It's amazing how easy it is for the scammers to take claim of your property but when but when it comes down to the owner claiming your own property you need a lawyer.

That's the government for you. It's always your job to do their job. But if it's something they want from you they take it. Don't owe them money they'll take everything but if they owe money they'll get it to you when they get it to you.

It all boils down to the County clerks who typically look bored AF if you have ever had to go there, and let anything pass without double triple checking.

It is an inside job as county employees knowingly let this scam happen in the first place. They work with scammers with all those details about your property.

I agree they should 100% be required to validate all of this stuff because something like this may seem like a small mistake to them but the one like us it’s a massive colossal issue which is not fair and it cost us more money than we could ever afford like for me if this ever happened to me honestly I would probably be better off dead because there’s no way I could afford a lawyer to fix this.

How is e-notification going help you after something has already been recorded? Wouldn’t you still have to go through the same unfair drawn out court process? They should set-up an Owner PIN number, and not record anything unless the actual Owner provides it. Crime does pay sadly in our society. You have to prove more to get your own ish back than the thief who stole it.

The fault lies with the clerks that are allowing the illegal so documents to be filed. Notaries all have to be registered on state databases. The clerks are not validating the notary's signature, license or checking with that notary as to the validity of the document. Total failure. They are the ones charged with protecting the public from fraudulent activity...they are liable.
Exactly. It’s way too easy to file fake court documents. The clerks barely look at them, there’s very little proof you even filed (that info is often lost) and you can end up in endless court battles over who has the real filing. A friend of mine has been going through a similar saga for years. Clerks will just take anything and file it a long as you pay the fee and all the blanks are filled.
Government workers are the most lazy, unmotivated, and entitled workforce in the country.

I'm starting to realize that the more obscure the law is the more that the lawyers just make money. Lawyers don't want the law to get better they want it to get more obscure and worse, because then they get to drag things out. 100,000 in litigation fees just to correct a deed that someone stole from under you. The kind that is full of lazy state,city,and county officials without a care in the world, the tax paying public is not a concern for them. The report makes it clear that to get justice we must spend thousands in attorneys and the ones keeping our home deeds "safe" are never held responsible. The job to verify if the transaction is real or not needs to be up to the county clerk. They should not just record the transaction. They need to VERIFY it is real. They are the only keeper of the data.
I think you’re right, but as of now there is no funding for such activity nor do the clerks, have the authority to do it. Laws need to change and your taxes need to go up.
Terrible advice...there is no advice...checking constantly is too late, it's changed already and you still have to go through the courts.

Why is it easy for the scammer to commit a crime and fraud, but it’s more difficult for the actual owner to get back their property? Things should not work that way, it’s like wrong is right and right is wrong. Doesn’t make sense and the laws should never protect the scammer.

What about criminal action against the cons who steal real estate this way? Shouldn't they be in prison for fraud? Why is there no mention of calling the cops against this obvious crime? Why is this merely a civil action?
The govt needs to do more. Why is it sufficient to just file a title transfer form? Something like that should require at minimum a notary to confirm the signature of the seller and buyer.
So they are the county clerks' faults. Sue the county then, that's the only way to get their attention and make them change their internal guidelines on how to verify document and perform dual diligence

If they forged the documents, that's fraud. Which means the scammers are in no way, shape, or form the "owners"; they are thieves and criminals, and should be treated as such. Ask yourself why they are not. 🤔

It’s to simply register because in the past, people were honest and not like this. They are often limited in what they can actually do. Otherwise they may call people liars when they are not. The laws need to change and funding needs to change so that the clerks can actually catch the frauds..

Seems to me that people with good, but "unsecure" titles or deeds, could create a new deed in which future ownership transfers will required the physical presence and signature (or that of someone with Power of Attorney) in order to convey owner ship to someone or transfer title.
Maybe county recorders work with scammers with inside job information. Hold those county employees accountable for letting these scams happened.

So this was a deed of trust not a deed to a home. If the borrowers would have tried to sell their home the title company would have required these gentlemen to sign an affidavit the loan was paid off. Without that affidavit the title company will not recognize the false reconveyance. This whole new story is confusing.

Systems can notify the listed owner before any title transfer is made. Who can? Real,estate agents, title search processes, deed registration … one or all.

My dept, check for deeds when they see something suspicious. The person who forge it, will get arrested, and go to jail. The county recorders need to do a better job.

They need to start using fingerprint identification with original documents and then again with any change and they need to be compared.
County Recorders in the US always have exorbitant regulations but amazingly one important element not covered … the protection of ownership. Ironically the reason these offices have been placed for.
So does it is more easy to steal a home owner title in blue state since the state still allow employees to work remotely or come to the office few days a week , they have no time to check carefully the deed?.
I’m just wondering, does this only happen if your home is already paid off, and there is no lien on it? Can you prevent this type of fraud if you take out a home equity line of credit on it, or a small home improvement loan of some sort?

Single mom and two kids, it happened to me, they prey on the ones that have no choices too. I’ve been three years homeless watching some people live in my home I had for 14 years and my son, daughter and I remodeled! COVID made it easy!! Not to mention no money for attorneys or to even fight for your home, so we just watch from the sidelines! Evil people will take what they want but yet get nowhere with what they took. Just keep believing, my two children and I still sit homeless yet again moving all around just to try.

This is a major failing of the County Recorders offices all over the country. Just too lazy to verify submitted documents. The Congress needs to take this up and put a nationwide requirement that all submitted documents for recording must be verified with both the Seller/Lawyer/Title Officer and buyer before recording. It's not the owners obligation to do the County Recorders job for them.
There is an obvious flaw to the system. And weirdly, but often, the government is not doing anything about it.
