He has represented the common people who have none in the top judiciary to protect their interest legally. Thank you Sir
Justice AP Shah spoke very openly without any fear. Great admiration! I hope we have more Judges like him.
We are all shocked at statements / orders passed by judiciary these days.
they think they are allowed to dictate instead of judge as per law
You mean they are upholding the constitution and protecting it from Dictator Modi?
@@yj9032 I'm sure your papa george soros is holy saint . LOL
Beautifully explained the dangers of excutive appointing the judges , people should be vigilant and not let this happen. Infact judiciary should stike it down if someone tries to tinker with it.
And what about nepotism in judiciary? Why don’t judges are not declaring their wealth and all that? What about unwanted comment they always use do which are not in verdict?

He is a good and responsible Judge & great human being.
He is believed to be sincere ( Mother India must be proud to have him )with a person of character.
Transperncy is the main criteria while appointing judges.
Wonderful Justice Shah, as always all your points were highly thought out, futuristic and considerate to the marginalised. I would like to get your views on Judges accountability too. Thanks.
Justice A P Shaw was one of the best CJs in Chennai High court. Great judge. Unfortunately he was not appointed to supreme court due to political reasons. Great man with great mind.
And imagine if Government wants to get involved in Appointing procedure.. or have Finla say
Only God knows
He was a good at appeasement
Live Law you do a great job of spreading awareness. Keep it up.
The Constitution when originally drafted was befeft of the 'Secular'. The reason for inserting 'Secular' in Constitution was to favour miniorities by appeasing them Why Common Civil Code is still not mandated?
It is very strange that while Justice A P Shah addressing and giving his views about judiciary pf Indian supreme court, people in audience busy and playing with their mobiles! Is our educated audience do care and is worth of listening this honourable judge?
Citizens main desire is that independence of the Judiciary should be maintained.
Justice A. P. Shah was an exceptional and upright judge as I had observed him in the Bombay High Court. His every word speaks of justice.
He talked from his heart and put forth very very valid suggestions to improve the present system of judiciary appointments. Like wise, one more convention can be arranged wherein how to improve the functioning of Govt servants not giving scope for service deficiencies, how a corruption free society to be created can be discussed in it and put forth valid suggestion to Govt to implement it enacting new laws if necessary.
I am with you in your valid request.
What a speech! Great Judge. Admire him.
Very interesting and engaging. Thanks to Justice Shah.
Well articulated. Right from 1950s to 1971, then upto 1993 and so on.... he covered the transformation of Executive & Judiciary appointments, with each one's pros & cons. The defects of Colleagium and the need to make it transparent is justified. Jayaho, Justice Shah.
Thanks to IndiraGandhi for having started the domino effect in Judiciary.
Very consoling! The soul of our nation is still alive because of the judges like him and our CJI of the SC.

AP Shah has been accused of favouritism and corruption.
@lansinngkahmei2417 By a former chief justice of the Supreme Court.
Why does justice AP Shah is not shocked about 10 crore cases pending in all courts of India?
Can he speak on the corruption and 2am bail in supreme Court. Bet he will not open his mouth
Independence of Judiciary does not mean dictatorship of Judiciary.
Really live law is going to dominate in the future.
Justice AP Shah speach is too good, his ideas could be implemented
Independence of ALL THREE pillars is the NEED.
Justice Shah is one of the best judges India has had, and he's paid a price for his forthrightness and adherence to the truth.
@David Ridgewell Why don't you concentrate on your own shithole where you live. I'm sure it has lots of problems, even though the English rule over you.

But I'm sure the gentlemen wasn't shocked by comments of SC judges in the Nupur Sharma case. The last bastion of left ecosystem is about to be teared down. Enjoy the show.
Yes, left eco system heavily infiltrated judiciary and education....need to break this hold...and Bharath go back to its roots of Dharma.. 🙏
Pranaam bhratashri, you are absolutely correct,
I politely disagree with some point like secularism, poverty favouritism. I think that judge must not have biased approach while giving verdict. It is lawyer's work to favour it's client.
One thing is clear that Hon'ble Judges tend to favour their relatives in Judiciary.
I think Justice Shah wanted to convey phases in Indian Judiciary:
1947-1970 Independent Judiciary
1971-1981 Committed judiciary with Punitive actions
1982-1992 Executive deciding what judiciary should do (worst phase of Judiciary)
1992-2014 Partially Independent with little give and take with government
2014- PRESENT Ideological Committed Judiciary with Safronization

Justice AP Shah has unmasked the collegium by explaining its bias in selecting judges .
How did His Lordship feel when two SC judges, who virtually torpedoed Ms. Nupur Sharma with harshest words, seeking clubbing of the cases filed against her in various places?
This retired judge earns lakhs by various means including being part of Arbitrations etc. Now lecturing others about ethics to others. Laughable!
the current chief justice is also the son of a chief justice.
Retired Judges must not be made arbitrators and head commissions. However they may take up teaching, research and fight for weak citizens.
Have a search committee comprising of renowned people who will scrutinise all candidates and then recommend the names to the collegium.
There is already a research team at the supreme court which recommends names to the collegium
@@rajat3180 The search committee should comprise of "renowned people" not people on the payroll of SC. The committee should act independently without any influence from the judiciary, executive or legislature.
@@vs9324 I agree with u. Recent judgement of SC which ordered that minimum one third judges of HC should be from district judiciary, the diversity which SC ensures in terms of diversity in gender, caste, religion, high courts is all set to ensure that nepotism won't prevail in the future judges. So system has already corrected itself and I think even without such an independent committee, SC will be able to attract the best talent which will be free from nepotism
Well spoken
First sentence itself is INCÒRRECT. Ambedkar DID NOT say that selection of judges should be with executive or Legislature.
Accusations against Vice President & Law Minister are atrocious
We should be concerned about truth and falsehoods. If something is true okay fine. It is false then condemn it .
Former Vice President Hamid Ansari and some of the former Law Ministers are epitome of virtues than the present Vice President and Law Minister.

He is not shocked by Pardiwala statement etc... Mr Shah reputation is less said the better...he is part of Breaking India Forces..
Bro what about victoria gauri's comments. Collegium system is not perfect but still better than the system of executive being a part of appointment of judges.
In a democracy everyone must be accountable to the parliament. It is the Parliament alone which is sovereign in democracy. Now the 'collegium' assumes itself to be the sovereign which is ludicrous.
Excellent sir
The problem is not with collegium but the ruling dispensation which is opposed to democracy, constitution, poor, minorities and humanity
@Sailaja. That is the abiding dream of every crypto. All should come together and vanquish the Hindus from India. Justice A P Shah is a remarkable person.
Unfortunately he was denied his rightful place as a judge of the Supreme Court of India.

Highly partisan. Not worthy of the SC post. Made a mark as usual signatory of pamphlets which no people mind to remember
What about the corrupt judges appointed by the Collegium? Does the common man get to know who in the Collegium recommended him? Sir, the Collegium has outlived its utility. Better to discard it and save face. The executive is responsible to the electorate that doesn't spare it.
Of course, he wouldn't have seen any videos of anti-nationals turned politicians turned judges!
His narrative is nearer to the facts, yes one of the fine judges who retired without promotion, but his words are worth to be noted 💐👏👌👍
I, with due honour to honourable justice Shah and all present, would like to refer to ' what kind of ..one one Cristian, one Muslim,one..' If such is the way in India will families to have one boy and one girl, will villages to have one Mandir, One Masjid, One Church, will an organization to have equal Male employees and female employees. What is this happening! Has everything collapsed? Is India under metamorphosed Taliban. Debates and speeches are honest, true to the spirit but question is does India have the true CITIZENS.
One get to baffle at how consultation transform in to consent. The most irrational bias of the Judges in their own favour. Absolutely irrational and therefore arbitrary. Collegial should go.
Not only there should be a minutes of the meeting but also publication of minutes after three years.
These judges not honour public opinian they are above law and behaving like a god. Nupur Sharma thrown
From court but what happened for Pawan Kheda , he was treated like vvip, same day hearing and relaxation , why because he from congress. Is SC Court influenced from congress politics ?
Why collegium pannel.... not introducing cooling period of 5 yrs for supreme court retired judges for accepting govt nominated position,....
Why not SC put sumo motto case against such appointments.... review & appoint committee.... put the matter under 5 judges committee..??
Why SC is silent??.... why Prashant Bhushan is silent?? Opposition is silent for their own reasons....
Instead of finding which system is fair for enrollment of judges in court it is important to fix accountability for judicial fraternity both lawyers and judges are law breakers and muscles of conscience ethics rusted. No reform will improve without fixing accountability. Rules the same judgment varies on appreciation of evidence and time lapse prompts to think judges are maha chors of 1st order
We continued the Colonial ( Moslem and later, East India Co. and British Crown) tradition of complete immunity from any sort of public accountability of the bureaucracy, police and Judicial Officials. Since after Mrs I.G's Emergency and starting with the Janta Regime the Civil and Judicial class have, step by step, completed an ironclad shield around themselves, protecting themselves from any consequential srutiny, answerability or Punishment.. The hardware is corrupt. Worse, the software of process procedure and record has been corrupted right up to our minds and our culture. Ramaswami, I couldn't agree with you more.

Wonderful speech
A P Shah is perennially carping ( siyaaaapa mode )
What happens when the Constitution itself is dictated and criticised none other than Dr. Ambedhkar.? Later what happens when Constitution is itself Amended several times to support ideology and The erstwhile Congress Communist govts ?
Isn't Justice Shah being unfairly and openly critical, almost seeking to provoke selectively, the current dispensation, the current government. Things, the workings, in the judiciary were far more compromised, much worse in the earlier dispensation but that important aspect is given just passing references. Merely to 'appear' balanced in narrative. Absolutely no reference is made by him comparing the process of judges selection, appointments and such judicial systems prevailing in advanced countries and their democracies. What i understand is that in the USA , for instance, the executive, the government of the day, has a big say in this appointment, selection of judges. But this significant point is just not touched upon even by Justice Shah. Why ??
Present day judiciary is an appendage of British Raj. India need not copy a country (Colonial tools to keep a colony under its rule)in judiciary, bureaucracy, educational system since we became a free Democratic Republic. We should follow a modern native practical systems.
Justice Shaw is such a good judge. We want more like him. Like Krishna Iyer. Today's judges are either threatened or given incentives
Carrot and stick policy.
Indian should take initiative to restore the integrity of judiciary
Are there no exams and scrutiny of merit at every stage of a judge's elevation? If the collegium is transparent and subject to checks and balances, only then India can hope for quality in judgements. Otherwise it has outlived its utility.
If the same thing said someone in polished English under the guise of political theory or intersectionality, then that would be very sweet, intellectual and Palatable to Honourable Ex. Justice Mr.Sah. Sorry we need prices procedural transparent appointment system
The Chief Justice of India should handle the Executive?
Nonsense
Any connection with judges get appointed as a judge👏👏👏👏
What collegium role in accountability, transparency and responsibility of judges. How corruption. Misconduct, incompetency, delay in disposal of cases, avoiding dynasty, nepotism etc. So many unanswered question.
Next while selection of judges, what is the pre qualification? No exam, interview etc. Only very few have opportunity to get selection as HC and SC judge. Where is right to equal opportunity to other judges, lawyers, advocates. Many thing missing. Status quo maintained.
Please try to address these questions in rhe upcoming session. This is a layman's perspective on judiciary.
Read him at The Hindu. We can judge his article before it🙏🤣🤣

Leave all this.. you dnt even know What is the status of present collegium ...how it is functioning , Do you think this is civil services like ? That Clearing an exam is sufficient to Become Justices ??? Really man...!! ?
Status quo maintained ??? 😂😂 Man did you copy your comment from Google ??
They did not take back but snatched what was not there earlier
Peaceful community stays blessed
'Favor'-ism and 'Favorite'-ism must totally be out 'off' judiciary. Under these catagory the person (judge) may not possess the calibre to judge the wrong/crime and can influence a wrong judgement. Judiciary must be Independent.
Valuable suggestions.
Collegium is not the right system to select judges and its functioning over 3 decades has exposed many deficiencies. So scap it. Instead let a set criteria be agreed between the Supreme Court and the Govt . For example eligibility for High court judge position the candidate should be in the age range of 48-55 and should have practiced in various subordinate and the high court for 20-25 years and the candidate should furnish 3 of his best argued cases. Like-wise for the Supreme Court judges criteria be worked out such that a minimum tenure of 5 years is possible if selected. A working paper on this should be widely published and invite comments from the public which should be evaluated by a committee of legal and administrative experience and based on the Committee’s recommendation the Govt and the supreme court 3 senior judges arrive at the most acceptable criteria and select candidates in a transparent manner and record the reasons for selection. and even a waiting list be made to meet to immediate vacancies withi the next 12 months
It only proves that no body is above corruption moral financial or otherwise.

Simple solution : Give some right to lawyers also in recommendation.
After final recommendation a candidate/lawyer / cittizen should have also been given the right to challenge on some basis the recommendation before the appointment ;if the reasons/ basis are considered valid by the combination of former judges and lawyers.
But it will be considered impractical/ not considerable.
