A Congressional subpoena is only a requirement to "appear". Congress does not hold the power to detain or arrest anyone, so anyone at a Congressional hearing is legally allowed to leave any time they want to. All they have to do to comply with the subpoena, is show up, therefore they cannot hold him in contempt. Notice when Congressional hearings last longer than expected, they always ask the witnesses if they wouldn't mind staying longer. They're fully aware that they have no obligation to stay at all.

A Congressional subpoena is only a requirement to "appear". Congress does not hold the power to detain or arrest anyone, so anyone at a Congressional hearing is legally allowed to leave any time they want to. All they have to do to comply with the subpoena, is show up, therefore they cannot hold him in contempt. Notice when Congressional hearings last longer than expected, they always ask the witnesses if they wouldn't mind staying longer. They're fully aware that they have no obligation to stay at all.
