Absolutely right. Post retirement benefits has to be stopped..its important to get neutral judgement. CBI ED EC RBI should also come under Supreme Court.
Very important and sane advice. Democracy can become stronger in India only if justice is done and seen to be done at all levels of the judicial system - quickly, impartially and with application of mind.
True Sir. Again , what would happen to normal citizens like us if people behave differently. Can top courts be trusted when they are having such erring ,partial and selfish judges . Those judges would be least bothered about common man issues. Sad for democracy.
Good lecture Sir. There should be a law banning retired justices from taking over any office of profit or political position or any other influential position in govt, post retirement. This may possibly protect the independence and honesty of judiciary.
Excellent Recommendations. Further, First Come First Serve Should be for All Files; even for every case; No case should be delayed more than a maximum for everybody alike.
I reside in Noida ( Gautam Budh Nagar ) and had a chance to visit Greater Noida courts. My request is that some senior judge should visit this court and see for himself the pathetic affairs.
An inspecting Judge of the relevant High Court is required to visit the lower courts under their jurisdiction and the judge is supposed to look into all the aspects of the court. If there is no improvement after their visits, means something is wrong in system of that High court under which the Gautam Budh Nagar Court falls !!
Excellent speach whereby given good suggestion in collegeum systems and. their appointment and these retirement judges should not be accepted the govt appointment as this is their against the Jamir and honesty. But they should have accepted the job for the judiciary commission enquiry independent. The supreme court as well as High court their lost their honour and faith of people due to their wrong decisions and not giving judgement within the constitution framework. The supreme court and high court are having ample powers to keep check and balance on the govt within provisions so that the loktantra can be strong
Judges should be judges right through till they die to be role models. They should not have conflict of interests before service, during the service and even retirement from their active service.
You are very true. Post retirement jobs in judges for higher post by the ruling party are very common. Who is responsible the Judichery, Government or both?
I fully agree. This will stop only if the judges are not recommended by Bar Associations and are not hand picked by politicians of the ruling Party in the States.
We need to bring a law through constitutional amendment, baring all retired (a)judges of HC, and SC, (b) retired IAS, IPS, IRS and IFS officers, (c) all retired CGM and above cadre bank officials and other financial institutions and (d) all other such key decision makers such as VCs, from taking any job either in public and private sector including RS membership or Govetnors. This will protect Constitutional spirit of these key posts and save democracy througj in-built accountability
'Ex' has become a qualification in many fields. It starts from the level of local government. This must be looked into for various reasons, most importantly to enable the in-position incumbent in any role to perform in his legitimate role. Only highly valuable 'Ex' persons to be listened to. He may be one such. But the subject really needs to be enquired into.
True Sir, in any democratic system to function democratically in true sense of the word, an independent Judiciary is an indispensable factor. Let's hope the learned voters of this country will help strengthening our democracy by dumping the party in the hustings which doesn't ensure an independent Judiciary during its government in the country. There must be a constant fear among the political parties to get punished at the general election it it doesn't uphold the principal of free and fair judiciary during its tenure in the government. For this to happen, voters need to be educated to understand the social issues and the importance of voting in a democratic country. Sub VT Nair (Retd) Gen Secy AREWA-AI
Now we can form a Collegium to recommend retired judges fot the post retirement appointments. It is the ratio of the NJAC case that independence of judiciary can ve safe guarded by taking over the full powers to appointment. 🤣🤣🤣
It makes me sad and depressed listening to many judges and senior lawyers blaming everything on executives and absolving bar and bench together from their own responsibilities. If that is how one chooses to look at it..Executives have advantages and they are able to show result to the people on street...water, electricity, roads, education, housing, jobs, gas cylinder, subsidies, free grains, direct transfer of money, contact with executive political leaders.. And when one looks at Judiciary..what have they done directly for the peeole on street...delayed Justice, denied Justice, fear of law, stories of corruption..they could not do the one job given to them and spent a huge amount of time and resources fighting with executives of the Indian government which may be very necessary to upheld the constitution, that is what we would like to think..but had little or no effect on general public. Roti, Kapda aur Makan toh mila..lekin Justice milega yaa nahi..iski guarantee koi nahi de sakta. Sochne wali ye baat hai..and the next conference should be on this.. HOW BAR AND BENCH TOGETHER DONT ALLOW CASES TO LINGER JUST FOR THEIR SAKE..and provide quicker Justice, which they are supposed to be doing. Fighting with executives will then be appreciated if you do something good for general people. The rant of independence of Judiciary seems like students ranting in JNU..azadi aazadi...what is the point? For doing your own primary duty no one is holding you back.. You have been independent since 1861, much before India got independence. People on the street should see the benefits of your independence. Please stop blaming others and together bar and bench strive to provide quick and efficient justice to people of India. Let us feel proud about it.
Who is independent - fellow who talks against government? Can new judges be appointedt by voting by all the judges? Colkegium should include all judges.
It is always easy to condemn every other ones sitting as a judge selected by an opaque collegium system. When your appointment itself is not proper, ab initio against the basic tenats of the Constitution how on earth they have views on post retirement. Further take up any case law that had been taken up by SC, for e.g. the anti defection law, we are yet to have clarity with so many judgements most of it pointing out in different directions and still there is a debate in SC on the process / procedure etc. etc. Can we know how long this will happen before we get clarity on any law that is taken up by SC Further in collegium, why not they have a secret ballot instead, when the judges can vote really independently ?
No judge interested in government nomination. They earn substantially if they work with corporates. If they posted as governor, that's good, they can do justice from their legal expertise.
Why you want to retire a Judge? A doctor, lawyer teacher businessman never retires. Unless the person is unfit. They are many young people who are already retired by being corrupt lazy.
@@agnescraig2912 More SC court benches needed to be opened in. All these old men (mostly) must retire and let the young take over. Unemployment in India amongst the youth is extremely high. Mass migration to the West is not the answer. The world must not be filled with Indians. Last year alone 185,000 Indians gave up their citizenship legally. Illegally the figure is much higher
It is not enough blaming the judiciary or the executive. Advocates are equally to be accountable and receive the blame and brickbats. Many of them exceptions being few charge ridiculous fees for taking up a client’s cause. They do no justice to their client. I will lay the blame more with these money suckers.
Collegium system is not constitutional. and how come, judges want that system, ? while speaking about , that they act , as per constitution of the country , within its percincts. ,

It is correct.

Guts, spine courage is rare among judges. What can you expect from the executive most from a patriarachal society.
What Justice Gupta has spoken if implemented can change the face of judicial system. Govt must consider the suggestions made by him.
