Fun fact: you are legally allowed to record your own phone calls so long as you are a party of the conversation. Federal Law (18 U.S.C. § 2511) requires one party consent. So you can record your own phone calls.
Depends on the state, too. Certain states are one-party or two-party states with regard to video/audio recording. Edit: It's stated in the video that Coffeezilla was in Texas, a one party consent state, so he should definitely be legally allowed to record his own conversations with people.

If Logan does decide to sue Coffee, then Coffee could have a compelling case for an Anti-SLAPP (Strategic Lawsuit Against Public Participation) countersuit. It will ultimately depend on the jurisdiction where Logan files, but it could mean that if Logan loses then he is required to not only pay Coffee's legal fee but also penalties to Coffee for the lawsuit itself. In the case of the manager's recording, Logan is not a party to that so it would be on his manager to file the lawsuit. Which even if Logan wants to bankroll the lawsuit, the manager's neck is the one on the line if an Anti-SLAPP counterclaim wins. If Logan decides not to pay the penalties, then the manager is still on the hook for them, so it really comes down to if his manager trusts that Logan will pay for everything.

According to my cursory research, the "illegal" recording of the phone call with Logan's manager Jeff would be totally legal. In Texas (Coffeezilla is based in Houston if I'm not mistaken), recording a phone conversation (whether in person or digitally) is legal so long as one of the parties on the phone is consenting to the call being recorded. Considering Coffeezilla recorded the conversation himself, it's safe to say that he consented lmao
It would even be legal everywhere else, because Coffee specifically asked the guy for comment on the situation for his ongoing investigation. Hence the replies centered around the magical phrase "no comment". Sure, there was more talk than just no comment, but it was clear as day that this call might very well be made public.

I'm a lawyer and, let me assure you: this is basically every lawyer's dream. This is the litigatory equivalent of going into trial with a taped confession of the plaintiff saying "Yeah, I'm the actual mastermind, and I'm planning to throw the defendant under the bus" and then describing, word-for-word all the 'evidence' the prosecution has and how they forged it. Wade called businesses in Texas to defame Myer to get them to not sell Myer's comic book. Myer sued Wade for defamation and got a $200,000 war chest in donations from his community to do it. Wade did everything he could do do stall, and cost more money to Myer. The $200,000 war chest dried up and eventually, Myer had to spend his own money to keep it going. 2 years later there was still nothing actually happening, so Myer was forced to settle with Wade. It costs a lot of money to sue, and it costs a lot of money to defend when being sued. That's why a lot of content creators are bullied by false DMCA, which happens all the damn time. Sue and then stall. The side with the deeper pockets wins 99% of the time.
I'm betting that Coffeezilla ran his story by a lawyer before posting. Doesnt mean Logan would win tho, because the evidence that was available pointed heavily to the conclusion that Coffeezilla made. If Logan truly wants a chance at winning a lawsuit against Coffeezilla, he would need to sue the criminal developers who were acting with malicious intent. Which, by the way, hiring people who have a felony isnt the same as hiring criminals, so that sueing might also not work as Zach Kelling has not been doing any criminal activities after he served justice. So not only would Logan need to prove that all his fired teammembers were working with malicious intent, he would also need to finish the game in a way where its not scamming any people directly and would be promoted that people can lose money(as its essentially Lootbox the Game). It’s important to wait and see how this develops. When it comes to Texas law which Charlie mentioned, I don’t think that matters as it’s possible for him to just go jurisdiction shopping. Even if there aren’t any legal merits for a lawsuit, he could still sue for the sake of publicity and to cost Steven a lot of money and stress. If I were Logan, I wouldn’t sue because that would given Steven the right to request documents through discovery providing more evidence to him about CryptoZoo and the schemes.

If Logan does decide to sue Coffee, then Coffee could have a compelling case for an Anti-SLAPP (Strategic Lawsuit Against Public Participation) countersuit. It will ultimately depend on the jurisdiction where Logan files, but it could mean that if Logan loses then he is required to not only pay Coffee's legal fee but also penalties to Coffee for the lawsuit itself.
In the case of the manager's recording, Logan is not a party to that so it would be on his manager to file the lawsuit. Which even if Logan wants to bankroll the lawsuit, the manager's neck is the one on the line if an Anti-SLAPP counterclaim wins. If Logan decides not to pay the penalties, then the manager is still on the hook for them, so it really comes down to if his manager trusts that Logan will pay for everything.

According to my cursory research, the "illegal" recording of the phone call with Logan's manager Jeff would be totally legal. In Texas (Coffeezilla is based in Houston if I'm not mistaken), recording a phone conversation (whether in person or digitally) is legal so long as one of the parties on the phone is consenting to the call being recorded. Considering Coffeezilla recorded the conversation himself, it's safe to say that he consented lmao
It would even be legal everywhere else, because Coffee specifically asked the guy for comment on the situation for his ongoing investigation. Hence the replies centered around the magical phrase "no comment". Sure, there was more talk than just no comment, but it was clear as day that this call might very well be made public.

I'm a lawyer and, let me assure you: this is basically every lawyer's dream. Logan is perfectly willing to spend literally MILLIONS in legal expenses to sue coffeezilla instead of simply just using that same money to refund the people who were caught up in his incompetence while selling a "Game" that was made by a team of scammers and con artists.

The man makes an aproximated $35 million a year so he has the means to make this right and just doesn't want to.

Wade called businesses in Texas to defame Myer to get them to not sell Myer's comic book. Myer sued Wade for defamation and got a $200,000 war chest in donations from his community to do it. Wade did everything he could do do stall, and cost more money to Myer. The $200,000 war chest dried up and eventually, Myer had to spend his own money to keep it going. 2 years later there was still nothing actually happening, so Myer was forced to settle with Wade.
It costs a lot of money to sue, and it costs a lot of money to defend when being sued. That's why a lot of content creators are bullied by false DMCA, which happens all the damn time. Sue and then stall. The side with the deeper pockets wins 99% of the time.

I'm betting that Coffeezilla ran his story by a lawyer before posting. If Logan chooses to sue him, he's only going to out himself further and deeper as a scammer, he could end up with criminal charges because this "game" is apparently not up and running and penguin didn't show the very end where Logan Paul has the dates 2023/2024 as if it's still to come. People have lost millions, a judge could rule that Logan Paul pay them all back. I'm going to say Logan threw out an empty threat because he knows he owes people money and he might have intentionally hired scammers, because he is one, birds of the feather.

Doesnt mean Logan would win tho, because the evidence that was available pointed heavily to the conclusion that Coffeezilla made.
If Logan truly wants a chance at winning a lawsuit against Coffeezilla, he would need to sue the criminal developers who were acting with malicious intent. Which, by the way, hiring people who have a felony isnt the same as hiring criminals, so that sueing might also not work as Zach Kelling has not been doing any criminal activities after he served justice.
So not only would Logan need to prove that all his fired teammembers were working with malicious intent, he would also need to finish the game in a way where its not scamming any people directly and would be promoted that people can lose money(as its essentially Lootbox the Game). And that is going to be incredibly tough to do.

recording thing could go either way. depends on the state the recorder was in at the time. some states have one party consent laws, where only one party needs to consent to recording. i feel like most people know recording phone calls has legal ramifications so i have sincere doubts coffeezilla would have illegally recorded a phone call and then used it in a video without having something in his pocket, like being in a one party consent state or something. i don't think hes dumb enough to get caught on that.

It’s important to wait and see how this develops. When it comes to Texas law which Charlie mentioned, I don’t think that matters as it’s possible for him to just go jurisdiction shopping. Even if there aren’t any legal merits for a lawsuit, he could still sue for the sake of publicity and to cost Steven a lot of money and stress. If I were Logan, I wouldn’t sue because that would given Steven the right to request documents through discovery providing more evidence to him about CryptoZoo and the schemes.
