    Beautifully explained the dangers of excutive appointing the judges , people should be vigilant and not let this happen. Infact judiciary should stike it down if someone tries to tinker with it.

    Justice A P Shaw was one of the best CJs in Chennai High court. Great judge. Unfortunately he was not appointed to supreme court due to political reasons. Great man with great mind.

    The Constitution when originally drafted was befeft of the 'Secular'. The reason for inserting 'Secular' in Constitution was to favour miniorities by appeasing them Why Common Civil Code is still not mandated?

    He talked from his heart and put forth very very valid suggestions to improve the present system of judiciary appointments. Like wise, one more convention can be arranged wherein how to improve the functioning of Govt servants not giving scope for service deficiencies, how a corruption free society to be created can be discussed in it and put forth valid suggestion to Govt to implement it enacting new laws if necessary.

    Well articulated. Right from 1950s to 1971, then upto 1993 and so on.... he covered the transformation of Executive & Judiciary appointments, with each one's pros & cons. The defects of Colleagium and the need to make it transparent is justified. Jayaho, Justice Shah.

    I politely disagree with some point like secularism, poverty favouritism. I think that judge must not have biased approach while giving verdict. It is lawyer's work to favour it's client.

    I think Justice Shah wanted to convey phases in Indian Judiciary:
    1947-1970 Independent Judiciary
    1971-1981 Committed judiciary with Punitive actions
    1982-1992 Executive deciding what judiciary should do (worst phase of Judiciary)
    1992-2014 Partially Independent with little give and take with government
    2014- PRESENT Ideological Committed Judiciary with Safronization

Recent judgement of SC which ordered that minimum one third judges of HC should be from district judiciary, the diversity which SC ensures in terms of diversity in gender, caste, religion, high courts is all set to ensure that nepotism won't prevail in the future judges. So system has already corrected itself and I think even without such an independent committee, SC will be able to attract the best talent which will be free from nepotism

    What about the corrupt judges appointed by the Collegium? Does the common man get to know who in the Collegium recommended him? Sir, the Collegium has outlived its utility. Better to discard it and save face. The executive is responsible to the electorate that doesn't spare it.

    I, with due honour to honourable justice Shah and all present, would like to refer to ' what kind of ..one one Cristian, one Muslim,one..' If such is the way in India will families to have one boy and one girl, will villages to have one Mandir, One Masjid, One Church, will an organization to have equal Male employees and female employees. What is this happening! Has everything collapsed? Is India under metamorphosed Taliban. Debates and speeches are honest, true to the spirit but question is does India have the true CITIZENS.

    Why not SC put sumo motto case against such appointments.... review & appoint committee.... put the matter under 5 judges committee..??

    Instead of finding which system is fair for enrollment of judges in court it is important to fix accountability for judicial fraternity both lawyers and judges are law breakers and muscles of conscience ethics rusted. No reform will improve without fixing accountability. Rules the same judgment varies on appreciation of evidence and time lapse prompts to think judges are maha chors of 1st order

      We continued the Colonial ( Moslem and later, East India Co. and British Crown) tradition of complete immunity from any sort of public accountability of the bureaucracy, police and Judicial Officials. Since after Mrs I.G's Emergency and starting with the Janta Regime the Civil and Judicial class have, step by step, completed an ironclad shield around themselves, protecting themselves from any consequential srutiny, answerability or Punishment.. The hardware is corrupt. Worse, the software of process procedure and record has been corrupted right up to our minds and our culture. Ramaswami, I couldn't agree with you more.

    I Hope High Court collegium ,give importance to sub ordinate Judicial service officers .. for Elevations to HC .. after holding least 10 years of office 🙏...Sir , that would be really Appreciable .. Otherwise most of Good Intellectual Judges retire at District level ..

    Isn't Justice Shah being unfairly and openly critical, almost seeking to provoke selectively, the current dispensation, the current government. Things, the workings, in the judiciary were far more compromised, much worse in the earlier dispensation but that important aspect is given just passing references. Merely to 'appear' balanced in narrative. Absolutely no reference is made by him comparing the process of judges selection, appointments and such judicial systems prevailing in advanced countries and their democracies. What i understand is that in the USA , for instance, the executive, the government of the day, has a big say in this appointment, selection of judges. But this significant point is just not touched upon even by Justice Shah. Why ??

    Present day judiciary is an appendage of British Raj. India need not copy a country (Colonial tools to keep a colony under its rule)in judiciary, bureaucracy, educational system since we became a free Democratic Republic. We should follow a modern native practical systems.

    Are there no exams and scrutiny of merit at every stage of a judge's elevation? If the collegium is transparent and subject to checks and balances, only then India can hope for quality in judgements. Otherwise it has outlived its utility.

    What collegium role in accountability, transparency and responsibility of judges. How corruption. Misconduct, incompetency, delay in disposal of cases, avoiding dynasty, nepotism etc. So many unanswered question.
    Next while selection of judges, what is the pre qualification? No exam, interview etc. Only very few have opportunity to get selection as HC and SC judge. Where is right to equal opportunity to other judges, lawyers, advocates. Many thing missing. Status quo maintained.
    Please try to address these questions in rhe upcoming session. This is a layman's perspective on judiciary.

    'Favor'-ism and 'Favorite'-ism must totally be out 'off' judiciary. Under these catagory the person (judge) may not possess the calibre to judge the wrong/crime and can influence a wrong judgement. Judiciary must be Independent.

    Collegium is not the right system to select judges and its functioning over 3 decades has exposed many deficiencies. So scap it. Instead let a set criteria be agreed between the Supreme Court and the Govt . For example eligibility for High court judge position the candidate should be in the age range of 48-55 and should have practiced in various subordinate and the high court for 20-25 years and the candidate should furnish 3 of his best argued cases. Like-wise for the Supreme Court judges criteria be worked out such that a minimum tenure of 5 years is possible if selected. A working paper on this should be widely published and invite comments from the public which should be evaluated by a committee of legal and administrative experience and based on the Committee’s recommendation the Govt and the supreme court 3 senior judges arrive at the most acceptable criteria and select candidates in a transparent manner and record the reasons for selection. and even a waiting list be made to meet to immediate vacancies withi the next 12 months

    Has anyone checked how he favoured a particular builder who also was a close family friend from Mumbai when he was posted in Chennai court in a case that was filed against the builder in Chennai court?
    Funny how the judiciary in India thinks they are holier than thou.
    Also was he not the same person that Swami took to a village in Tamil Nadu to show him how mullas has taken over an entire village where they told the villagers they could convert and enjoy the benefits from the government or else they won't get any 😂

    Simple solution : Give some right to lawyers also in recommendation.
    After final recommendation a candidate/lawyer / cittizen should have also been given the right to challenge on some basis the recommendation before the appointment ;if the reasons/ basis are considered valid by the combination of former judges and lawyers.
    But it will be considered impractical/ not considerable.

      All that is well known to those who have worked in the Courts. It was all incestuous. Notably the Allahabad High Court. With nexus working from all across and about the system like a horrible matrix making a mockery of fairness, fearlessness, objectivity, competence and judicial calibre.
