Agree! I can't stand it when people bring up family/friend deaths as excuses. True or not, obviously sad if true, but to use that as part of the defense is ridiculous. Just say something horrible or personal and then let the judge ask WHY
The defendant is a joke. Tried to exploit his mother's cancer for NO REASON, and while I think he's entitled to those few cosmetic changes fixed, they're also a result of natural things that happen when you're dealing with an above ground pool. He's no different from when someone goes online and finds a picture of a $12,000 Prada dress and then brings it to their local tailor and wants to pay $250 and expects the exact same dress. If you want a perfectly aligned pool that isn't susceptible to things like the settling earth, the altering volumes of water, "looking" like an in-ground pool, you get an in-ground pool. Even the fact that he actually expected the plaintiff's to EXCAVATE some of his yard to make the pool level with his deck, he was quite literally trying to get an in-ground pool for the cost of an above-ground pool. I agree with the judge that the plaintiff was being a little petty at the end, but I also think the plaintiff is telling the truth when he says the problem was that the defendant wasn't truly worried about those smaller issues, he was worried about the fact that they altered the deck, and that's why they couldn't come to an agreement to handle the repairs.

@@TopherGrant being a judge doesn’t give you a free pass to be rude. If you ask a question it’s reasonable to give time to let people adequately respond instead of cutting people off within half a second of trying to respond.

The plantiff screwed up by not going out to the property when asked. He held the defendant hostage. "I'll fix it after I get paid" is essentially his answer.
But he still owed for the initial setup. He never paid in full.

I disagree with the Judge ruling in favor of the late fee and interest, especially because she agreed herself that they were wrong for holding him hostage ny refusing to do the repairs until they got paid and they told him that they were going to call to schedule a date to come out to his house and never called him. In my opinion, that's on them and he shouldn't have to eat the late fees and interest because the guy never said that he wasn't going to pay, only that he wanted them to fix their mistakes first making the job complete, which is completely reasonable.
But I do agree with the rest of her ruling of them going to fix what needs to be fixed and him paying the remainder of the bill.

The comment about the contingency and the contract being 20 pages. There can be a section on the contract that's for comments and notes pertaining to the particular job. Write down specifics of what the customer is asking for, that way they can sign off and it'll be there. It's not about changing the wording of the actual contract each time

To not harm the liner the pool will have to be emptied moved carefully, adjust the wall . refill it while someone stays there. Use a firetruck. The owner should of payed for the firetruck and then someone could of waited while it fills.

Wrong about the pool issue is cosmetic. The manufacturer says the buttresses are weight bearing, as well as each of those concrete footings, the metal posts have to sit on them to maintain the pool integrity. They should not move with the water install if they are placed correctly. I’m assuming no pool permits occurred. I installed mine myself and these install instructions were mandatory and required to pass inspection.
I think the reason people have above ground pools is that they don’t need to be permitted and cost .

I disagree with JM. “The customer agrees” to me means if the project goes forward the customer is agreeing to modifications.

The defendant's whiny and wants a bunch of stuff not in the estimate for free. If he was so concerned about the aesthetics he would have made a point of being there when the pool was installed. I think the job looks good. The plaintiffs seem like honest businessmen and I feel like they were above board in communicating realistic expectations to the defendant - especially since they merely installed the pool the defendant bought! I also believe the plaintiff when they told him the deck would not overlap like it used to. The defendant should then modify his deck. Bottom line is, defendant screwed up and he wants the plaintiffs to pay for it, and had unrealistic expectations on what the installation would look like. And his own letter demanded they fix the issues while simultaneously demanding them to not be on his property. Can't have it both ways. He wanted a new pool installed onto an existing foundation and expected it'd look just like the old one - and unfortunately, in this scenario there will be sizing and fit issues. To me it looks like they did a good job of trying to make it look good.

Defendant probably called plaintiffs and MF them up and down and refused to pay balance due so plaintiff said F him either I get paid and fix settling issues or I go to court. Believing plaintiffs more than defendant because of defendants comments to try a sway court in his favor. Judge made right decision.

A estimate a proposal then a invoice SHALL DESCRIBE ALL WORK. Any additional work ir JUST 1 MORE THING is a change order. Family & Friends are ok as long as you are specifying all work done.

It’s crazy to me judges and polices have very little expectation to control their emotions, and most of the time won’t be punished for not doing so. While regular citizens are expected to be in complete control of themselves and sometimes others around them. The punishment for not could be jail and fines. Citizens are expected to know all the laws and regulations because I didn’t know or I didn’t understand isn’t a valid defense in court. Where as police officers get qualified immunity from most mistakes except constitutional rights violations, because they can’t possibly know or understand every law they’re supposed to enforcing. But for some reason a lot of people feel like no one should be worried when encountering cops.

There is no way in hell that pool would fit under that deck. The defendant said I want a pool with out paying for an in ground pool and talking about his mom and that he’s in or was in the military. 100% what was in the contract was what he said it was. What does she think additional carpentry means?

They all knew it wouldn't fit that's why the defendant assumed they were going to excavate to make the pool fit under the deck.
My father, husband, brother in law and father in law do carpentry for a living. I would have assumed that they might have to change the deck in some way to safety have it meet the new pool as well. Idk what the judge was thinking or how it wouldn't mean changes to the wood 🤔
@@EmoNinjaKat89 he was just trying to get it cheaper there is no doubt about that. All his complaints were stuff that could be fixed in a couple of minutes cept the deck that he knew they were cutting it and he was just in a hurry.

It's weird because I've seen cases where the judge was more lenient to female plaintiffs in house construction projects. Because women are picky apparently. Women would complain about every small detail and the judge would give them sympathy saying that it was ugly or off a shade of color. However, this man is nitpicky about relatively the same issues, she is a little less forgiving. I feel she isn't as empathetic to his situation. Why did he have to pay for interest if the plaintiff refused to come back to his property?

I have no idea what was said verbally on the day of installation. But why would ANYONE want the deck to meet the pool the way they did it? It was a million times better with the deck overlapping the pool. I know they kept saying it was impossible, but they never said why.
They did say why you didn’t listen. The new pool was deeper than the old one. Defendant thought they would dig the new one in. Plaintiff cited some rule that said they couldn’t. Hence the problem.
Defendant has issues, more than wanting a free pool. And anyone can say they was in the military with no proof of being in there. And plus he would have been too short for the military. LMAO!

I could see it being problematic to hire a friend to do a construction job for you but all in all it depends upon the friendship and what the job entails. But remember there's always a huge risk because if things go left it could very well cost a friendship.
