants. They do all of the boring regulatory work I don't want to do and save me a lot of time. They're also handy when it comes to planning for business expansion, so they can also help me decide the best way to make and save money.

    @thetrademarklawyer I'm a DJ, and I'd like to trademark a name. I like to trademark the name DJ Evan Saenz, however I would love also like to include Evans Saenz. What I have to file to separate names for a trademark. Or is there a special form where I can include both. Or would I just have to fill out two separate forms and pay double?

    you must do your homework. i know someone who use to work at the uspto and said you do not need an attorney to register a trademark, all the information is online spelled out. people just have to be willing to do the work. for those who can't afford an attorney..do the work and dont allow others to discourage you. where theres a will, theres a way!!!

    I'm guessing if your the Business owner you have to be 18 -_-.... I'm 16 but i make T-Shirts i have the equipment & my friends help me & i give them a cut.... Can i still register our name before someone eals does?

      You do not need a USA address to own a USA trademark. Some countries like Canada & Mexico - yes.

Your tutorial about filing is great...But, but what about the need to do comprehensive IP research BEFORE filing a trademark - like the USPTO recommends? What about the need to be LEGALLY CLEAR before filing? Wouldn't your own May 17, 2018 filing of KEEPING IT LEGAL avoided refusal if you had done research before filing?       Names and logos are separate trademarks, and should be filed separately to achieve future flexibility. IF you ever change your logo, or even your type font - you will NOT be able to renew your trademark in the 5th, 10th, 20th, etc years.

    I want to register a slogan and have some concerns.
    While I don’t want to disclose the slogan, I will give you an example of my dilemma.
    Let’s say my slogan is “The white horse ran across the road”.
    However I want the color word ‘white’ to be fluid that is I also want the slogan to be able have protection if I change the slogan to “the black horse ran across the road.”
    All the other words in my slogan will not change but the color will.
    So am I ok to submit this type of slogan and expect to get it registered?

      Trademarks automatically cover similar names in sound, appearance and meaning. Your coverage with a trademark, even without a trademark - under common law - gives you protection against anyone using such a slight variation. You are thinking domains, where even 1 character away will get you a domain. Trademarks are much more powerful. It's all about limiting and controlling confusion in the marketplace.
