A Provisional Patent is a great way for you to test the market to see if your idea will do well in the market. It is a little over $70 and a great way to get temporary protection. It's also now obsolete, have been through endless frustration trying with authoring tools meant for the EFS system which has now been supplanted by the patent center. There's quite a need for updated videos for the new system, I'm trying to file by snail mail now, very difficult to find out how to do this if it's even possible.

How do you incorporate variations in your idea in the provisional patent?
Great video! In order to pay for the provisional patent, am I required to file the PTO-2038 form to pay by credit card, or can I simply pay on the website after uploading the files? I'm asking because the sb/16 form asks for a payment form, but it isn't mentioned in the video.
At the end of the process you are able to pay by credit card!

I believe that I have to file as a small entity because of the income limitation of a micro entity but I didn't see that in the drop down menu for adding your 4 docs. Do I just pay small entity price of $150 but still upload docs as a micro entity?

I am an attorney and I found this video very helpful. I would like to see examples of the drawings and specifications that are approved, so I can better understand the threshold for detail. Do you have examples of acceptable drawings/specifications? Also, what if the invention is modified after the application is submitted?
Google patents or USPTO is a free resource for you to find successful patents. That would be much better to look at. I'm not an attorney, I'd imagine the patent would have to be amended.
My understandings w/ PPA's is that this is where you also include "the story" the "why" etc. Where do we do that? Or is that supposed to be done in photos as well? I submitted my PPA w/ just the drawings & other required docs you talked about. I'm a little worried I may have filed w/ out any of the important info. Thanks much

Found this very helpful since I have a unique product I designed for myself and want to see if I can get it on the market. My question is what if it’s in CAD? Do I take that as wireframe and mark out each feature for specifications?

god, what a disaster the USPTO website is. There are so many contradictions, duplicate forms with slight variations, dead links, dead buttons, bloated and outdated documents, error messages....

Hi, I have a full patent on a safety device that will be expiring soon. The attorney told me it would be about $6,000. to get it up-to-date. I can’t afford that but I would like to continue being the rightful intellectual property owner. Would it be a good idea to do a provisional patent on it now? Great video! So, just to clarify, do you number the parts of your invention and then describe them in detail on the specification page? Can you elaborate a bit on what the specification page contains and its format? Thanks.
Yes, that is how I did it.
In terms of the specfications it's usually numbered based on the drawing. If you labeled a hand component #3 you would specify what it's done, it's function, etc.
Remember, I'm not a patent attorney, they would be able to go way more in depth with you. If you're doing something serious I'd recommend seeking a patent attorney.
Do u have to have the exact name of the brand or can u just upload the idea with no name and a drawling?
I have an idea for an invention, I just found out that someone else thought of my idea as well. Luckily, my idea is a bit different and a different material. I can still patent my idea right? And I had another question, can I use someone elses material to make my product? For example, if I bought windows from Home Depot, and converted them into stained glass, would I get sued? What if your idea was created by you, but owned by your business that you created for your idea? Do you still put the inventor as yourself or your company?
Question buddy... I forgot to leave my phone number on my certification of Micro Entity Status form. I did sign and date. Is this or will this cause an issue? My telephone number is listed a few times on the SB16 Cover Sheet which i also submitted.
I went to the Provisional Patent form, pressed new applications, and I didn't see " Provisional " as a option.

quick question, can my drawings and design change down the road after I patent? Lets say I don't have a prototype built and the finish product is subject to change can I still patent it now to protect my interests and change the design later for functionality? @Empower Multimedia
I am not a lawyer, but from what I was taught in class, if the drawings were to change, that will have to be address once you file the actual patent.
A provisional patent application gives you one year of quiet-time while a non-provisional patent application is the first step toward a legally recognized patent. Both are patent pending and both can help you be the first to file.
A provisional patent application is meant to help protect your idea and give you time to perfect it - essentially, hold your place in line. You can submit as soon as you have a basic design for your idea.
Once you’ve researched your idea thoroughly, and the design and function are ready, you can then apply for the non-provisional patent.
Why did you save your cover sheet as a transmittal?

The one thing missing from all the videos I've seen is how to write the specs and description document and if there is a form or template to use. I don't think there's a particular/specific form to use (pls correct me if I'm wrong). There are a few templates online that vary slightly but all have similar sections (title, background, description, etc.)

@@mike9483 I ended up taking a few templates I found online and pieced together all the common sections. 1 template would have been enough to cover all the major sections. I drafted everything first then copied and pasted/edited into the actual online form. Once you get going it's pretty straight forward. A lot of the sections will seem repetitive.

The Government has changed there filling. How do I get to this page. filling online.
Lets say for instance I want to patent something in the USA and the examiner does an search, do they only search in USA or world wide. If someone already has a patent in lets say France but has no PCT or they haven't filed in USA does this mean my patent will or won't be granted in the USA.
If for some reason I'm not granted the patent then it will be possible to still manufacture and sell the product in all the other countries where the original patent inventor didn't register in without having any legal ramifications.
Any publication or disclosure ANYWHERE that was publically available before your filing date can serve as prior art. There are a lot of nuances as to what constitutes "publicly", but applications and patents printed/published by national or regional patent offices would be publically available.
