  • A motorist was livestreaming as he sat in slow-moving traffic, when suddenly, a big rig truck barrels past him, crashing and triggering a fireball in which four people were killed. Josh McCutcheon went into journalist mode, giving a live account of the tragic accident. That was in 2019, and now the truck driver, Rogel Aguilera-Mederos, has been sentenced to 110 years in prison. A tidal wave of sympathy for the trucker resulted in 4.3 million people signing a petition demanding he get clemency.

    I’ve been a trucker for 15 years. We do encounter many mechanical issues. But to receive 110 years for something that wasn’t your fault is an outrage.

    *HIS SENTENCE WAS REDUCED TO 10 YEARS* - it was deemed unjust as the truck was going _downhill_ when the brakes failed hence the immense speed. He was trying to weave through traffic to stop the crash but sadly lost control. 🙏🏻

      @@zerotodona1495 It was downhill and the speed was so fast that there was no way for him to pull off the road - he was trying to dodge cars so he didn’t run them over. He crashed at the bottom of the hill and it was the fireball that killed the other people sadly. He couldn’t have predicted the size of the fireball.
      That’s manslaughter at _best_ .. Murder is when you intentionally take someone’s life.

      It is an accident if he ended up in the runaway lane, the fact he drove right past it means he was neglecting his duty. Brakes fail all the time, it is what you do about it that separates the men from the boys.

Sometimes operable machines have components that become inoperable, thereby leading to incidents that removes the ability of the operator to avoid the incident. In this instance of a fully loaded truck travelling downhill on the highway and gaining speed, with the only means of stopping the vehicle outside of piling into traffic being faulty, what is he supposed to do, teleport?

      Its more of the law that was implemented. The thing is that the judge doesnt agree with the 110 years sentence but the law gives 110 as a minimum. The justice system is a joke.

      I am not convinced he is entirely innocent, was he aware of the condition of his truck and if so, what steps did he take to have the truck repaired? Did he check his truck properly before taking it out onto the road? Were there any potential warning signs that his brakes were not working properly before he came to the hill? Why didn't he use the escape lane designed specifically for this purpose?
      In my experience, it is extremely rare for a system to just....... fail... there is almost always some kind of warning that something isn't right. The failure occurs only after that warning is ignored/unnoticed for long enough.

      Honestly whats the point if punishing someone who had no ill intent? He should have to attent serious training if hes going to drive a truck again but its an accident. Theres no use in punishing someone for something they dont mean to do, it could still happen again no matter how much hes punished because he had no control or choice in the matter really. If hes going to be punished for anything at all it should be speeding but the rest was a freak accident

There is no reason for his truck to be going that fast. Also why did he wait to hit tons of other motorists instead of veering off the road and dodging people. I'm not saying he deserves 110 years but he was at a lot of fault here. He also gets to live after his poor choices where the other 4 people do not!!

    Sadly pedos, murders, and dv abusers get lighter sentences than this and some judges STILL have sympathy for them. I don’t like driving near trucks but I respect all truckers who work day & night bringing those precious resources to cities/suburbs for us to live so comfortably and conveniently. Hope he is able to get an approved appeal on this

    Here in the UK a woman was just given 25 years for torturing and killing a baby. The mother who allowed it to happen was given 8 years.

    Edit: His sentence was reduced to 10 years! They took 100 years off his sentence. Thank god for that. Thank god for all the people who saw this injustice and did something.
    I just watched a video where a woman who knifed a man 100 times til his end got sentenced with 100 hours of community service because "the weed made her do it."
    What this man was sentenced with- despite being the cause of the ending of 4 people- is completely inhumane. It's cruel and unusual punishment.
    I hope he got his clemency. I'm gonna have to do some digging...

      Yup because most of us Conservatives know that Truckers have a lot on our shoulders when operating a truck and how harsh a company can be on their truckers … The company that hired him should get 110 years for not teaching the guy English and how to read a runaway truck ramp sign … The judge even knew that giving him a long sentence was bad but it was Colorados weird law that forced him to sentence that amount

      Actually its for the accident that killed 4 people, not just mechanical issue. But I agree, the brakes were not his fault. His fault is not using emergency line for trucks. He should be fined and sentenced for that - 10 years still seems like alot. People get less for much more.

Drove recklessly for HOURS including people reporting it. 2 hours before this called his boss about his brakes and if he waited would've never happened. Lied about knowing how to drive in Colorado.       1, he didn't have a CDL to drive a semi. 2, he didn't have experience driving in mountains which you most definitely need when driving a semi. 3, he didn't take emergency exit ramps made for these situations (probably because he didn't have a CDL or any kind of training on driving a semi or a semi in mountains) 4, he knew the truck had break problems.

    My husband is a truck driver and anybody who drives a truck knows your brakes can go out at any time. It can happen to anybody. He does need punishment maybe 5 years and 3 year probation. But 110 years, that’s crazy. I hope he gets a lighter sentence

    Im a returned truck driver, my heart goes out for the people whom lost their lives to this tragic accident, the driver lost his brakes, the amount of panic he would surely of been under would have been extreme to say least, it was a tragedy, the driver should never of received such an outrageous sentance of 110 years, if it was intentional yes, but it wasn't, if any he shouldn't have been sentence at all.
    The judge claims he had no choice, he did he being a judge could and should have overruled the accident based on circumstances. The driver will pay for this mentally for the remainder of his life.
    May the victims R.I.P.

    It sounds rough but I watched something about this a few weeks ago. He passed run away truck ramps, kept riding his breaks (which you don't do on a big rig on a grade), stopped a few dozen miles before the incident to call his boss because he was worried about his breaks overheating but continued going. Then I heard, once his breaks gave out he just closed his eyes and hugged the wheel until he crashed. I want to see some corporate responsibility. This guy did not have sufficient training to do the job. He panicked, forgot his training and people died as a result. Who certified him? Who allowed him to get his CDL? Did his boss convince him to keep going when he himself wanted to stop (I hear that's a big issue in trucking)? There needs to be accountability put on the shoulders of the people pulling his strings. They need to evaluate the training program he went through.

      @Cheapzer there’s a difference in seeing a sign at normal speed and coming down a mountain with no control when you can turn the wheel too quickly to follow your sign and still flip over because that’s how trucks work. It’s much harder and scarier than you think. People who say this clearly have never been in a truck when going down a mountain. There is no training to prepare a person for a situation where he or she may die

    Having been a trucker in the past, I have seen the aftermath of many freak accidents. The biggest mistake he made prior to the crash was he should’ve pulled over when it was humanly possible and safe to do so before he passed the runaway truck ramp.

      @F.B.I Truck drivers often die when they wreck out in those ramps. He didn’t know the road and was never in that situation before. He made a very bad choice in thinking maybe the descending grade would level out so he could slow down and safely stop. Should he face charges. Yes. Should he do some time? Yes, but 110 years is ridiculous. The guy was trying to earn a very honest living and was caught in a very bad situation that didn’t know how to handle.

    Anyone who’s familiar with this case knows the trucking company he works for holds at least 50% of the blame. They pushed a driver with no experience far too hard. Transcripts also show he didn’t want to go over the pass that day.

      When he passed the runoff ramps and kept going, he then became responsible for anything that happened. He should have gotten 5 years for each death, minimum. It's no different than taking a gun and killing 4 people and then saying I didn't know it was loaded. He had opportunity to safely stop his truck.

    He passed a runaway truck ramp to avoid causing damage to the truck and load to save his job and professional record and he put that over the lives and safety of other people on the road. He didn't know there was a slowdown at the bottom of the hill so he figured he would ride it out because he was close enough to the bottom and then deal with the mechanical issues from there whether it was brake failure or just brake fade but there was an accident at the bottom of the hill and traffic was coming to a stop and he killed four people. He deserves at least 10 years in prison. 110 years was excessive but most definitely deserves 10 years. At least.

    I personally believe him. Some people don’t realize that when your life is in danger, and you know that you’re in imminent danger, you truly go into a state of shock. No matter what you tell your body to do with your mind, your body simply does not respond. I’ve felt this probably twice in my 30 years of being alive. He absolutely should’ve hit the runaway ramp, but I’m willing to bet he was so scared that he wasn’t thinking straight at all. This whole situation is tragic all the way around. Prayers to the people who were lost. I’m also sorry for the driver… smh

      He obviously didn’t remember his safety training from orientation, he could’ve gone off the runaway ramp or hit the other big rig but he instead chose to hit smaller cars to ensure his own safety.

      Because it’s part of the state’s old “get tough on crime” legislation. Colorado requires all charges to be served consecutively. He got the minimum for all of his charges, but there were so many that they all added up to 110 years

      @@lucaslindgren3237 1, he didn't have a CDL to drive a semi. 2, he didn't have experience driving in mountains which you most definitely need when driving a semi. 3, he didn't take emergency exit ramps made for these situations (probably because he didn't have a CDL or any kind of training on driving a semi or a semi in mountains) 4, he knew the truck had break problems.

    I feel for this truck driver because I went through the very same thing, only difference was, six totaled cars, no one was injured, and Budget Truck rental, was 100% at fault. I was a kid, and convinced an arcade owner to sell me all his arcade machine's, instead of dumping all of them into the ocean like he had planned. Each was was broken, but amazingly, I repaired all but one, and at $50 each. I was 14, paid a neighbor who had a truck license to drive a truck three hours each way to pick all the machines up. When we hit the highway, truck was only doing 20mph, so we pulled over and I called Budget Rental. Instead of bringing us another truck, a mechanic came and told us the brakes were new, and needed loosening. We took his word. Told us to bring the truck back for a replacement. As we were nearing a traffic light intersection, Im asking my friend shouldn't we be slowing down?? The look on his face and seeing what he was doing said it all. We had no brakes!! He yelled duck, which I did as glass broke over my head, and when we came to a stop, discoveted I couldnt get up, something was blocking us. Slid out the side door, to an awe of onlookers thinking I and driver were dead. We should be. We hit a lumber truck and the entire back and of the stack, went through the cab. Had we not ducked, wed both have been beheaded. Six mangled cars, not one person injured. I paid an arcade seller to tramsfer my machines to my home for repair after that incident. No clue what happened with the mechanic or court proceedings. I wasnt allowed to go, due to being a miner. Court wasnt about my neighbor being charged, but him suing Budget Rental. Never ever used them again.

    I'm not a truck driver but something similar happened to me and the other driver lost their life. I was found not at fault but let me tell you that the burden I carry is a life sentence. I feel for this man, the burden of taking a life sucks and I can't even imagine doing it while being in prison for life.

      I heard on the news today that the governor is going to wait for the court of appeals decision to make himself a decision so actually it doesn't matter if it takes five years to reduce his sentence cause my believe and I might be wrong he's going to be there from 10 to 20 years

    He is now serving only 10 years and is eligible for parole on December 30th, 2026. Poor guy. The truck company should be held responsible. Forensics could even tell that the truck was in poor condition. The brakes were so old that they failed and something went mechanically wrong. The families of the victims didn't even want him to go to jail because even they knew it wasn't his fault. Also, rest in peace to the people who lost their lives. And condolences to their family and friends.

    The owners of the trucking company should be the ones doing time. How did they know the brakes didn’t fail by the time he passed by the runway ramp. Maybe when he passes it, then it started to fail. He’s just the driver/messenger not the owner of the truck.

    This terrifies me. My husband is a truck driver and sometimes things can't be helped. This is a tragedy but it also seems like an accident.

      He could have used the runaway truck ramp, or just crashed off the side of the road. He had a problem with his brakes, not his steering. He chose to crash into cars instead of off the road. He deserves more than life in prison. I doubt your husband would ever make such a selfish and stupidmistake.

      But i do not agree with your view that he deserves more than life in prison. The man is not a terrorist or mass shooter. He did not hop into that truck with the intention of taking lives. Neither did he ask for the truck brakes to fail.
      Everything else was a freak accident. The only action he can be held personally liable for is failing to use the runaway ramp. With all that in consideration, I don't see why he should spend more than 2 or 3 years in prison at most.
      I personally would give him 1 year community service and ban him from driving any kind of heavy commercial vehicle ever again.

Think about the 4 people that were trapped a live in the cars and them burning to death. This POS can rot.

      You can easily miss that sign at the rate of speed he was going, plus the stress he was under. Hell, I had to rewatch and pause the video just to read what the heck the sign said! I personally have never seen this type of sign with this verbiage. If I was personally in this situation, I would’ve been screwed, since I’m near-sighted. I dang sure wouldn’t have known what the sign said until I was right up on the sign, and it would have been too dang late for me to take the exit. I sure hope justice re-evaluates this situation, and grant him clemency!
