great info! I've been binging your channel tonight. I'm in a situation where I'm waiting for mail communications from a collector so I know where to send a dispute/debt validation letter (they've been hounding me via phone and I'm not answering). But they don't have my correct address because I moved out of state before the account was sent to collections. Do I wait for them to figure out where I live now and send me a letter stating they're attempting to collect? Or should I answer the phone calls w/o giving any of my personal info, that way I can move forward w/ the dispute letter and potentially take care of this? Thanks in advance!

    • @RWlawFL

If they don’t know where you live, they can’t sue you. If it’s not on your credit report, you might want to just block the calls.

Never received anything physical from them only phonecalls. they're asking for $700 and I just don't have the money. My phone automatically silences unknown callers, and I even have YouMail to make my phone seem like it’s disconnected and no longer in service. Yet the calls are still coming. If they're calling you every day to collect a debt, but you don't have any debt that you owe, they are breaking the law.

This is an interesting situation. We had something similar happen, where the debt was so old that it fell off the credit reports and we wrongly assumed it was all over, and then the junk debt buyer must've decided to start collection efforts again. Some sort of collection trigger must've alerted them to a change in our financial status. But this debt is now far beyond the statute of limitations for winning a lawsuit against us. We sent them a very simple dispute letter, to which they responded with a one page printout of the account in question. We then sent them a very simple stop calling us letter and added that the statute of limitations would be used as an affirmative defense against a lawsuit and that we would expect them to pay our attorney fees and court costs if they sue us. Still waiting to see what happens next.

For all practical purposes, whether a debt was "legally" sold isn't something you'll be able to find out unless you're in a court case with the debt collector.
They'll tell you if they CLAIM to have bought the debt, but there's no good way to test that claim outside the courtroom.

Only in a limited way. Under the Fair Debt Collection Practices Act (FDCPA), debt collectors are allowed to contact third parties, but only to locate the debtor. They can’t discuss your debt with them or harass them in any way.
If you think a debt collector is breaking the law, you might have grounds to sue under the FDCPA. Definitely consult with a lawyer in your state who handles FDCPA cases.
