- This was a video done before 2020. It is of Sheriff Laurie Smith and her Undersheriff, rick Sung. I was trying to ask Smith about an issue related to the Los Gatos police, and she got edgy , Sung tried to block my questions and stop my camera.
This video has been unlisted for years. Am turning it on now as since this time, Smith was indicted and retired. Sung was criminally charged by DA Jeff Rosen in the big CCW case. But then in 2022, we found something fishy .
Smith and Sung were both invited to the secret BBMP dinner meetings, but not the same way other Sheriff Deputies incuding John Hirokawa.

Deputies can enter someone's home dawning a body camera(w/ a warrant), and are required to have it on in public. Yet somehow individuals can't record in public??

When the Sheriff doesn’t know the law about something as basic and common as video recording in public, how can the citizens have any faith that the deputies will abide the way? We can’t. It’s shameful how we allow these kind of incompetent people to work in law enforcement.

It always makes me laugh when LEO's wave their arms around when trying to explain something, as if that magically makes their message correct. The reality is, they're always NOT correct on law.
Susan did you have a camera recording them? If not you should have one too in case they unlawfully separate you from the guy recording. Plus we lost a lot of your conversation with the woman while the sheriff was bullying your recorder.

It's not just that law enforcement & politicians are ignorant of the aforementioned, so are We The People, on the whole. @@jwells3315 I agree with you when it comes to government offices but the Sheriff's department is different and in most states, the people can make changes. Then you have totally corrupt states like California where the people in public office don't even change their underwear, California is a lost cause. So for now just stay armed and keep repaired for the worst.
Why would recording a person who holds a high public position be considered an intimidation tactic?
Throughout my life, those in power typically enjoy being recorded.
It’s a golden opportunity for them to remind the public why they deserve the position they hold, state what they stand for in the current climate and how they plan to resolve issues that concern the citizens of their jurisdiction.

I've had a similar problem for years. When I go to a restaurant for the first time I walk into the kitchen and inspect a little bit. Sometimes I get ask to leave the kitchen, sometimes I'm invited to look around all I want. If they kick me out of the kitchen I walk out the door and go to another restaurant. If they don't mind my little inspection I will probably be a repeat customer. The point is why shouldn't I see, what are they doing in that kitchen to the food they don't want me to look at? The ones with the clean kitchen say sure look around all you want.
Marry me ! I am going to use that ! So very hard to explain to the average person unaware of the facts. I showed the facts. You gave us that !

I think that 1 hour/week for one semester would surely be enough to give everyone a working knowledge of their rights. How come teaching people about their freedoms is not compulsory in the 'land of the free'.
There are cameras EVERYWHERE in public and in most businesses . I don't know if many have audio . So now these people suddenly seem shocked to be recorded in public - when it fits THEIR agenda !

When I saw the way Rick Sung reacted in this situation it rang alarm bells . Check that wink to his minions. In a long life I’ve never known a guy who winks like that who isn’t abusive in some way. It’s an insight into their arrogance misogyny and ego. It a signal of his sense of superiority over those he’s speaking to. A warning of : this guy will think he is immune from anything except his own will. No surprise he’s indicted. Sitting at home taking money, certain he did nothing wrong because all he did was what he thinks he was entitled to.

The state, just like a private property owner, has the right to control its property...make rules, which are enforced by existing law. Didn't the Constitutional Scholar have a master class on Adderley v. Florida?
The recording took place entirely in either a limited or non-public forum, where you do not have a right to video record. My guess is you have read Fordyce v Seattle recently. You have heard of qualified rights, haven't you? In the 9th Circuit that is a forum test.

Obviously they need more time in the classroom studying law. I'm not saying the sheriff's you know every law but public photography is basic law I mean it's constitutional law freedom of press

It's bad enough that law enforcement has no clue about the law but they make it worse by doubling down with their ignorance and saying, with conviction, that you can't record in public and that it's illegal to record someone without their consent! They say it like it really is illegal and that they know what that particular law is. But we all know they are saying that with such confidence and it's completely wrong, it just makes it more of a joke and makes them look that much more stupid. I would have much more respect, or any respect at all, if they would just say that they aren't sure and need to do some research or that they don't know if there is a law against that. Don't just say something arbitrary to fit your narrative and embarrass yourself like that, it's not a good look...

The sheriff's supposed to obey the constitutionality of law. Not go by law's that are against the Constitution.
Being stupid is a requirement to enter law enforcement.
People need to understand that there is no such thing as a "private conversation" There are conversations that take place in "private" and there are ones that take place in "public". Hence the phrase: There is no expectation of privacy in public.
When those sho serve the people choose to serve their ego over their oath they become the biggest threat to the community.
