Notaries must carry insurance and can be sued and lose their license for fraudulent signing. As a notary, people will call me feeling me out if I would go along with a scheme. I tell them outright, you must have your State issued ID and you must be the owner of the property, or the owner of the property has to be present with ID, or I will not be working with them. Period!

He was a career criminal and I think he lived in California and he would call around two different notaries and different title companies and he would say all these really big words and make his sentences Very elegant and he just knew what to say until he could get someone to send them a copy of the title or the deed to the home once he got that he went down and filed on it with a fake ID and then he would turn around and sell the house out from under the people that were actually living in it who owned it And unfortunately, the people who lived in it and owned it had no clue what was going on so they’d end up losing their home some of them got them back, but once authorities finally caught onto what he was doing and ended up in prison. I think it was like 30 years, but yeah, this is not Justin Georgia. This is practically everywhere. Here in Texas you have to show your ID for everything as far as I know. Title Insurance insures activities on the property "prior" to the most recent purchase or acquisition. Basically, the title insurance company is ensuring that the closing agent/closing attorney has researched public records and confirmed the liens, ownership, and taxes on the property. Keep in mind that there could be outstanding federal, state, or local tax liens; mechanics liens, and second mortgages on the property. Title companies pay closing agents/closing attorneys a fee for that service.
