The ACE edition was my doorway into The Lord of The Rings. I bought vol 1 at a drugstore, finished it, purchased vol 2, finished it, ran out with my last 75cents and bought volume 3. Read them all over one weekend when I was in 10th grade high school. Ace made it available to the masses. Now I have about everything written by JRRT and about him and his works.
The Ace paperbacks were sold in the "mass market," i.e. everywhere where a salesman could convince a retailer to display books. Hence the name "mass market paperbacks." This "market" did not initially include bookstores, but by 1965 they, too, were carrying mass market paperbacks. Drug stores, grocery stores, convenience stores, shopping malls, bus stations, train stations, airport lobbies, and subways were the prime vending areas for the "mass market."

The Lord of the Rings won't be in the public domain for a long time - January 1, 2044 (unless the law changes between now and then)
No, they are not, Copyright law has evolved since the 1960's when this incident took place.
