    Story 5- I appreciated seeing the professor's response because the OP post kinda felt off to me somehow. It sounds to me like a cross between misunderstanding and insecurity a little.
    Story 6...if being there was so important to the mom she should've been there. I get wanting to be there for her sister, but she could've done more to be there. She also had ZERO right to make that demand and for OP's sister to agree is equally ridiculous. I completely understand why Jack is so hurt and furious right now, and I agree with OP that he probably will divorce over this if something doesn't change.
    (After the update- I don't see that most of the "restrictions" are really that extreme...it mostly sounds like the mom is in a time out and he wants his family to be able to have holidays with the baby. Especially since she's using her PPD against him to keep him from leaving.)

      @@sanicinapanic4264 even then, in the US, the school isn't allowed to make such demands, as it requires the police with a warrant to access anything on people's phones, laptops, and other electronic devices, and any of their accounts. In other words, this school was overreaching by a damn light-year, and if they retaliate at all, their asses can face a loss of jobs, and possibly jail time on top of massive fines. This was beyond unreasonable.

    • @Arkryal
      @Arkryal 2 месяца назад +2

      @@sanicinapanic4264 I work in evidence (for civil litigation, not criminal). The school in this case was not following procedure (if in the US at least), and was severely mishandling the issue. They have a vested interest in the outcome of such an investigation, so to insert themselves into the evidentiary chain of custody is extremely problematic. If there was a criminal complaint pertaining to the data (even one not involving the school), their mishandling of the evidence could undermine that, and in a civil dispute, it would render what they collected largely inadmissible.
      The courts have set the policy of such data collection, the school administration has zero authority to impose their own policies and procedures in that matter. I know they like to pretend they have such authority, but they do not. These are not attorneys, they are not analysts, they are not forensic techs. Just accessing the devices can alter relevant metadata. Simply looking at the files could result in effective destruction of evidence, or pollute the chain of custody.
      More than that, they have no claim to the data. They would need a warrant or subpoena from the courts. And they can't go on a fishing expedition, they have to have an articulable suspicion, backed by evidence that there is relevant data on the device. They need to be able to say what specifically they expect to find, why they believe it's there, and what supporting evidence they have of that claim.
      The way they were mishandling evidence collection means if anything made its way to an attorney, the school would get their asses handed to them in spectacular fashion. Again, I do this for a living, the school has no discretion in this matter whatsoever, they need to follow the explicitly defined procedures.
      Their recourse was two-fold:
      1) Call police if they believe it is relevant to a criminal matter. Police will collect the data (with a warrant based on a Supporting affidavit which articulates why they need to look, and what they expect to find), and provide it to prosecutors who will make a decision on it's relevance.
      2) If it pertains to a civil matter, they need to file a lawsuit and subpoena the records on the device.
      At no point do they have a direct claim to that data. Administrators will never see it, though in some cases, their attorneys may, and could provide them a generalized summary of it's contents, if reasonable to do so. Data collection needs to be done following the federal rules of civil procedure. The school has no discretion in such matters.

    All of which could be manipulation by the step-mom and/or naivety from the father, also what he said about his daughter had past cases of manipulation sadly makes me think it's both. Good intention but too blinded to see how his and his wife actions were bad/approval without the proper steps.

    If I was his dad I'd probably consider having a very strong password that I know and my kid didn't know and then having them set a finger print lock with strict instructions that if they want to take his phone, turn off the phone entirely.
    Why? Because this allows him to access his phone by fingerprint under normal circumstances. But if they take his phone and he turns it off, the finger print is disabled meaning they need the password. Since he wouldn't know it, he couldn't give it to them and they would have to come to me for the password, this way they can't strong arm him into opening the phone for them.

    Story #1 - This was funny, I'm sure the school's attorneys didn't know the principal was making these requests. That type of data collection is what I do for a living, analyzing electronic evidence for litigation. The way they went about it is so wrong, the school is actually opened up to a ton of legal liabilities and they couldn't actually use data collected in that manner in court. The school has an inherent conflict of interest regarding the outcomes of such matters, so they have no place in chain of custody.
    You still have to follow the Federal Rules of Civil Procedure (FRCP). If you violate procedure, opposing counsel isn't going to just let that slide, lol.
    OP needs to alert the schoolboard AND the school's legal counsel of how this is being handled. I can count about a dozen issues with their methods that would put the school in a very bad legal position if any of that data found its way into a court room for any reason. They have lawyers, let them handle the legal stuff. Those lawyers will retain a guy like me to handle the technical aspects within the scope of procedural requirements. There is a right and a wrong way to do this (as defined by the courts, the school has no say in that procedure), and if they choose the wrong way, they'll get their asses handed to them. School districts retain attorneys for a reason, use them. I assure you, they'd rather address this issue before the principal fucks it than afterwards, lol.

    Last story tells us a lot when the "I'm the one carrying" bit came up, and I get why Jack would be upset. He didn't want to upset her at the funeral, and he's had two major events happen, and he should have been in grief counseling, and for the OP's sister and mother to say what they did, and for them enabling the sister's PPD, it tells us a lot about it, as Jack should have also had a say in the name as well.

    Story one, all you need to say is, "Get a warrant. Mind the door!" Asking a minor to just hand over access to their social media account and personal phone is insane. Also, the first step is TALK TO the son. In these types of situations, schools are usually more interested in covering their own butts and not what happened to the student beyond making sure it doesn't make them look bad.

    @tesuniekataren46 2 месяца назад +1

    If I was Jack in the last story, the best reason I could have for such "strict" and honestly "overbearing" and "unreasonable" demands would be only to see if she (the wife) would be willing to accept it to get back together. If she said yes, then I'd be going "Okay. I didn't mean any of that, but you were willing to do the unreasonable just to be with me, so that tells me a lot". The "A lot" mentioned would be "You do still love me and want to be with me, and you are willing to make sacrifices to do so". From there, clear communication across the board.
    I mean, to be honest though, my relationship with my wife is going strong because we always communicate. We haven't had a single argument in our five years because we will back off if we are upset, cool down, and then come back and talk. (This isn't to say we haven't had disagreements, but we've not yelled at each other at all.)

      @@MalahnMoon It really is all about communication. Shouting matches isn't communicating. Even if one side goes, "I can't deal with this right now. Give me a little bit to process and we can talk about this later today" is a perfectly reasonable statement, provided it isn't an emergency and you each are actually going to revisit the issue. (It isn't always easy, but clear expectations and communications are key.)
      My wife and I met and have known each other for 10 years before we hooked up together. We were older before we even started our closer relationship (mid 30s), so that may have a contributing factor for how we deal with things.

    1st story:: In cases like this always have them send it in writing so that you can give to your lawyer, even if you dont have a lawyer or anything to hide. Sometimes schools are fishing for anything to attach to the kids, and they might use something completely different to as a justification.
    I, a straight A student that received pretty good scholarships to private college in my home state, once head a teacher that was angry after she found out that I had math tutoring from a different teacher (vice principle, her boss).
    Edit / Side Note: I needed tutoring because I moved to this school from 3 states away, we had different schedule. I also started a moth late after my dna donor won my custody for a month and I had to move to Europe, but then he realized that he does not want me and gave up custody of me.

So what if Jack is being controlling, he's just doing the same thing Eve did in the first place that led to his mother never getting to see their baby. She is incredibly lucky that he's even giving her a chance to work it out. Maybe it's petty and can't really fix anything but if it's what he needs to make things feel even it's fair enough to just let it be.

    Story 1, it could also be a Japanese school, they take bullying to the point it leads to an attempt like that super serious. They would interrogate and gather any and all info they can to find who is to blame at times. Bullying has seen a rise with the advent of social media and the like, and if a school was seen as "not trying" to find the culprits would look bad, more so when they claim to be a "zero tolerance" school.

    He's made several posts not because he wants to genuinely understand where he's fucking up and what he can do better as a father and husband. He just wants someone to validate his actions which are entirely focused on his own happiness.
    Dude if you would rather focus on your wife and newborn and make them the priority then fine that's your choice, but stop acting like you are the victim here.
