With more countries flying to space than ever and a private space race in full swing, the legalities around space and space resources are still very much up in the air. There are currently only a few treaties that guide space activity and they are woefully outdated. So that begs the question - who owns space?

Irony. Almost all astronauts have returned from space with the "Overview effect" - "from up there you can't see any borders"... but as it becomes "easier" to get out there, I have a feeling we will start drawing borders again.

"Common heritage" is tantamount to throwing the resources of the universe away. Nobody will extract resources if they don't get to keep them when they do. The current state of the law is in NOBODY'S interest. We need some sort of "homestead law" whereby those who propose to extract resources can obtain clear title to use/sell them. "Common ownership" of resources has traditionally led to starvation.

Sorta lol Your family, for example, is a tribe, your group of friends are a tribe, your county or state is a tribe and so on and so on and Earth wont be united under a single tribe until theres another tribe to compete against that's equally as powerful so an alien race or another human colony on Mars as examples.

Exploration of space just for the sake of exploration isn't going to happen. It's too expensive. Notice that it's the superpowers of the Earth that are exploring space? They are doing it because of the opportunity to exploit it. It's an investment in future resource mining. In some ways it's inevitable. I mean, you have to exploit the resources of the Moon and Mars to provide fuel and bases for going further. It's just too expensive to launch from Earth.

Orbits is an interesting concept. A higher orbit is slower than a lower orbit. What do you do when you slowly orbit past (beneath) another country's space station? Are you violating space? who owns the orbit? Especially popular orbits like geosynchronous or Lagrange points (which are more areas). It's gonna be sorted by aggression, by "Me stronger! I own you!" Not saying it's nice, or polite, or reasonable, but when you are stronger, by definition you dominate.
By the same logic, the country that puts the most resource into starting space will impoverish themselves in the process, and will need the protection of the orbital domination. Sounds like an interesting history.

@@KillaBitz Putting a railgun *with its gargantuan power supply* in orbit would be even more tedious and expensive. A Lunar railgun built on the Moon, maybe. But Moon-to-Earth plinking will hardly be faster than Earth-to-Earth. The slug has to be quite big to make it through the atmosphere. That makes it impractical to accelerate it to dozens of times Lunar escape velocity.
A *practical* railgun will be slower, that is. Then again, if a kiloton slug is incoming, stationary assets may be doomed, even with several hours' notice.

I think we already have a pretty good framework for the peaceful exploration of space. The problems are the consequences of this framework.
We start by defining ownership: that to which you use, delimit, and protect.
So just throwing a flag on the moon would not characterize it as owning it. Nor exploring one part of the moon and claiming all of it.
Another part of the framework is about how things change from unowed to owned. Under this framework there are only 2 ethical ways to have ownership over something:
-You either mixed your work with a resource in its natural state, effectively extending your being towards it. From that moment it can be owned (given you use, demit and defend). Also called original appropriation
-Or you can voluntarily transfer ownership of something acquired that was acquired through original appropriation.
Any other way to acquire resources would involve aggression which would only generate more conflicts rather than solving them, hence being unethical. Btw, we have to remember that the whole concept of ownership is to solve conflicts. If resources were infinite, there would be no need for any ownership of anything.
All good and all, but the problems are the consequences of this framework when you look back at Earth. That's when you start to separate those that believe that "no ends justify the means" from those that think that "the ends justify the means". With those from the second group enabling all the atrocities humans did and could do, just need a good enough end, then everything goes.

As far as the question you posed for us in the comments, we are not "one people".
Humanity is made up of nation states and for the foreseeable future, it will remain that way. Maybe 5000 years in the future humanity will be homogenized enough to be united in pursuit of a new frontier like space, but not within the lifetimes of any of our children's children's children. Probably not even within the lifetime of our own nations.
What the consequences of that will be I don't know, but I think any idea of a world government or whatever is required for such large scale cooperation among the human race is overly optimistic.

    • @glennpearson9348

I'm betting this will manifest as an impending extinction-level event and, even then, only if we have the science to detect it before it actually ends life on Earth as we know it.
The problem with this theory is that there is a significant portion of the human race that needs human extinction to occur so that their Rapture can happen.

You can really only "own" something if a governing body recognizes that ownership, now thats doesnt pervent someone from taking and using resources its just they wont have a legal claim over it if someone else goes and starts using it too

    • @logiconabstractions6596

..... or, if you can yourself enforce your ownership.
E.g. there are a bunch of variously autonomous/warlord controlled regions in troubled countries around the world. They tend not to be recognized by international bodies for good reasons... yet practically speaking they do "own" whatever part of the world in which they operate and can use force to assert their self-proclaimed ownership.
If/when we DO have a sizeable presence in space, it's doesn't seem too hard to me to image that in remote corners of our reaches, someone someday will make a similar play. E.g if I have the most people, the most ships and the most stuff in general on Mars, or some asteroid in the belt, who's going to enforce ownership (or lack of ownership, if we end up keeping stuff common goods)? If I'm 6+ months away from any meaningful intervention from anyone, what prevents me from declaring that this part of mars/asteroid all of a sudden isn't collective but mine only?
And I'm not even saying I'd have to have a militarized ship of some sort to do that. Just using numbers to deny access might be enough.
I'm sure smart people will come up with solutions to that. Or we'll just militarize the heck out of space as well.

@@logiconabstractions6596 well of course, I was speaking in the legal sense, out there you're definitely dealing with bigger army diplomacy, though I dont know if i would use the term "own" because that has moral weight behind it while what you're describing is more akin to holding a territory or a resource until someone with more power takes it from you

@@logiconabstractions6596 - You should study the British Empire and the age of sail - 6 months away from intervention just means that A LOT of ships will arrive in 6 months. Plus if they declare it theirs? then no country will buy their products - or send them supplies.

Suggestion for new topic: yearzones. As time zones work on earth, it won’t feel good to count earth years for a colony on mars. Will they use mars years since first person on the planet? That means all planetary colonies will have different years and we travel between yearzones.
How will computers handle this? All encryption is based on the year. Maybe we use linuxtime instead, a number of megatics after a set date? I suggest this start date is first foot on other planet (not moon).
